The called - special session of the Allen City Council
was called to order by Mayor Rodenbaugh on Tuesday, July 29,
1986, at 7:07 p.m., in the Council Chambers of the Allen
Municipal Annex, One Butler Circle, Allen, Texas.
Report of the City's Bond
Agent Regarding All Matters
Relating to the Sale of General
Obligation and Revenue Bonds (Agenda Item II)
Dan Almon, the city's bond agent with Schneider, Bernet &
Hickman, distributed to the City Council blank bid tabulation
sheets for the bond sales, copies of the recent Bond Buyers
Index and copies of the Texas Bond Reporter.
Mayor Rodenbaugh advised that the city would now proceed
with the bid opening for the Series 1986 General Obligation
Bonds and the Series 1986 Water and Sewer Revenue Bonds.
Mayor Rodenbaugh opened the bids and Mr. Almon read the
name of the company and the bid results for the city's general
obligation bonds. (See Attachment No. 1) Mr. Almon then
read the bid results for the city's water and sewer revenue
bonds. (See Attachment No. 2)
Mr. Almon advised that the apparent low bidder for both
bonds were Schneider Bernet.
Mr. Almon then reviewed again the city's bond ratings
received from Standard & Poors and Moody's and advised the
Council of the process for obtaining insurance on the bonds.
Mr. Almon also discussed with the Council the drop in one of
the city's bond ratings.
Mr. Almon then reviewed with the Council the Bond Buyers
Index which showed the interest rates on municipal hoods from
January 1980 through July of 1986.

Mr. Almon also advised the Council of the calendar of
scheduled bond sales as reflected in the "Texas Bond Reporter"
for the month of July and reviewed the number of entities that
were selling bonds on this same date.
The Council discussed various aspects of the interest rates
paid on municipal bonds and the number of entities selling
bonds and the interest rates paid on the bonds.
Ordinance No. 712-7-86: An
Ordinance Authorizing the
Issuance of "City of Allen,
Texas, General Obligation Bonds,
Series 1986"; Specifying the
Terms and Features of Said Bonds;
Levying a Continuing Direct
Annual Ad Valorem Tax for the
Payment of Said Bonds; and Resolving

MOTION: Upon a motion made by Councilman Wolfe and seconded
by Councilman Pendleton, the Council voted 6 - 0 to
approve and adopt Ordinance No. 712-7-86, as captioned
above. The motion carried.
Resolution No. 713-7-86(R): A
Resolution Approving and Authorizing
the Execution of a "Paying Agent/
Registrar Agreement" in Relation to
the "City of Allen, Texas, General

MOTION: Upon a motion made by Councilman Womack and seconded
by Councilman Wolfe, the Council voted 6 - 0 to
approve and adopt Resolution No. 713-7-86(R), as
captioned above. The motion carried.
Ordinance No. 714-7-86: An Ordinance
Authorizing the Issuance of "City of
Allen, Texas, Waterworks and Sewer
System Revenue Bonds, Series 1986";
Specifying the Terms and Features of
Said Bonds; Pledging the Net Revenues
of the City's Combined Waterworks and
Sanitary Sewer System to the Payment
of the Principal of and Interest on
Said Bonds; Enacting Provisions Incident
and Related to the Issuance, Payment,

MOTION: Upon a motion made by Mayor Pro Tem Farmer and
seconded by Councilman Wilson, the Council voted
6 - 0 to approve and adopt Ordinance No. 714-7-86,
as captioned above. The motion carried.

The called - special workshop session of the Allen City
Council was called to order by Mayor Rodenbaugh at 7:50 p.m.
on Tuesday, July 29, 1986, in the Council Chambers of the
Allen Municipal Annex, One Butler Circle, Allen, Texas.
The called - special workshop session of the Allen Planning
and Zoning Commission was called toorder by Chairman Glass
at 7:50 p.m. on Tuesday, July 29, 1986, in the Council Chambers
of the Allen Municipal Annex, One Butler Circle, Allen, Texas.
Statement of the Purpose of the
Workshop (Agenda Item II)
Chairman Bobby Glass read the purpose of the meeting into
the record as follows:
"To provide an orderly, progressive, and meaningful
discussion between the City Council and the Planning
and Zoning Commission to consider recommendation of
specific sections of the text of the Comprehensive
Zoning Ordinance, to review use and area regulations
for proposed zoning districts, and to receive input
from the City Council on conceptual planning issues
presently being examined by the Planning and Zoning
Commission."

Consider Technical Revisions
to the Zoning Ordinance (Agenda Item III)
Chairman Glass advised the Council that the first section
to be considered during the workshop was some technical revisions
that the Planning and Zoning Commission had recommended after
holding workshop sessions on review of the Comprehensive Zoning
Ordinance.
"A temporary facility or a permanent residential structure
located on any platted lot in an approved residential
subdivision may be used as a construction office, or as
a sales office, or for display purposes, directly related
to the construction and sale of residential structures
within the subdivision. No more than one (1) office
shall be allowed for any one builder in any subdivision.
Such temporary use shall be allowed for a period of one
(1) year, with extensions upon application and approval of
six (6) months possible provided the builder has unsold
lots remaining in the subdivision."
Per the Council's request, Chairman Glass explained how
the proposed technical revisions had come about and had caused
concern for changes in the zoning ordinance. The technical
revisions are primarily focused on changes in definitions,
problems of platting, and changing the landscaping requirements.
Technical Revisions - Paragraph C - Section 2.03
The Council discussed with the Planning and Zoning Commission
and city staff the paragraph C under "Technical Revisions" and
how the proposed text would clarify Section 2.03 in the Zoning
Ordinance from what presently exists.
It was the consensus of the Council and the Planning and
Zoning Commission that the proposed text should be revised as
follows for paragraph C under "Technical Revisions":
"The lot or tract is part of a plat of record after the
recommendation by the Planning and Zoning Commission
and filed in the Plat Records of Collin County, and
faces upon a dedicated street, or public access, or has
some frontage on a dedicated street."
There was further discussion on how approval would be
reached on each item discussed and it was concluded that a
"show -of -hands" vote would be taken on each item as it was
discussed.
Chairman Glass asked for an approval by a show -of -hands
on paragraph C, as revised, and the consensus of the Council
and the Planning and Zoning Commission was approval of paragraph
C as revised above.
Technical Revisions - Paragraphs A & B - Amending Zoning Ordinance
to Include Private Club, Restaurant, CBD,
and Site Plan and Section 1.09
In a show -of -hands vote, it was the consensus of the Council
and the Planning and Zoning Commission that these two paragraphs
be approved as presented.
Technical Revisions - Paragraph D - Section 2.07
The Council and the Planning and Zoning Commission then
discussed the proposal for Section 2.07 of the Zoning Ordinance

and why the section spoke to no more than four display facilities
in any one subdivision. Upon a show -of -hands vote, the consensus
of the Council and the Planning and Zoning Commission was to
revise the proposed text as follows:

Consider Technical Revisions
to the Zoning Ordinance (cont'd) (Agenda Item III)
Technical Revisions - Paragraph E - Section 2.10
Definition No. 47
The Council and the Planning and Zoning Commission then
discussed paragraph E of the "Technical Revisions", which made
reference to Section 2.10 of the Zoning Ordinance and listed
certain definitions found in the ordinance. Definition No. 47,
regarding the use of the word "tract" rather than "lot" was
approved by the Council and the Planning and Zoning Commission.
Definitions No. 58 and 92
The Council and the Planning and Zoning Commission also
approved the definition revisions listed for No. 58 "home
occupation" and No. 92 "restaurant/private club" as proposed
by the Planning and Zoning Commission.
Definitions No. 105 and 133
Chairman Bobby Glass then explained that the next definitions
shown in No. 105 and 133 were revised in order to include land-
scaping screens as a means for providing a visual barrier and
advised of the revised text. The Council and the Commission
approved of the revisions as presented.
Technical Revisions - Paragraph F - Section 3.01(T)
Chairman Glass advised that paragraph F of the "Technical
Revisions" was regarding Section 3.01 (T) of the Zoning Ordinance,
which referred to the "flood way, flood plain, and flood fringe"
and the Planning and Zoning Commission recommended that these areas
be differentiated.
There was considerable discussion by the Commission, Council,
and city staff on the wording to be used to describe the flood
plain and making sure that the same wordage be used that will
be referenced in the Greenbelt/Linear Park Study, currently being
conducted. There was also discussion on the reason Section 3.01(T)
was being changed, when really the portion that should be changed
relates to the flood plain used for open space in the Planned
Development districts and that the land use maps should designate
this area.
After further discussion, it was concluded that revisions
to Section 3.01(T) of the Zoning Ordinance should be deleted
and that consideration should be given to revising Section
3.01(R), paragraph 4, "Area Requirements in Planned Development
Districts".
It was concluded that this paragraph should be revised as
follows:
. Such open space shall be computed as the ratio
of the actual number of dwelling units bears to this
requirement and shall not include any floodway."
It was the consensus of the Council and the Planning and
Zoning Commission that this revision be approved.

At this time, the Council and Commission also discussed the
need for additional differentiation as to types of businesses
that are covered under the parking section of the Zoning Ordinance.
It was pointed out that were various businesses that attracted
a lot of customers that need parking spaces as well as areas for
delivery vehicles that are just listed under one category of
commercial or retail zoning district. It was also pointed out
that in certain cases portions of the buildings should not be
used to calculate the parking spaces needed because the building
spaces did not generate traffic.
It was concluded that

Technical Revisions - Paragraph G - Section 3.03(d)
Chairman Glass then moved on to paragraph G of the "Technical
Revisions", which proposed to increase the widths of the parking
spaces to nine (9) feet.
In discussion on this item, it was concluded that the
parking spaces should be changed to nine (9) feet in width,
except for single-family residential areas.
By consensus, the Council and the Commission approved
the parking spaces to a nine (9) foot width, except for
single-family residential areas which would remain at the
eight (8) foot width.
Technical Revisions - Paragraph H - Section 3.03(a)(18)
Chairman Glass advised of the proposed amendment to
Section 3.03(a)(18) of the Zonino Ordinance, which consisted
of making the requirements for parking spaces for commercial
establishments more consistent and eliminates the stringent
requirements on the small shops or stores. The proposed text
read: Parking Requirements: 1 space for every 200 square feet.
In discussion on this section, it was clarified that the
revisions were only to be made to paragraph 18 of Section 3.03(a),
regarding "retail stores or personal service establishments" as
listed on page 68 of the Zoning Ordinance. Discussion also
included there be the number of adequate parking spaces for
customers as well as employees. It was concluded that the proposed
text should read:
"Parking Requirements: 1 space for every 200 square feet,
exclusive of employee parking."
By consensus, the Council and the Commission approved the
proposed text as revised.

Consider Technical Revisions
to the Zoning Ordinance (cont'd) (Agenda Item III)
Chairman Glass advised the Council and the Commission of
the proposed changes to the text in the Zoning Ordinance regarding
landscape screening and landscaping done during the winter months.
He also pointed out a recommendation for a larger variety of
landscape plantings and the extension of the growing seasons.
There was considerable discussion by the Council and
the Commission on the proposed revisions regarding the number
of growing seasons needed, the types of plants to be used in
the landscaping, the size of the plants that should be used,
the need for higher quality type trees and shrubs and guidelines
for placement of them, and the need for an ordinance that provides
for landscape maintenance and maintenance of landscape screening.
After a lengthy discussion on this section, it was concluded
that the Planning and Zonina Commission needed to do more work
on this section per the discussions that where held.
Technical Revisions - Paragraph J - Section 4.03
Chairman Glass reviewed the proposed text of the formal
criteria for deciding zoning cases and if they should be modified.
It was the consensus of the Council and the Commission,
that items a through i be approved as revised under Section 4.03.
Zoning Districts (Agenda Item IV)
Before consideration of the revisions made to the Zoning
Districts, Mayor Rodenbauah and Chairman Glass recessed the
called - special workshop session of the Allen City Council
and the Allen Planning and Zoning Commission at 9:23 p.m. The
meeting reconvened at 9:35 p.m.
Bill Petty, Director of Community Development, spoke before
the Council and the Commission on the creation of additional
zoning districts in order to provide consistency between the
Zoning Ordinance and the Comprehensive Plan. He advised that
Council and the Commission have indicated a need for a "garden
home district", the "garden office district" and "multi -family
district with 18 units per acre", and the "industrial technology
district".

Mr. Petty then reviewed the "PH" Patio Home or "GH" Garden
Home District as proposed by the Planning and Zoning Commission.
He reviewed the purpose, the use regulations, height regulations,
area regulations and building regulations.
There was discussion on the proposed rear yard requirement
and what the minimum should be for the patio or garden home, the
amount of open space needed for a patio home, and the need for a

rear yard in order to provide for adequate separation between

units. After considerable discussion, it was the consensus of
the Council and the Commission to approve a rear yard of 10'
for patio or garden homes, approval of lot area at 5,000 square
feet and a minimum floor area of any dwelling shall be 1,000
square feet.
Since a two-hour time limit had been set on this workshop
session, the Council and the Commission discussed the need
to set another workshop date to continue these discussions.
Therefore, Agenda Items IV and V were passed over at this time.

Recess Workshop to a Specific
Date, Time and Place (Agenda Item VI)
The Council and Commission discussed the most appropriate
date and time to reconvene the workshop session on the proposed
changes to the Zoning Ordinance.
It was the consensus of the Council and the Commission to
reconvene the workshop session on Wednesday, August 13, 1986,
at 7:30 p.m. in the lunchroom area of the Allen Municipal Annex,
One Butler Circle.
Adjourn
Mayor Rodenbaugh adjourned the called - special workshop
session of the Allen City Council at 10:09 p.m. on Tuesday,
July 29, 1966.
Chairman Bobby Glass adjourned the called - special work-
shop session of the Allen Planning and Zoning Commission at 10:09 p.m.
on Tuesday, July 29, 1986.
