HomeMy WebLinkAboutO-4203-1-26ORDINANCE NO. 4203-1-26 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF ALLEN, COLLIN COUNTY, TEXAS, AMENDING THE CODE OF ORDINANCES BY AMENDING CHAPTER 2, “ADMINISTRATION” BY ADDING A NEW ARTICLE XI, “TERMINATION OF CAMPAIGN TREASURER APPOINTMENT”; PROVIDING A SEVERABILITY CLAUSE; PROVIDING A REPEALING CLAUSE; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the City of Allen, Texas, is a home rule municipality acting under its chapter adopted by the electorate pursuant to Article XI, Section 5 of the Texas Constitution and Chapter 9 of the Local Government Code; and, WHEREAS, Texas Election Code, Section 252.0131 allows for a process by which the City Secretary may terminate the campaign treasurer appointment of an inactive candidate or political committee that is required to file a campaign treasurer appointment with the City Secretary; and, WHEREAS, the City Council desires to adopt a procedure by which the City can terminate the campaign treasurer of an inactive candidate or political committee; and, WHEREAS, the City Council finds that the amendment to Chapter 2, “Administration,” as outlined herein, is in the best interest of the City and will promote the health, safety, and general welfare of the citizens of the City of Allen and the general public. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ALLEN, COLLIN COUNTY, TEXAS, THAT: SECTION 1. Chapter 2, “Administration” of the Code of Ordinances, City of Allen, Texas, is hereby amended in part by adding Article XI, “Termination of Campaign Treasurer Appointment,” to read as follows: “ARTICLE XI. - TERMINATION OF CAMPAIGN TREASURER APPOINTMENT Sec. 2-307. - Termination of campaign treasurer appointment by the City Secretary. (a) The city secretary is authorized to terminate campaign treasurer appointments for inactive candidates or inactive political committees following consideration of and vote by the city council at a regularly scheduled meeting, to terminate the appointment. (b) In this article, “inactive candidate” or “inactive political committee” means a candidate or political committee that: (1) Has never filed or ceased to file a required report under Texas Election Code, Chapter 254, as amended (political reporting) for more than one (1) year since the last reporting deadline; and (2) In the case of a candidate, has not been elected to an office for which a candidate is required to file a campaign treasurer appointment with the city secretary; and (3) Has not filed: (i) A final report under Texas Election Code, Section 254.065, as amended (Final Report) or Texas Election Code, Section 254.125, as amended (Final Report of Committee for Supporting or Opposing Candidate or Measure); or
