AN ORDINANCE AUTHORIZING THE SALE OF 128.262
ACRES OF LAND AND PROVIDING FOR AN EFFECTIVE
DATE HEREOF.
THAT WHEREAS, the Town of Allen, Texas, is the
owner of 128.262 acres of land more fully described as
follows, to -wit:
SITUATED in Collin County, Texas; a part of the R. C.
Ingram Survey, .Abstract No. 462, and a part of the R. C.
Whisenant Survey, Abstract No. 1012, and a part of the
J. 0. Straughan Survey, Abstract No. 825, and being a
re -survey of all of a 10, 36 and 83 acre tracts as
described in a deed from Clarence W. Moulden to the
Town of Allen, Texas, dated Sept. 16, 1965, and recorded
in Volume 661, Page 200 of the Collin County Deed
Records, and the re -survey being more particularly
described by metes and bounds as follows:
BEGINNING at an iron stake by a corner post in the
Northwest corner of the said 83 acre tract. Said stake
also being in the Southeast corner of the said 10 acre
tract;
THENCE SOUTH 88 degrees 07 minutes West with an
established fence line and hedge row along the South
line of the said 10 acre tract a distance of 967.0 feet
to a corner post at the Southwest corner of the said
tract;
THENCE NORTH 0 degrees 35 minutes East with an
established fence line and hedge row along the west
line of the said 10 acre tract a distance of 461.5 feet
to an iron stake; Same being in the Northwest corner of
the said tract;
THENCE NORTH 88 degrees 07 minutes East with the
South line of a public road and the North line of the
said 10 acre tract a distance of 962.5 feet to an iron
stake in the Northeast corner of the said tract. Said
stake also being in the West line of the said 36 acre
tract;
THENCE NORTH with the West line of the said 36 acre
tract a distance of 125.9 feet to an iron stake at the
Northwest corner of the said 36 acre tract;
THENCE NORTH 88 degrees 28 minutes East with the
North line of the said 36 acre tract a distance of 2695.9
feet to a stake in the center line of Cottonwood Creek.
Said stake bears North 88 degrees 28 minutes East, 42.7
feet from an iron stake. Ski stake being at the Northeast
corner of the said 36 acre tract;
THENCE IN A SOUTHERLY direction down stream with the
center line meanders of the said creek along the East line
of the said 36 and 83 acre tracts as follows:
SOUTH 28 degrees 45 minutes East, 159.0 feet;
SOUTH 16 degrees 37 minutes West, 564.0 feet;
SOUTH 27 degrees 00 minutes East, 247.0 feet;
SOUTH 03 degrees 59 minutes West, 765.0 feet;
SOUTH 34 degrees 58 minutes West, 340.2 feet to a
stake in the Southeast corner of the said 83 acre
tract. Said stake bears North 88 degrees 34 minutes
East, 116.1 feet from an iron stake;
THENCE SOUTH 88 degrees 34 minutes West, with an
established fence line along the South line of the
said tract a distance of 2475.1 feet to a corner post
at the Southwest corner of the said tract;
THELE NORTH with an established fence line and
hedge row along the West line of the said 83 acre tract
a distance of 1343.7 feet to the place of beginning,
CONTAINING 128.262 acres of land,
and
WHEREAS, such land is no longer needed for municipal
purposes and it would be to the best interest of the
Town of Allen and its inhabitants that such land be
sold; NOW, THEREFORE
BE IT ORDAINED BY THE COUNCIL OF THE TOWN OF ALLEN,
TEXAS:
Section 1: That the above described property be
sold to Harrold L. Kallenberg, Milton Rubin and Herman
M. Waldman for a cash consideration of $110,000.00.
Section 2: That Gentry T. Jones, Mayor of the
Town of Allen, be and he is hereby authorized to execute
and deliver a general warranty deed conveying such real
estate as aforesaid, which said deed shall be attested
to by A. C. Story, the City Secretary, and the seal of
the Town of Allen affixed thereto.
Section 3. This Ordinance to take effect immediately
after its passage and approval and it is so ordained.
Duly passed and approved by the Council of the Town
of Allen, Texas, on this the � �day of June, 1966.
