AN ORDINANCE ANNEXING TERRITORY TO THE CITY OF
ALLEN, TEXAS, AND EXTENDING THE BOUNDARY LIMITS
OF SAID CITY SO AS TO INCLUDE SAID PROPERTY
WITHIN THE CITY LIMITS AND GRANTING TO ALL THE
INHABITANTS OF SAID TERRITORY ALL OF THE RIGHTS
AND PRIVILEGES OF OTHER CITIZENS AND BINDING SAID
INHABITANTS BY ALL OF THE ACTS, ORDINANCES,
RESOLUTIONS AND REGULATIONS OF THE CITY; PROVIDING
FOR ZONING CLASS "A -RESIDENTIAL"; PROVIDING FOR
A PENALTY FOR THE VIOLATION OF THIS ORDINANCE;
AND PROVIDING FOR AN EFFECTIVE DATE OF THIS ORDINANCE,
AND PUBLICATION OF THE CAPTION HEREOF.
WHEREAS, application having been duly made for annexing
the below described territory to the City of Allen, Texas,
which application is in the form of a petition duly and
legally executed and filed with the Mayor of the City
of Allen, Texas, and the Mayor, having certified the same
to the Council of the City of Allen, Texas, and
WHEREAS, a public hearing was held not more than
twenty nor less than ten days prior to the institution
of such annexation proceedings with notice of such hearing
given in the manner prescribed by law and all other require-
ments of notice and completion of such annexation procedure
being fulfilled, and
WHEREAS, the Council of the City of Allen has investigated
into and determined that all of the facts contained in
said petition are true, and
WHEREAS, the Council of the City of Allen has investigated
and determined that it will be advantageous and beneficial
to the City of Allen and its inhabitants as well as the
hereinafter described territory to annex such territory
to the City of Allen, Texas;
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE
CITY OF ALLEN, TEXAS:
SECTION 1: That the territory described as follows
be and the same is hereby annexed to the City of Allen,
Texas, to -wit:
SITUATED in Collin County, Texas, out of the William
Snider Survey, Abstract No. 821, and being a part of a
43.17 acre tract of land as conveyed from Earnest A.
Northern, Jr, et ux, Doris D. Northern to C. C. Gregory
and W, E, Gregory by deed dated April 119 19569 and recorded
in Volume 516, Pages 47 - 48 of the Collin County Deed
Records as follows:
BEGINNING at a point for corner in South R.O.W.
line of Farm -Market Road No. 2170; said corner being
South 89 degrees 56 minutes East 1327.92 feet and South
O degrees 30 minutes East 45,0 feet from the Northwest
corner of said Snider Survey;
THENCE SOUTH 0 degrees 30 minutes East 1371.36 feet
to a point for corner;
THENCE NORTH 89 degrees 56 minutes West along an
established fence line, 1327.92 feet to a point for
corner in the center of a graveled road;
THE24CE NORTH 0 degrees 30 minutes West along the
center of said graveled road, 1321.36 feet to a point
for corner in the South R.O.W. line of said F.M. Road
No. 2170;
THENCE IN A NORTHERLY direction along the South
R.O.W. line of said F. M. Road as follows:
NORTH 89 degrees 56 minutes East 25,0 feet;
NORTH 44 degrees 49 minutes 30 seconds East 70.33 feet, and
SOUTH 89 degrees 56 minutes East 1252.92 feet to
the place of beginning, and
CONTAINING 41.738 acres of land.
SECTION 2: That from and after the passage of
this Ordinance, said territory shall be a part of the
City of Allen, Texas, and the inhabitants thereof shall
be entitled to all of the rights, privileges and immunities
of all other citizens of the City of Allen, Texas, and
shall be bound by all of the ordinances and regulations
enacted pursuant to and in conformity with the general
laws of the State of Texas,
SECTION 3: That from and after the passage of this
Ordinance said territory shall be zoned Class T'All Residential.
SECTION 4: It shall be unlawful for any person,
firm or corporation to make use of said premises in
some manner other than as authorized by this Ordinance,
and it shall be unlawful for any person, firm or corporation
to construct on said premises any building that is not
in substantial conformity with Class "All Residential
zoning.
SECTION 5: Any person, firm or corporation who
violates any provision of this Ordinance shall be deemed
guilty of a misdemeanor, and upon a conviction thereof,
shall be fined any sum not exceeding Two Hundred Dollars,
and each and every day that such violation continues
shall be considered a separate offense provided however
that such penal provisions shall not preclude a suit
to enjoin such violation.
SECTION 6: The caption of this Ordinance shall be
published ten days in a newspaper having general circulation
in the City of Allen, Texas, and shall be effective
immediately upon its passage and such publication.
Duly passed and approved by the City Council of the
