WORKSHOP SESSION - 6:45 P.M.
With a quorum of the Council Members present, the Special Called Workshop of the
Allen City Council was called to order by Mayor Farmer at 7:37 p. m. on Thursday, May 30,
1991, in the Conference Room of the Allen Municipal Annex, One Butler Circle, Allen,
Texas. He welcomed the guests and noted that several members of the Planning and Zoning
Commission were present for the meeting to perhaps answer or discuss questions regarding
the Impact Fee Land Use Assumptions.
Development Impact Fee
Planning Assumptions Workshop
(Agenda Item II)
Dave Whitehead, Public Works Director, discussed and reviewed with the Council the
process of the Development Impact Fee structure. As of June 20, 1990, no Impact Fees can
be charged that are not in conformance with Senate Bill 336. Impact fees can be imposed
on only new development, which is defined as the subdivision of land; the construction,
reconstruction, redevelopment, conversion, structural alteration, relocation, or
enlargement of any structure; or any use or extension of the use of land; any of which
increase the number of service units.

Impact fees are used for four types of facilities:
1. Water Supply, Treatment and Distribution Facilities
2. Wastewater Collection and Treatment Facilities
3. Stormwater, Drainage and Flood Control Facilities
4. Roadway Facilities
The fees maybe used to finance costs of capital improvements or facility expansions,
to serve new development, or to recoup costs of capital improvements which have oversized
to accommodate future development. The City of Allen Capital Advisory Committee was
appointed by The City Council which included the Planning and Zoning Commission, one
member from the Construction Community, and one member from the Extraterritorial
Jurisdiction. This advisory committee will be an ongoing committee and after the initial
thrust, will be required to meet and report to the Council semiannually.
Mr. Whitehead discussed the functions of the Advisory Committee.
1. Advise and assist the political subdivision in adopting land use assumptions.
2. Review the capital improvement plan, and file written comments with the City
Council.
3. Monitor and evaluate implementation of the capital improvements plan.
4. File semiannual reports of progress of the capital improvements plan and
report to the political subdivision any perceived inequities in implementing the
plan or imposing the impact fees.
5. Advise the political subdivision of the need to update or revise the land use
assumptions capital improvements plan and impact fees.
Mr. Whitehead reviewed the time schedule for the land use assumption, capital
improvement plan, and impact fee schedule with the Council.
John Garcia, Chairman of the Capital Improvement Advisory Committee, discussed
several aspects of the land use assumptions. He discussed the service areas for water and
sewer and roadways and the three mile geographic limitation for roadway facilities. All fees
charged will be appropriated to the service area where the fee was procured and reflects
the cost of build -out to the year 2001. Because of the nature of the water and sewer
facilities in the City of Allen, one service area was established for water and one service
r area was established for sewer.

Although the comprehensive plan indicated thirty-two (32) different service areas
and in order to comply with the legal restrictions, a minimum of nine (9) service areas
would be required, the committee has suggested that twelve service areas be considered
for the roadway system and population and employment projections. Population growth
figures from the North Texas Council of Governments was used for the year 2001, and the
population and employment projections will be reviewed on a semiannual basis and updated
if necessary. Council discussed the high growth areas of the City at the present time and
possible future growth. The land use assumption must be adopted by Council prior to the
committee adopting or presenting to Council for adoption the actual impact fees or the
impact fee plan. The finalization of the document should be done after the public hearing
and any changes will be incorporated into the plan at that time.
Council complimented the Committee for the amount of work and effort put into this
document, realizing there is still a great deal to be done.

Economic Development
Half Cent Sales Tax Workshop (Agenda Item III)
C David Pitstick, Economic Development Coordinator, discussed a schedule of activities
for consideration and adoption for the implementation of a one-half cent sales tax program.
Additional study on this topic will be implemented prior to subcommittee recommendation.
The legal requirements of the one-half cent sales tax include the need for a city-wide
election with the majority of the citizens approving this tax. The City Council must also
appoint a five -member Citizens Advisory Board to serve without compensation in an
advisory capacity and who are not public officers or agents of the City. This Board would
investigate methods for promoting the City and recommend to the City Council the best
methods and amounts to spend for economic development projects.
John Newman, from the State Comptroller's office was present to discuss some of the
programs available through the State and the use of this tax money. The sales tax can be
used for the recruitment and expansion of existing industry. The tax cannot be used for
normal day-to-day activities of the city. If the citizens, at some future point, vote the tax
to be rescinded, it will, however, remain until any debt is paid. The tax can be used for
expansion of jobs and bond companies cannot require more payment than the sales receipts
indicate. Mr. Newman indicated there is no magic formula for the passage of this process
and each city is entirely different in its need. No one at the present time monitors closely
this program from the State Comptroller's office.

Adjourn (Agenda Item V)
MOTION: Upon a motion made by Councilmember Christakos and seconded by
Councilmember Bishop, the Council voted seven (7) for and none (0) opposed
to adjourn the regular session of the Allen City Council at 9:55 p.m., on
Thursday, May 30, 1991. The motion carried.
