' AN ORDINANCE AMENDING THE ALLEN LAND DEVELOPMENT CODE, AS
AMENDED, BY AMENDING SECTION 4.10.6 "RESIDENTIAL. ACCESSORY USE
REGULATIONS" BY ADDING A NEW PARAGRAPH "Q" REGARDING THE
REPAIR AND SALE OF CERTAIN MOTOR VEHICLES AS A HOME
OCCUPATION; ADDING A NEW SECTION 6.06.12 "CERTAIN VETERINARY
HOSPITALS, ANIMAL CLINICS, OR ANIMAL BOARDING FACILITIES" TO
PROVIDE FOR SUPPLEMENTAL USE REGULATIONS FOR VETERINARY
HOSPITALS, ANIMAL CLINICS, OR ANIMAL BOARDING FACILITIES AND
MAKING RELATED AMENDMENTS TO SECTION 6.06; AMENDING SECTION
8.13.11 "STORMWATER DETENTION FACILITIES" REGARDING THE DESIGN
AND MAINTENANCE OF CERTAIN STORMWATER DETENTION FACILITIES;
AMENDING APPENDIX F "STANDARD CONSTRUCTION DETAILS: PAVING,"
APPENDIX G "STORM DRAINAGE AND TXDOT DETAILS," AND APPENDIX H
"WATER LINES AND SANITARY SEWER"; AMENDING THE DEFINITION OF
"VETERINARY HOSPITAL OR CLINIC" IN APPENDIX A "DEFINITIONS" TO
INCORPORATE THE BOARDING OF ANIMALS; AMENDING SECTION 4.20.2
"SCHEDULE OF PRINCIPAL USES" AND SECTION 4.20.4 "SCHEDULE OF
PRINCIPAL USES CENTRAL BUSINESS DISTRICT" BY AMENDING THE USE
"VETERINARY HOSPITAL OR CLINIC;" PROVIDING A CONFLICTS
' RESOLUTION CLAUSE; PROVIDING A SEVERABILITY CLAUSE; PROVIDING
FOR A SAVINGS CLAUSE; PROVIDING FOR PENALTY OF FINE NOT TO
EXCEED THE SUM OF TWO THOUSAND ($2,000) DOLLARS FOR EACH
OFFENSE; AND PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, the Planning and Zoning Commission and the governing body of the City of Allen, Texas, in
compliance with the laws of the State of Texas and the Ordinances of the City of Allen, Texas, have given the
requisite notices by publication and otherwise, and after holding due hearings and affording a full and fair hearing
to all persons interested and in the exercise of its legislative discretion, the City Council has concluded that the
Allen Land Development Code Zoning Regulations of the City of Allen, Texas, as previously amended, should
be further amended as follows:
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ALLEN,
COLLIN COUNTY, TEXAS, THAT:
SECTION 1. The Allen Land Development Code, Section 4.10.6 "Home Occupations" shall be amended
by adding paragraph "q" to read as follows:
q. Except for a person working on or selling a motor vehicle owned by the person and
subject to all other applicable laws, rules, ordinances and regulations, the service,
repair, painting, or onsite selling of any motor vehicle, including, but not limited to,
automobiles, motorcycles, trailers, boats, personal watercraft, recreation vehicles and
' lawn equipment is not authorized as, and is specifically excluded from the definition
of, a home occupation.
SECTION 2. The Allen Land Development Code, Section 6.06 "Supplemental Use Regulations" shall be
amended by replacing the phrase "Section 6.06.11" wherever it appears with the phrase "Section 6.06.12."
SECTION 3. The Allen Land Development Code, Article VI "Special Zoning Provision" shall be amended
' by adding a new Section 6.06.12 titled "Certain veterinary hospitals, animal clinics, or animal boarding
facilities" to read as follows:
Sec. 6.06.12. — Certain veterinary hospitals, animal clinics, or animal board facilities.
Any outdoor runs, outdoor kennels or other outdoor areas, to be used by animals,
associated with a veterinary hospital, animal clinic or animal boarding facility shall not be
located within 100 feet of any residentially zoned property.
SECTION 4. The Allen Land Development Code, Section S. 13.11 "Stormwater detention facilities" shall
be amended in its entirety to read as follows:
ll. Stormwater detention facilities. Stormwater detention facilities constructed in
association with development of property shall be subject to the following:
a. Concurrently with the submission of plans for the design of the public
improvements in the city, the developer shall provide to the Engineering
Department a written engineering analysis prepared and sealed by a Texas
Registered Professional Engineer and satisfactory to the Director of
Engineering indicating that all required stormwater detention facilities are
designed to reduce outflows from the detention pond following each storm
event to pre -developed flows for a 5 year, 10 year, 25 year, 50 year, and 100
year frequency storm event.
b. All stormwater detention facilities required for the development of all
phases of a proposed subdivision must be constructed at the time of
development of the first phase of development, and shall be built for the
ultimate condition at the time of initial construction unless otherwise
approved by the Director.
C. Section 8.20 of this code shall govem the establishment of a homeowners'
association or property owners' association and the perpetual operation,
maintenance and supervision of a stormwater detention facility constructed
as required by this section.
d. In the event a stormwater detention facility is designed and/or constructed to
receive stormwater from properties, which, at the time of construction of the
facility, are under different ownership, the Director shall have the authority
to approve a drainage facility maintenance agreement between or among the
Property owners that establishes the operational and financial obligations of
the respective property owners relative to the perpetual operation,
maintenance and supervision of the facility. Such agreement must be
submitted to and approved by the Director (i) prior to approval of a final
plat, if the property to be served by the facility is not yet platted, (ii) prior to
issuance of a building permit if the property served by the facility is platted
but no development has occurred on the property, or (iii) prior to issuance of
' a certificate of occupancy for any structure on the property to be served by
the facility when construction on the property has commenced when the
requirement for the construction of the facility arises. Any drainage facility
maintenance agreement approved pursuant to this Paragraph d must provide
that:

Veterinary hospital, animal clinic or animal boarding facility means a place for the care,
grooming, diagnosis and/or treatment of animals, and/or overnight boarding of animals.
SECTION 6. The Allen Land Development Code, Section 4.20.2 "Schedule of principal uses" shall be
amended by replacing the phrase "Veterinary Hospital or Clinic" with the phrase "Veterinary hospital, animal
clinic or animal boarding facility."
SECTION 7. The Allen Land Development Code, Section 4.20.4 "Schedule of principal uses central
business district" shall be amended by replacing the phrase "Veterinary Hospital or Clinic" with the phrase
"Veterinary hospital, animal clinic or animal boarding facility."
SECTION 8. The Allen Land Development Code, Appendix F "Standard Construction Details: Paving"
shall be amended to read in its entirety as shown in Exhibit A.
SECTION 9. The Allen Land Development Code, Appendix G "Storm Drainage and TxDOT Details"
shall be amended to read in its entirety as shown in Exhibit B.
SECTION 10. The Allen Land Development Code, Appendix H "Water Lines and Sanitary Sewer" shall
' be amended to read in its entirety as shown in Exhibit C.
SECTION 11. In the event of an irreconcilable conflict between the provisions of another previously
adopted ordinance of the City of Allen and the provisions of this Ordinance, the provisions of this Ordinance
shall be controlling

(1)
All property owners' associations or homeowners' associations who
own the common areas of the subdivision or which will succeed to
such ownership from the owner or developer of the property in
accordance with the provisions of the required restrictive covenants
are parties to the agreement; and
(2)
Notwithstanding the allocation of costs and responsibilities
regarding the operational and financial obligations of the respective
property owners relative to the perpetual operation, maintenance
and supervision of the facility, all owners shall be jointly and
severally liable for maintaining the facility in the manner required
by the City; and
(3)
No amendment to the agreement shall be effective without the
approval of the City Manager; and
(4)
The City shall be a third party beneficiary to the agreement with the
right, but not the obligation,
to require specific performance of the
agreement by the parties; and
(5)
The agreement shall be a covenant running with the land with
respect to all properties served by the stonnwater detention facility,
recorded in the Real Property Records of Collin County, Texas, and
enforceable against all subsequent owners of the properties served
by the facility.
SECTION 5. The Allen
Land Development Code, Appendix A "Definitions" shall be amended by
replacing the definition of "Veterinary Hospital or Clinic" with the following new definition:
Veterinary hospital, animal clinic or animal boarding facility means a place for the care,
grooming, diagnosis and/or treatment of animals, and/or overnight boarding of animals.
SECTION 6. The Allen Land Development Code, Section 4.20.2 "Schedule of principal uses" shall be

adopted ordinance of the City of Allen and the provisions of this Ordinance, the provisions of this Ordinance

' SECTION 12. Should any word, sentence, paragraph, subdivision, clause, phrase or section of this
Ordinance, as amended hereby, be adjudged or held to be void or unconstitutional, the same shall not affect
the validity of the remaining portions of said ordinance, or the Allen Land Development Code, as amended
hereby, which shall remain in full force and effect.
SECTION 13. An offense committed before the effective date of this Ordinance is governed by prior law and
the provisions of the Allen Land Development Code, as amended, in effect when the offense was committed and
the former law is continued in effect for this purpose.
SECTION 14. Any person, turn or corporation violating any of the provisions or terms of this Ordinance shall
be subject to the same penalty as provided for in the Allen Land Development Code, as amended, and upon
conviction shall be punished by a fine not to exceed the sum of Two Thousand Dollars ($2,000) for each offense,
and each and every day such violation shall continue shall be deemed to constitute a separate offense.
SECTION 15. This Ordinance shall take effect immediately from and after its passage and publication in
accordance with its provisions of the Charter of the City of Allen, and it is accordingly so ordained.

NOTES: STORM WATER POLLUTION PLAN
1. All operators and/or contractors shall conform to the terms and conditions of the
Texas Commision on Environmental Quality (TCEO), TPDES General Permit No.
TXR 150000 Issued and Dated March 5, 2003.
2. The Notice of Intent (NOI), as required by the General Permit, must be properly
displayed on site at all times by each operator.
3. All releases of the reportable quantities of hazardous substances shall be reported
immediately to the facility operator, EPA, and TCEQ.
4. Qualified operator personnel must inspect the site at least once every 14 days and 24 hours
of a storm event at 0.5 inches or greater. As an alternative, an inspection can be conducted
once every seven (7) calendar days on a defined day. A decision on which method to use
must be decided before work begins and must be followed throughout the project.
5. Modifications to the Storm Water Pollution Prevention Plan shall be Implemented and be
in-place within a Seven calendar day period.
6. If any contractor sees a violation by an operator or another cordmictor,thal operator or contractor in violation shall be noted
as well as the facility operator.
7. Erosion control shall be installed prior to grading.
8. Accumulated silt deposits shall be removed from silt fences and hay bale dikes when silt depth reaches six Inches or capacity
has been reduced by 50%, whichever occures first. Removal of silt deposits by the contractor shall be incidental to the
performance of the contract and a separate bid item shall not be included.
9. The contractor shall add or delete erosion protection at the request and direction of the Operator of the city.
10. After installation of pavement, final lot benching and general cleanup, the paving Contractor shall establish grass groundcover
in all street parkways,lot and all other disturbed areas. Sodding shall be done as specified by Section 202.5 and seeding as
specified by Section 200.6 of the October 2004 or Latest edition of NCTCOG Standard Specification.
11. It shall be the contractor's responsibility to control and limit sill and sediment leaving the site. Specifically, the contractor shall
protect all public streets, alleys, streams and storm drainage systems from erosion deposits.
12. It shall be the contractors responsibility to provide a dumpster (or equal) to tolled solid waste materials during construction.
13. A drainage area map will be included with the Storm Sewer Pollution Plan.
14. It is anticipated that the following non -storm water discharges will be associated with this project. These discharges are
authorized through the construction general permit.
A Fire hydrant flushing
S. Discharge from Firefighting activities
C. Potable water sources including waterline gushing
D. Water used to control dust
E. Uncontamianted ground water
F. Air Conditioning condensate
G. Vehicle, external building and pavement wash water where detergent and soaps are not used and where spills of
toxic or hazardous malerilas have not occured and the purpose is to remove mud, dirt or dust.
15. Construction waste disposal containers shall be provided on the site for disposal of all non -hazardous construction waste
materials. The containers shall be hauled to landfill by the Contractor.
16. All hazardous materials shall be handled and disposed of by the Contractor In accordance with Federal, State and Local
regulations.

NOTES: SILT FENCE
1. Posts which support the silt fence shall be installed on a slight angle
toward the anticipated runoff source. The post must be embedded a minimum
of 18 inches.
2. The toe of the silt fence shall be trenched in with a spade or mechanical
trencher, so that the downslope face of the trench is flat and
perpendicular to the line of flow. Where fence cannot be trenched in
(e.g. pavement), weight fabric flap with washed grave on the uphill side to
prevent flow under fence.
3. The trench must be a minimum of 6 inches deep and 6 inches wide to
allow for the silt fence fabric to be laid in the ground and backfilled with
compacted material.
4. Silt fence shall be securely fastened to each support post or to woven wire,
which is in turn attached to the support post. There shall be a 6 inch double
overlap, securely fastened where ends of fabric meet.
5. Inspection shall be made daily or after each rainfall. Repair or
replacement shall be made promptly as needed.
6. Silt fence shall be removed when the site is completely stabilized so as
not to block or impede storm flow or drainage.
7. Accumalated silt shall be removed when it reached a depth of 3 inches. The
silt shall be disposed of at an approved site and in such a manner as to
not contribute to aditional siltation.
