Consent Aeenda MOTION: Upon a motion made by Councilmember Stout and a second by Mayor Pro Tem Caplinger, the Council voted seven (7) for and none (0) opposed to adopt all items on the Consent Agenda as follows: 4. Approve Minutes of the January 23, 2018, Regular City Council Meeting. I5. Approve Minutes of the January 20, 2018, Special Called City Council Workshop for Strategic Planning. 6. Adopt a Resolution Ordering the May 5, 2018, General Election and Authorizing the City Manager to Enter into a Contract with the Elections Administrator of Collin County to Provide Joint Election Services with the Allen Independent School District. RESOLUTION NO.3548-2-18(R): A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ALLEN, COLLIN COUNTY, TEXAS, ORDERING A GENERAL ELECTION TO BE HELD ON MAY 5, 2018, FOR THE PURPOSE OF ELECTING THE CITY COUNCB.MEMBERS FOR PLACE NOS. 1, 3 AND 5; DESIGNATING LOCATION OF POLLING PLACE; ORDERING NOTICE OF ELECTION TO BE GIVEN AS PRESCRIBED BY LAW IN CONNECTION WITH SUCH ELECTION; AUTHORIZING EXECUTION OF JOINT ELECTION AGREEMENT; AND PROVIDING FOR AN EFFECTIVE DATE. 7. Adopt a Resolution Authorizing the City Manager to Execute the Lease/Purchase of Three 2018 Harley Davidson Motorcycles for the Police Department through Government Capital Corporation in the Amount of $80,780. ALLEN CITY COUNCIL REGULAR MEETING FEBRUARY 13, 2018 PAGE 3 ' RESOLUTION NO. 3550.2-18(R): A RESOLUTION OF THE CITY OF ALLEN, TEXAS, AUTHORIZING THE EXECUTION AND DELIVERY OF A LEASE -PURCHASE AGREEMENT AND RELATED DOCUMENTS WITH RESPECT TO THE ACQUISITION, PURCHASE, FINANCING AND LEASING OF CERTAIN EQUIPMENT FOR THE PUBLIC BENEFIT; RESOLVING OTHER MATTERS RELATED THERETO; AND PROVIDING AN EFFECTIVE DATE. 9. Approve the Terms of Settlement and Authorize the City Manager to Execute Documents Necessary for the Acquisition of Right -of -Way for a McDermott Drive Right -Hand Turn Lane. 10. Authorize the City Manager to Execute an Agreement to Assume the Alders at Twin Creeks, LLC, Obligation to Construct Improvements at the Twin Creeks Detention Easement Area for Payment in the Amount of $141,172. 11. Authorize the City Manager to Execute a Purchase and Sales Agreement with Zeno Land Management for the Purchase of Property in the Ridgeview Crossing Development in the Amount of $525,000, and to Enter into a Facilities Agreement Providing for the Construction of Park Improvements. 12. Award Bid and Authorize the City Manager to Execute a Contract with Williams & Frost Specialty Group, LLC, for the Construction of the Joe Farmer Recreation Bridges Replacement Project in the Amount of $466,289. 13. Award Bid and Authorize the City Manager to Execute the Purchase of Fertilizer, Clay, Quick - Dry and Chemicals for The Parks and Recreation Department and The Courses at Watters Creek with BWI Companies, Greensmilhs, Inc., Harrell's, LLC, Target Specialty Products, and Winfield Solutions in the Annual Amount of $235,851 for a Five -Year Term. 14. Authorize the City Manager to Execute the Purchase of Custom Fabric Replacements at Celebration Park from USA Shade & Fabric Structures Through the Buyboard Cooperative Purchasing Agreement in the Amount of $64,894. 15. Authorize the City Manager to Execute a Four (4) Year Lease Agreement with Dell Financial Services for Computer Equipment in the Total Principal and Interest Amount of $218,675. 16. Accept Resignation of Rhonda Staples and Declare Vacancy in Place No. 2 on the Convention and Visitors Bureau Advisory Board The motion carried. Reeular Azenda 17. Conduct a Public Hearing and Adopt an Ordinance for Specific Use Permit No. 160 for a Fitness and Health Center Use in an Approximately 2,000± Square Foot Portion of the Building Generally Located North of McDermott Drive and West of Greenville Avenue. [Drumba Fitness ' - Fitness and Health Center]. Mayor Terrell opened the public hearing and asked anyone wishing to speak for or against this item to do so at this time. ORDINANCE NO. 3551-2-18: AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF ALLEN, COLLIN COUNTY, TEXAS, AMENDING THE ALLEN LAND DEVELOPMENT CODE ZONING REGULATIONS AND ZONING MAP, AS PREVIOUSLY AMENDED, BY GRANTING SPECIFIC USE PERMIT NO. 160 AUTHORIZING AN APPROXIMATELY 2,000± SQUARE FOOT PORTION OF THE BUILDING LOCATED ON LOT IA, COTTONWOOD CREEK VILLAGE SHOPPING CENTER (COMMONLY KNOWN AS 107 N. GREENVI-LE AVENUE, SUITE B), PRESENTLY ZONED FOR SHOPPING CENTER "SC" TO BE USED FOR A FITNESS AND HEALTH CENTER USE; PROVIDING A CONFLICTS RESOLUTION CLAUSE; PROVIDING A SEVERABILITY CLAUSE; PROVIDING A SAVINGS CLAUSE; PROVIDING A PENALTY OF FINE NOT TO EXCEED THE SUM OF TWO THOUSAND DOLLARS ($2,000) FOR EACH OFFENSE; AND PROVIDING AN EFFECTIVE DATE. MOTION: Upon a motion made by Councilmember Sedlacek and a second by Mayor Pro Tem Caplinger, the Council voted seven (7) for and none (0) opposed to adopt Ordinance 3551-2-18, as previously captioned, for Specific Use Permit No. 160 for a Fitness and Health Center use for Dmmba Fitness. The motion carried. 13. Calendar. Items of Interest. • Councilmember Brooks congratulated Karen Cromwell, Director and Conventions and Visitors Bureau Advisory Board on efforts to secure a March Madness Event and the Texas Twisters Taekwondo tournament at the Allen Event Center. • Council encouraged citizens to take part in Sam Bass Day on February 24, 2018. • Councilmember Sedlacek encouraged citizens to attend Hearts for Art on February 25, 2018, from 2:00 - 6:30 p.m. at the Allen Performing Arts Center. • Council wished happy birthday to Ty Caplinger and Eric Canon, Chief Financial Officer. Executive Session The Executive Session was not held.
