TOWN OF ALLEN - - ORDINANCE NO. /
AN ORDINANCE VACATING, CLOSING AND ABANDONING AN ALLEY
20 FEET WIDE BY 100 FEET LONG, OUT OF BLOCK 6 OF THE
TOWN OF ALLEN, AND AUTHORIZING AND DIRECTING THE MAYOR
TO EXECUTE A QUIT CLAIM DEED OF THE SAME TO G. C. MATHEWS,
WHICH DEED IS TO BE ATTESTED TO BY THE CITY -SECRETARY, AND
DECLARING AN EMERGENCY
BE IT ORDAINED BY THE BOARD OF ALDERMEN OF THE TOWN OF
ALLEN, TEXAS
SECTION I: After the necessary application, as required by
law, made by G. C. Mathews, the property owner
effected thereby, requesting the Town of Allen
to vacate, close and abandon an alley in Block
6 of said town, said alley being described as
follows:
SITUATED in the town of Allen, Collin County,
Texas, in the J. L. Read Survey, and
BEGINNING at a point at the SW cor. of Lot 8
of Blk. 6 of said town;
THENCE in an easterly direction with the S lines
of Lots 8 and 9 of said block, 100 ft. to the SE
cor, of Lot 9;
THENCE in a southerly direction 20 ft. to the NE
cor. of Lot 6 of Blk. 6;
THENCE in a westerly direction with the N line
of Lots 6 and 7 of said block, 100 ft. to the NW
cor. of Lot 7;
THENCE in a northerly direction 20 ft. to the
place of beginning.
and after considering the same, it is the opinion
of the Board of Alderman of the Town of Allen,
that the existance of said alley is a detriment
to the Town of Allen, and should be vacated,
closed and abandoned and further, that Virgil
Watson, Mayor, should be authorized and directed
to execute a Quit -Claim Deed to G. C. Mathews,
conveying all of the right, title, interest of
the Town of Allen, in said tract of land, to
G. C. Mathews, such Deed to be attested by A.
C. Story, City -Secretary, and the official seal
of said town to be affixed thereto. It is,
therefore, the Order of the Board of Alderman
of the Town of Allen, that the alley above
described be, and the same is hereby vacated,
closed and abandoned by the Town of Allen, so
that the Town of Allen will have no further
claim thereon and that Virgil Watson, Mayor,
is hereby authorized and directed to execute
a Quit -Claim Deed on behalf of said town con-
veying the same to G. C. Mathews, and that A.
C. Story, City -Secretary, attest said Deed and
affix thereto the official seal of the town of
Allen.
SECTION II: The fact that for the general welfare of the
Town of Allen, it is necessary that the above
described alley be vacated, closed and abandoned,
and that time is of the essence, and the same
creates an emergency and an imperative public
necessity: This ORDINANCE to take effect
immediately.
PASS AND APPROVED this the 2,y J day of October

TO: THE CITY COUNCIL OF THE TOWN OF ALLEN
COMES NOW G. C. Mathews, and would respectfully show the
following:
I.
That he is the owner of Lots 6, 7, 8 and 9 in Block 6 of
the town of Allen, and that Lots 6 and 7 are separated on the
Official Map of said town from Lots 8 and 9 by a 20 foot alley.
II.
That although the map of said town shows such an alley, the
same has never been opened for public travel and has, in fact,
been surrounded by fence and for many years certain farm improve-
ments have been constructed across said alley and that the loca-
tion of said alley is not marked on the ground.
III.
That said alley is described as follows:
SITUATED in the Town of Allen, Collin County,
Texas, in the J. L. Read Survey, and
BEGINNING at a point at the SW cor. of Lot 8
of Blk. 6 of said town;
THENCE in an easterly direction with the S
lines of Lots 8 and 9 of said block, 100 ft.
to the SE cor. of Lot 9;
THENCE in a southerly direction 20 ft, to the
NE cor. of Lot 6 of Blk. 6;
THENCE in a wewterly direction with the N line
of Lots 6 and 7 of said block, 100 ft. to the
NW cor. of Lot 7;
THENCE in a northerly direction 20 ft. to the
place of beginning.
IV.
That this Petitioner owns all of the property on each side
of said alley and respectfully submits that the existence of
said alley is a detriment to the Town of Allen, in that said
town has the burden and obligation to maintain said alley yet
realizes no benefit from the same.
WHEREFORE, premises considered, this Petitioner respectfully
prays that said alley be vacated, abandoned and closed by the
Town of Allen, and that the same revert to and become the pro-
perty of Applicant under Article 1016, VATS and that this City -
Council authorize and direct Virgil Watson, Mayor, to execute a
Quit -Claim Deed to be attested by A. C. Story, City -Secretary,
conveying the above described property to G. C. Mathews.
