ORDINANCE NO. 7-3
AN ORDINANCE CREATING A PUBLIC LIBRARY FOR THE
CITY OF ALLEN, TEXAS; PROVIDING FOR THE CREATION OF
A LIBRARY BOARD; PROVIDING FOR THE APPOINTMENT OF
A LIBRARIAN; PROVIDING FOR THE ORGANIZATION AND
DUTIES OF THE LIBRARY BOARD AND LIBRARIAN; PROVIDING
REGULATIONS FOR THE OPERATION OF THE PUBLIC LIBRARY;
PROVIDING A PENALTY FOR THE WILFUL INJURING OR
DEFACING OF ANY BOOK, NEWSPAPER OR OTHER PROPERTY
BELONGING TO THE PUBLIC LIBRARY; PROVIDING FOR THE
PUBLICATION OF THE CAPTION OF THIS ORDINANCE, AND
PROVIDING FOR AN EFFECTIVE DATE HEREOF.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
ALLEN, TEXAS:
SECTION 1. CREATION OF A PUBLIC LIBRARY.
There is hereby created a city library to be
known as the "Allen Public Library."
SECTION 2. USE OF THE PUBLIC LIBRARY.
Use of the public library shall be free to all
citizens of the City of Allen, Texas, and the surrounding
area.
SECTION 3. THE LIBRARY BOARD.
There is hereby created a library board which
shall be composed of five (5) members. Its officers
shall consist of a chairman, vice chairman, a secretary
and treasurer and such officers shall be selected by the
members of the Board from its members.
The object and purpose of the library board
is to act as an advisory, policy-making board to the City
and Council and librarian, relating to the establishment

and usage of the library, the nature of the services
rendered or to be rendered by the librarian, the manner
in which the library service may be coordinated with the
services of the other libraries which render services to
the citizens of the City, and such other manners as the
Council may deem beneficial to the City of Allen.
The members of the library borad shall be
resident citizens of the City of Allen and the surrounding
area, shall be taxpayers and qualified voters. All members
of the library board shall be appointed by the City
Council from a slate recommended by the library board.
Vacancies on the library board occurring other than
through the expiration of a term of office shall be filled
by the City Council from recommendations from the board.
Such appointees shall serve for that portion of the unexpired
term remaining for the vacancy being filled.
With the exception of the original appointment,
the term of office shall be two (2) years. Two members
shall be appointed in even numberedyears and three members
appointed in odd numbered years. Appointments shall be
made by the City Council at the first meeting of the
Council in the month of May of each year. No person shall
be reappointed to the board without having been retired
from the board for at least one (1) year.
Bylaws governing the board shall be promulgated
by the board and shall be subject to the approval of the
City Council. The bylaws of the board may be amended by
a majority vote of the board with the approval of the
City Council.

SECTION 4. LIBRARIAN.
The Librarian shall be the chief administrative
officer of the public library and shall be appointed
by the Library Board subject to the approval of the
City Council. The Librarian shall be by profession
a librarian and shall receive such compensation as shall
be determined by the Library Board with the approval
of the City Council.
SECTION 5. LIBRARY HOURS.
The library shall be kept open for the use of
the citizens of the City of Allen and the surrounding
area during such hours as may be fixed by the Librarian
after consultation with the Library Board.
SECTION 6. REGULATIONS FOR THE OPERATION OF THE
ALLEN PUBLIC LIBRARY
General rules and regulations for the operation
and use of the library shall be left to the direction of
the Librarian with approval of the Library Board. Whoever
wilfully injures or defaces any book, newspaper, magazine,
pamphlet manuscript or other property belonging to the
public library by writing, marking, tearing, breaking or
otherwise mutilating and whoever shall wilfully detain
any book, magazine, newspaper, pamphlet, manuscript or
other property belonging to the public library for thirty

(30) days after notice in writing to return the same,
given after the expiration of the time by which the rules
of the library such property may be kept, shall be deemed
guilty of a misdemeanor, and upon conviction therefor,
shall be fined an amount not more than $2$.00.
SECTION 7.
A registration card must be signed and on file
in the library for each user of the library who desires
to be loaned books and other library materials and
equipment.
SECTION 8.
The caption of this ordinance shall be published
one (1) time in a newspaper having general circulation in
the City of Allen, Texas, and shall be effective immediately
upon its adoption and such publication.
