Can to Order and Announce a Ouorum is Present (Agenda Item 1)
With a quorum of the Councilmembers present, the workshop session of the Allen City Council was
called to order by Mayor Farmer at 7:11 p.m. on Wednesday, August 18, 1993, in the Council Chambers of the
Allen Municipal Annex, One Butler Circle, Allen, Texas.
The Special Called Workshop was recessed at 7:13 p.m. to allow the remainder of the Councilmembers
to arrive and was reconvened at 7:20 p in.
Workshop on Proposed Property Maintenance Code Ordinance (Agenda Item II)
Bill Petty, Community Development Director, reviewed with the Council the history of the Property
Maintenance Code. During the 1985 Comprehensive Plan review, Staff proposed a property maintenance
ordinance which was not adopted at that time. During the 1992 Comprehensive Plan review, the Development
Subcommittee gave directions to Staff to develop a Property Maintenance Code. Review of completed routine
inspections indicate a total of 1,768 complaints for items that would relate to a Property Maintenance Code issue
The proposed City of Allen Property Maintenance Code is a compilation of codes from the following cities:
Mesquite, Farmer's Branch, Richardson, Plano and Garland. All inside requirements have been taken out of this
ordinance, although it was present in other city ordinances. The proposed ordinance deals strictly with the outside
of the home and how the property is maintained. At the direction of the Development Subcommittee, Staff
updated certain sections of the proposed ordinance. Those sections were distributed to the Council which included
information regarding burned structures and junked vehicles.

The Development Subcommittee indicated they tried to look at the number of complaints received and
to define those areas specifically in this ordinance. The subcommittee would like to bring the ordinance forward
to protect the citizens' interest in the City of Allen. It was felt the City will have support from many groups of
people because as a City ages, the community needs to protect itself from deterioration.
A list of basic questions was distributed to the Council and reviewed. An abatement budget would allow
for abatement by the City to remove, repair, etc. and eventually file a lien on property It was felt that this
would be the "teeth" of the ordinance.
Discussion was held regarding existing situations to be considered nonconforming such as swimming pools
without existing P -traps. It was felt that if at the time the pool was built all pemiitting processes took place
properly, the City of Allen would not enforce conforming to this new ordinance. There may be a time when EPA
regulations would dictate such enforcement. The EPA will look to the City for enforcement of certain pool
drainage violations. Council reviewed a model ordinance developed by the Council of Governments affecting
swimming pools and storm water quality management.
Council felt a public hearing process should be utilized and that the Property Maintenance Code is needed
and wanted.
Bill Petty, Community Development Director, read a statement from the Economic Development Director
in support of the Property Maintenance Code.
Council would like to see a broad-based endorsement of this ordinance, possibly using the mechanism
of PTA, civic clubs, etc.
Since details on the ordinance itself needs to be finalized prior to its final adoption and prior to
community endorsement, the Staff and Development Subcommittee are to work out some details including the
actual process to be used. Another workshop has been scheduled for 7:00 p.m., Monday, August 30, 1993,
which will include the ordinance content and possibly the process.

MOTION: Upon a motion made by Councilmember Terrell and seconded by Councilmember Christakos,
the Council voted six (6) for and none (0) opposed to adjourn the special called workshop of the
Allen City Council at 8:55 p.m., on Wednesday, August 18, 1993. The motion carried.
