AN ORDINANCE PROHIBITING THE CONSUMPTION OF
ALCOHOLIC BEVERAGES ON ANY STREET, ALLEY OR
OTHER PUBLIC PLACE ADJACENT TO A PUBLIC STREET
OR ALLEY IN THE CITY OF ALLEN; PROVIDING FOR
THE ARREST WITHOUT WARRANT OF PERSONS VIOLATING
THE TERMS OF THIS ORDINANCE; PROVIDING FOR A
PENALTY FOR THE VIOLATION OF THIS ORDINANCE;
PROVIDING FOR THE PUBLICATION OF THE CAPTION
OF THIS ORDINANCE.
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF
ALLEN, TEXAS:
SECTION 1: That from and after the effective date
of this Ordinance it shall be unhwful for any person
to consume any alcoholic beverage on any public street
or alley in the City of Allen, Texas.
SECTION 2: That from and after the effective date
of this Ordinance it shall be unlawful for any person to
consume any alcoholic beverage on any public place
adjacent to any street or alley in the City of Allen, Texas.
SECTION 3: That from and after the effective date
of this Ordinance the Chief of Police or other policemen
of the City of Allen or any peace officer within the
limits of the City of Allen may arrest without warrant
any person who violates the terms of this Ordinance and
the officer or person making the arrest is justified in
adopting all of the measures which he might adopt in
cases of arrest under warrant provided further that in
all cases of arrest without warrant, the officer making
the arrest shall immediately take the person arrested before
the nearest or most accessible Magistract having jurisdiction.
SECTION 4: Any person found guilty of violating
the terms of this Ordinance shall be deemed guilty of
a misdemeanor, and upon conviction therefor shall be
fined any sum not to exceed $200.00.
SECTION 5: The caption of this Ordinance shall be
published one (1) time in a newspaper having general
circulation in the City of Allen and shall be effective
immediately upon its passage and such publication.
