AN ORDINANCE AMENDING THE ZONING ORDINANCE -
1960, TOWN OF ALLEN, TEXAS, CHANGING FROM
"A," DWELLING DISTRICT ZONING, TO "G,"
LOCAL BUSINESS DISTRICT ZONING, THE PRO-
PERTY HEREINAFTER DESCRIBED; PROVIDING FOR
PENALTIES, A SAVINGS CLAUSE, PUBLICATION,
AND PROVIDING FOR AN EMERGENCY
BE IT ORDAINED by the City Council of the Town of Allen,
That in accordance with the Zoning Ordinance -1960 for
the Town of Allen, Texas, appropriate application has heretofore
been made and due and legal notice given to such application, to
change from "A," Dwelling District Zoning, to "G," Local Business
District Zoning, the property hereinafter described.
That such application for the zoning change has been
submitted to the Zoning Commission of the Town of Allen, which
has recommended in writing to the City Council of the Town of
Allen that such application to change the zoning be approved.
That appropriate timely legal notice has been published
in accordance with law prior to the meeting of the City Council
of the Town of Allen.
That, therefore, the zoning and classification of the
following described property, to -wit:
All of that certain lot, tract or parcel of land
situated in Collin County, Texas, to -wit:
Being a part of the Wm. Perrin Survey and the
David Wetsel Survey and being a part of a 49.51
acre tract conveyed by S. Eros Brown to Gentry
T. Jones by deed recorded in Volume 557, Page
175 of the Deed Records of Collin County, Texas,
to -wit:
Beginning at a stake in the SW corner of said
49.51 acre tract, said stake being in the E
right of way line of old U. S. 75 (now State
Highway No. 5) and the center line of a branch
of Cottonwood Creek;
Thence North 30 deg. 39 min. E with the right
of way line of said Highway 794.6 ft, to a
stake therein;

Thence S 59 deg, 21 min. E 649,3 ft, to a stake;
Thence S 30 deg. 39 min. W parallel to the right
of way line of said Highway 543.4 ft. to a stake
in the S line of said 49.51 acre tract, which
stake is in the middle of a creek;
Thence in a Westerly direction with the middle
of said creek and conforming to the meanderings
thereof and being described by metes and bounds
as follows;
S 87 deg. 38 min, W 16.9 ft. N 80 deg. 12 min,
25 sec. W 679.63 ft. to the place of beginning
and containing 10 acres of land, of which 6,33
acres are in the Wm. Perrin Survey and 3.67
acres are in the David Wetsel Survey;
shall be, and it is hereby, changed from its present "A," Dwelling
District Zoning, to "G," Local Business District Zoning, and the
Zoning Ordinance -1960, Town of Allen, Texas, is hereby so amended.
That all provisions and penalties applicable to "G,"
Local Business District Zoning, as provided for in the Zoning
Ordinance -1960, Town of Allen, Texas, shall apply to the property
herein described.
This ordinance shall be published twice in the McKinney
Examiner, a newspaper of general circulation in Allen, Texas, the
first publication of which shall be within one (1) week and the
second publication of which shall be within two (2) weeks after
this ordinance has been passed and approved.
The fact that there is an imperative public need and
necessity that the zoning be changed on the property described
here creates an emergency and the reading and passing of this
ordinance at three separate meetings is hereby suspended and
this ordinance shall take effect and be in full force from and
after the passage at a single meeting and the approval thereof
by the Mayor.
