Smith, City Attorney Call to Order and Announce a Ouorum is Present With a quorum of the Councdmembers present, the Regular Meeting of the Allen City Council was called to order by Mayor Terrell at 7:13 p.m. on Thursday, March 2, 2000, in the Council Chambers of the Allen Public Library, Two Allen Civic Plaza, Allen, Texas. Items discussed in the preceding workshop included: • Tour of New City Hall Items discussed at the February 26, 2000, Strategic Planning Session of the City Council are included as Exhibit .,A Public Recognition Citizens' Comments. There were no Citizens' Comments. 2. Presentation of a Proclamation to George Conner, City Engineer, Recognizing National Engineers L Week. ALLEN CITY COUNCIL REGULAR MEETING MARCH 2, 2000 PAGE 2 3. Presentation of a Proclamation to a Representative from the American Red Cross Proclaiming Red Cross Month. Mayor Pro Tem Kerr stepped down from the Council bench. MOTION: Upon a motion made by Councilmember Thomas and a second by Councilmember Fulk, the Council voted six (6) for and none (0) opposed to approve and adopt all items on the consent agenda as follows: 4. Approve Minutes of the February 17, 2000, Regular Meeting. 5. Receive Tax Assessor -Collector's Report for November 1999. 6. Receive Tax Assessor -Collector's Report for December 1999. 7. Accept Resignation from Ms. Pamela Smith and Declare a Vacancy in Place No. 6 of the Planning and Zoning Commission, 8. Authorize Execution of Contracts with Cook InletNoiceStream PCS, L.L.C., for the Following: A. Execute a Five -Year Contract in the Amount of $12,000 per Year for Placement of a Cellular Antenna on the Rowlett Water Tower. Council authorized the City Manager to execute a contract with Cook InletNoiceStream PCS, LL C., in the amount of $12,000 per year with a rate increase of five percent each year for placement of a cellular antenna on the Rowlett Water Tower. B. Execute a Five -Year Contract in the Amount of $12,000 per Year for Placement of a Cellular Antenna on the Hillside Water Tower. Council authorized the City Manager to execute a contract with Cook InletNoiceStream PCS, L L.C., in the amount of $12,000 per year with a rate increase of five percent each year for placement of a cellular antenna on the Hillside Water Tower. 9. Authorize Execution of a Contract to Moss Construction Company in the Amount of $80,713 for a Sanitary Sewer Line Extension on SH 5 from Rivercrest Boulevard to High Meadow Drive. Council authorized the City Manager to execute a contract with the low bidder, Moss Construction Company, for a unit price contract of $80,713 for a sanitary sewer line extension on SH 5 from Rivercrest Boulevard to High Meadow Drive. 10. Conduct a Public Hearing and Consider the Adoption of an Ordinance Requesting a Change in Zoning from Shopping Center (SC) to a Community Facilities (CF) District for Victoria Gardens on 6.472 Acres of Land Located West of Jupiter Road and South of Main Street. Mayor Terrell opened the public hearing and asked for anyone speaking either for or against the request to do so at this time With no one speaking either for or against the request, Mayor Terrell closed the public hearing. MOTION: Upon a motion made by Councilmember Folk and a second by Councilmember Bartlemay, the Council voted six (6) for and none (0) opposed to table consideration of this request to the March 16, 2000, regular Council meeting upon the request of the Proponent The motion carried. Conduct a Public Hearing and Consider the Adoption of an Ordinance for a Request to Rezone Planned Development No. 42 (PD No. 42) for R-5 and R-7 Single Family Residential Developments on 94.569 Acres of Land Located Northeast of Main Street and Malone Road for Auburn Springs Subdivision. Mayor Terrell opened the public hearing and asked for anyone speaking either for or against the request to do so at this time. With no one speaking either for or against the request, Mayor Terrell closed the public hearing. Ordinance No. 1807-3-00An Ordinance of the City Council of the City of Allen, Collin County, Texas, Amending Comprehensive Zoning Ordinance No. 1425-5-96 and Zoning Map, as Previously Amended, by Granting a Change in Zoning from Planned Development No. 42 to 'R-5" Single -Family Residential District for 41.049 Acres and "R-7" Single -Family Residential District for 53.520 Acres in the Witsaul Fisher Survey, Abstract No 323, City of Allen, Collin County, Texas, and Being Further Described in Exhibit "A" Attached Hereto, Providing for a Repealing Clause; Providing for a Sevembilrty Clause; Providing for a Savings Clause; Providing for a Penalty of Fine Not to Exceed the Sum of Two Thousand Dollars ($2,000) for Each Offense; and Providing for an Effective Date. MOTION: Upon a motion made by Councilmember Thomas and a second by Councilmember Gallagher, the Council voted four (4) for and two (2) opposed with Councilmembers Gallagher and Folk casting the negative votes, to approve and adopt Ordinance No. 1807-3-00 as previously captioned rezoning a 94.569 acre tract of land within Planned Development No 42 to R5 and R7 Single Family Residential Districts for the development of the Auburn Springs Subdivision. �1 The motion carried. Conduct a Public Hearing and Consider the Adoption of an Ordinance for a Specific Use Permit (SUP) for a Restaurant/Private Club for LaFinca Mexican Restaurant on .9523 Acres of Land Located Northeast of US 75 on Bethany Drive. Mayor Terrell opened the public hearing and asked for anyone speaking either for or against the request to do so at this time. With no one speaking either for or against the request, Mayor Terrell closed the public hearing. Ordinance No. 1808-3-00: An Ordinance of the City Council of the City of Allen, Collin County, Texas, Amending the Comprehensive Zoning Ordinance No. 1425-5-96 and Zoning Map, as Previously Amended, by Granting a Specific Use Permit for RestaumnUPrivate Club with Special Conditions for the Property Located on Lot 2, Block 1, the Allen Tech Center Addition (Recorded in C.C.P.R. 99-0066477) in Planned Development District — Corridor Commercial No. 68, Providing a Repealing Clause; Providing a Sevembility Clause; Providing a Savings Clause; Providing a Penalty of Fine Not to Exceed the Sum of Two Thousand Dollars ($2,000) for Each Offense; and Providing an Effective Date. MOTION: Upon a motion made by Councilmember Gallagher and a second by Councilmember Bartlemay, the Council voted six (6) for and none (0) opposed to approve and adopt Ordinance No. 1808-3- 00 as previously captioned granting a Specific Use Permit for a Restaurant/Private Club for LaFinca Mexican Restaurant. The motion carried. Mayor Pro Tem Kerr returned to the Council bench. 14. Adopt a Resolution Approving the Boundary Agreement between the City of Plano and the City of Allen. Resolution No. 1809-3-00(R): A Resolution of the City Council of the City of Allen, Collin County, Texas, Approving the Terms and Conditions of a Boundary Adjustment Agreement by and Between the City of Allen, Texas, and the City of Plano, Texas, to Set Future City Limit Boundaries and to Adjust Existing Boundaries; Authorizing Its Execution by the City Manager; and Providing for an Effective Date. MOTION: Upon a motion made by Councilmember Owen and a second by Councilmember Fulk, the Council voted seven (7) for and none (0) opposed to approve and adopt Resolution No. 1809-3- 00(R) as previously captioned approving the boundary agreement between the City of Plano and City of Allen. The motion carried. 15. Provide Direction to the Planning Department to Prepare a Service Plan and Adopt a Schedule of Proccedings for a Proposed Annexation. MOTION: Upon a motion made by Mayor Pro Tem Kerr and a second by Councilmember Fulk, the Council voted seven (7) for and none (0) opposed to direct the Planning Department to prepare ALLEN CITY COUNCIL REGULAR MEETING MARCH 2, 2000 Otber Business PAGE a service plan that provides for the extension of full municipal services to approximately fifteen acres of land located adjacent to the City limits at Hedgcoxe Road and Custer Road and to adopt a schedule using the regularly scheduled Council meetings as proposed for the proceedings.
