With a quorum of the Council Members present, the workshop session of the Allen City Council was called to order by Mayor Farmer at 7:00 p.m. on Thursday, September 6, 1990, in the Conference Room of the Allen Municipal Annex, One Butler Circle, Allen, Texas. Discussion of Consent Agenda and Regular Agenda Items (Agenda Item II) Mayor Farmer began the review of the Consent Agenda items. There was no discussion on the Consent Agenda, Mayor Farmer informed the Council there would be two proclamations presented during the regular meeting. There was no further discussion on this item. Mayor Farmer reviewed Agenda Item VI, Citizens Comments. There was no discussion on this item. Mayor Farmer reviewed Agenda Item VII, Public Hearing on a Request to Zone 13.8 Acres Located South of Park Place Drive and East of Heritage Parkway as Requested by Wayne Lee, and Consider an Ordinance Establishing Zoning on this Property. Discussion was held regarding the need for a retaining wall at this location. This item was recommended by staff and Planning and Zoning. The developer has agreed to accommodate the request. Aesthetics, safety and headlight glare are reasons for this request. Discussion was also held regarding the out parcels and how zoning and development of future tracts are affected by these parcels. There was no further discussion on this item. ALLEN CITY COUNCIL WORKSHOP SESSION SEPTEMBER 6, 1990 PAGE 2 Discussion of Consent Agenda and Regular Agenda Items (Cont'd) (Agenda Item II) Mayor Farmer reviewed Agenda Item VIII, Presentation on Proposed Expansion of Dallas Fort Worth International Airport. Mark Watson, City Manager of Grapevine will be present to speak as opposition to the expansion. Dr. Dean Vanderbilt, Executive Vice President of the North Texas Commission will be present to speak for the expansion. Each will speak for approximately ten minutes. There was no further discussion on this item. Mayor Farmer reviewed Agenda Item IX, Consider Ordinance Establishing Regulations on Parking of Certain Vehicles on City Streets. Comments at the last public hearing were classified into three categories: providing an exemption for handicapped vehicles, short term parking of recreational vehicles for out-of-town guests, and changing the prohibition on parking trucks abo a 314 ton to trucks above one ton. Discussion was held regarding the effective date being changed to January 1, 1991 which would allow residents time to prepare for the impact of this ordinance. There was no further discussion on this item. There was no further discussion on the Agenda. With a quorum of the Council Members present, the regular session of the Allen City Council was called to order by Mayor Farmer at 7:32 p.m. on Thursday, September 6, 1990, in the Council Chambers of the Allen Municipal Annex, One Butler Circle, Allen, Texas. CONSENT AGENDA (Agenda Item V) MOTION: Upon a motion made by Councilman Fyke and seconded by Councilman Glass, the Council voted seven (7) for and none (0) opposed to approve and adopt all items on the Consent Agenda as recommended and as follows: A. Approval of City Council Budget Retreat Minutes of August 10-12, 1990. B. Approval of City Council Minutes of August 16, 1990 - Regular Session. C. Approval of City Council Minutes of August 22, 1990 - Called - Special Budget Workshop. D. Approval of City Council Minutes of August 23, 1990 - Called - Special FY 1990-91 Budget Public Hearing. End of Consent Agenda ALLEN CITY COUNCIL REGULAR SESSION SEPTEMBER 9, 1990 PAGE 4 Mayor Farmer presented a Proclamation designating September 1990 as Voter Registration Awareness Month in Allen, Texas, to City Secretary, Judy Morrison. Mayor Farmer also presented a Proclamation designating September 9 - 15 as Developing Capable People Week to Danny Meek, Chairman of the Allen Substance Abuse Prevention Council. Mr. Meek distributed tee shirts to each Council Member displaying Developing Capable People Program. The mayor congratulated the program and the people working with this program who were in attendance at the meeting for a job well done in the City of Allen. Citizens' Comments (Agenda Item VI) Dale Holt, 607 Bush Drive, spoke before the Council regarding progress on the cemetery entranceway and the historical marker. She also expressed displeasure regarding the amount of money being spent on Allen Civic Plaza. The City Manager is available to meet with Ms. Holt regarding the design and layout of the Civic Plaza at Ms. Holt's convenience. Public Hearing and Ordinance No. 998-9-90 (Agenda Item VII) Mayor Farmer read the request into the record as follows: "Public hearing on a request to zone 13.8 acres located south of Park Place Drive and east of Heritage Parkway as requested by Wayne Lee, and consider an ordinance establishing zoning on this property." ordinance No. 998-9-90: An Ordinance of the City of Allen, Collin County, Texas, Amending Comprehensive Zoning Ordinance No. 829-11-87, as Previously Amended, so as to Establish Permanent Zoning, to -wit: Planned Development -Residential No. 48 (PD- R No. 48) , on the Following -Described Tract of Land: Approximately 13.821 Acres of Land, More or Less, Out of the George W. Ford Survey, Abstract No. 328, Collin Coun- ty, Texas; Providing for a Land Use Plan; Providing for Variances; Providing for Area and Use Regulations; Providing for a Penalty of Fine not to Exceed the Sum of One Thou- sand Dollars ($1,000.00) for Each Offense; Providing for a Severability Clause; and Providing for the Effective Date of Said Ordinance. Pat Atkins with Don Tipton Engineering Representing Legacy Homes and John Landen, President of Legacy Homes, were available for comments from the Council. Mr. Atkins displayed an aerial map of the property and indicated the location of the I P. ALLEN CITY COUNCIL REGULAR SESSION SEPTEMBER 6, 1990 PAGE 5 Public Hearing and Ordinance No. 998-9-90 (Cont'd) (Agenda Item VII) property. He discussed the vegetation existing on the property and discussed the concept plan for the property. The homes will be a quality product and will be enhanced by the number of trees in the area. Mayor Farmer opened the public hearing and asked for anyone speaking either for or against the request to do so at this time. Ms. Connie Gray, 3 Heritage Circle spoke before the Council expressing her displeasure with the development of the property due to the imminent destruction of the vegetation, the added traffic congestion in the City and the additional burden to the school system due to additional children in the City. With no one else speaking either for or against the request, Mayor Farmer closed the public hearing. Council discussed the retaining wall, the future development of properties surrounding the piece of property in question and the present design of the alley and road system. MOTION: Upon a motion made by Mayor Pro Tem Wolfe and seconded by Councilman Glass, the Council voted seven (7) for and none (0) opposed to approve Ordinance No. 998-9-90, as previously captioned, in accordance with staff and Planning and Zoning recommendation. The motion carried. Presentation on Proposed Expansion of Dallas Fort Worth International Airport (Agenda Item VIII) Mark Watson, City Manager with the City of Grapevine spoke before the Council regarding expansion of D/FW Airport. Mr. Watson discussed the original master plan for the airport and the proposed modifications to that master plan. He also discussed alternatives to the proposed modifications as presented by the City of Grapevine. Dr. Dean Vanderbilt, Executive Vice President of North Texas Commission spoke before the Council regarding the need for expansion of DIFW Airport. Mr. Vanderbilt discussed the importance of the airport expansion with regard to the economy and growth of the area. Mid-America air transportation leadership has competition from several cities and Dallas needs this expansion to stay in the running for the Mid-America air transporta- tion hub in the future. Mayor Farmer expressed his and the Council's appreciation for both opinions and indicated the Council will be discussing the subject and taking action as necessary in the near future. Mayor Farmer called a brief recess. ALLEN CITY COUNCIL REGULAR SESSION SEPTEMBER 6, 1990 PAGE 6 Consider Ordinance Establishing Regulations on Parking of Certain Vehicles on City Streets (Agenda Item IX) Ordinance No. 999-9-90: An Ordinance of the City of Allen, Texas, Amending Chapter 9, Article I, Sections 9-2, "Definitions," and Article I, Sections 1-2, of the Allen Vehicle and Traffic Code, Ordinance 259, as Pre- viously Amended, of the City of Allen, Texas, by Adding New Definitions Thereto; Amending Chapter 9, Article IX, Division 1, Sections 9-227, "Commercial Vehicles -- Generally," and 9-228, "Same --With Capacity of More than One and One -Half Tons in Certain Districts," of the Allen Code of Ordinances, and Article XI, Division 1, Sections 1-72 and 1-73 of the Allen Vehicle and Traffic Code, Ordinance 259, as Pre- viously Amended, of the City of Allen, Tex- as, Restricting the Parking or Standing of Various Vehicles in Residential Districts, Restricting the Parking or Standing of Var- ious Vehicles in Other Districts from 30 Minutes After Sunset Until 30 Minutes Before Sunrise, and Prohibiting the Stopping, Standing or Parking of any Vehicle in Specified Places; Repealing Sections 9-242, "Parking for More Than 24 Hours," Division 2, Article IX, Chapter 9, of the Allen Code of Ordinances and Sections 1-76, Division 2, Article XI, of the Allen Vehicle and Traffic Code, Ordinance 259, as Previously Amended, of the City of Allen, Texas; Pro- viding Penalty Clauses, Severability Clauses and an Effective Date. A public hearing was held on August 2 regarding a proposed ordinance to ban parking of certain types of vehicles on city streets. Because of public input, the following items were considered and incorporated into the ordinance. Providing an exemption for handicapped vehicles. 2. Short term parking of recreational vehicles for out-of-town guests. 3. Changing the prohibition on parking trucks above 3/4 ton to trucks above 1 ton. Discussion was held regarding the enforcement of the ordinance. Notification will be given to the violation location. The resident will be given ten days to correct the violation or enforcement action will be taken. Staff also suggests that Council direct ALLEN CITY COUNCIL REGULAR SESSION SEPTEMBER 6, 1990 PAGE 7 Consider Ordinance Establishing Regulations on Parking of Certain Vehicles on City Streets (Cont'd) (Agenda Item IX) staff to maintain records on the number of complaints, violations investigated, letters written and citations issued for a period of six months from the adoption of this ordinance. That information will be sent to the Council for consideration of modification of the enforcement policy andlor the ordinance itself. In order to allow citizens to prepare for the impact of the ordinance, the effective date will be set for January 1, 1991. MOTION: Upon a motion made by Councilman Fyke and seconded by Councilwoman Christakos, the Council voted seven (7) for and none (0) opposed to approve Ordinance No. 999-9-90, to become effective January 1, 1991, and to request input from staff regarding enforcement as noted previously, as recommended by staff and Development, Services and Mayor Committees. The motion carried. Authorize Submission of Grant Application for the Substance Abuse Prevention Program (Agenda Item X) Joel Blaylock, Substance Abuse Prevention Coordinator, discussed the need for a grant request. The grant will enable the Substance Abuse Prevention Office to increase community awareness and to better manage the activity of volunteers through the funding of a part-time person. Funding for equipment necessary to begin newsletter production will also be requested. AISD will also be approached for their support in this effort. MOTION: Upon a motion made by Mayor Pro Tem Wolfe and seconded by Councilman Edstrom, the Council voted seven (7) for and none (0) opposed to approve the request of the Substance Abuse Prevention Coordinator to apply for a grant to fund the volunteer] newsletter position and to approve and support the following statement to be included in the grant proposal: "We are excited that the Allen Substance Abuse Prevention Office is seeking to inform the community about the dangers of substance abuse via a community newsletter. We feel an active volunteer network will also provide citizens with the opportunity for direct participation in drug prevention activities. We support making this information available via a community newsletter and by creating a volunteer coordinator to involve all concerned citizens. We will do our best to continue this position, as the budget allows, in order to offer citizens information and the chance to participate in this on-going city-wide effort." in accordance with staff and Services Committee recommendation. The motion carried. E ALLEN CITY COUNCIL REGULAR SESSION SEPTEMBER 6, 1990 PAGE 8 Consider Capital Improvement Projects for Fiscal Year 1999-90 Using Remainin¢ Bond Funds (Agenda Item XI) There are no Capital Improvement Projects for FY 1989-90 under consideration at this time. Other Business: Appointments to Boards (Agenda Item XII -A) Judy Morrison, City Secretary, explained the vacancies on the various boards and the individuals who submitted data sheets for those vacancies. Interviews will be held by the Finance/Administration Committee on Monday and Tuesday, September 17 and 18. Calendar (Agenda Item XII -B) The calendar was discussed and various meetings were added. Committee Reports (Agenda Item XII -C) • Finance/Administration Discussed upcoming meetings. Development No discussion. Services The committee worked with ASAP with regard to the grant request. Work is continuing on the solid waste issue. Items of Interest (Agenda Item XII -D) Jon McCarty, City Manager, discussed the preliminary census data for Collin County recently received from the Council of Governments. Allen statistics show a 1970 population of 1,940, a 1980 population of 8,314 which is a 328% increase and a preliminary 1990 population of 18,213 or a 119% increase. COG had estimated Allen's population to be 17,650 at 1990. Allen ranked No. 2 as the fastest growing city in Collin County. Mayor Farmer complimented City Hall in their United Way efforts during the Pacesetter campaign for 1990-91. The City goal was $5,000; however, $5,649.19 was collected which is 113$ of goal. This represents a 35% increase over last year. This year there were 88 participants which is a 24% increase over the previous year. A ALLEN CITY COUNCIL REGULAR SESSION SEPTEMBER 6, 1990 Items of Interest (Cont'd) PAGE 9 (Agenda Item XII -D) Mayor Farmer reminded Council of the Cotton Pickin' Days Parade in McKinney and festivities scheduled beginning at 9:00 a. m. Saturday, September 15, 1990. The Crop Walk will be held Sunday, October 28 beginning with recognition of dignitaries at 12:45 p.m. The Allen Country Fair will be held on Saturday, September 8, beginning at 10:00 a.m. in the downtown area. Executive Session (Agenda Item XIII) In accordance with Article 6252-17, V. A. T. C. S. (Open Meetings Law), Sections 2(e), 2(f), and 2(g), the Allen City Council was to convene into Executive Session in the Conference Room of the Allen Municipal Annex, One Butler Circle, Allen, Texas in order to discuss matters pertaining to Possible Contractor Litigation, Park Acquisition and Pay plan. The Executive Session was adjourned at 11:58 p.m. Reconvene (Agenda Item XIV) The Allen City Council reconvened into regular session at 11:58 p. m. on Thursday, September 6, 1990, in the Council Chambers of the Allen Municipal Annex. No Action was taken. Adjourn (Agenda Item XV) MOTION: Upon a motion made by Councilman Womack and seconded by Councilman Edstrom, the Council voted seven (7) for and none (0) opposed to adjourn the regular session of the Allen City Council at 11:59 p.m., on Thursday, September 6, 1990.
