Call to Order and Announce a Ouorum is Present
With a quorum of the Councilmembers present, the Regular Meeting of the Allen City Council was called to
order by Mayor Terrell at 7:06 p.m. on Tuesday, January 13, 2004, in the Council Chambers of the Allen City
Hall, Allen Civic Plaza, 305 Century Parkway, Allen, Texas Items discussed in the preceding workshop
included:
Introduction of Cal Calvin, Chair of the Library Board
Introduction of George Chrisman, Former Member of the Library Board
View the 'History of Allen' Segment from the Access Allen Broadcast
Discussion Regarding the Proposed Interlocal Agreement, Articles of Incorporation, and B) laws
for the Arts of Collin County Commission
Items discussed at the Allen City Council Joint Workshop with Frisco City Council and Plano City Council
held on January 5, 2004, in Frisco, Texas, included:
• Update Regarding the Arts of Collin County Project
• Presentation and Discussion of Various Legal Documents as Required to Establish a Local
Government Corporation to Develop and Manage Property and Facilities for Performing and
Creative Arts within Collin County

2. Presentation of Proclamations by the Office of the Mayor:

Alliance.
5. Administer Oath -of -Office and Certificate -of -Appointment to Milt Haws, Newly Appointed
Member to the Allen Arts Alliance.
MOTION: Upon a motion made by Councilmember Stout and a second by Councilmember Bardemay,
the Council voted seven (7) for and none (0) opposed to approve and adopt the consent
agenda as follows:
6. Approve Minutes of the December 9, 2003, Regular Meeting.
7. Adopt an Ordinance Authorizing Extension of the Current Franchise Agreement to TXU Gas
Distribution until July 31, 2004, for Operating and Maintaining their Gas Distribution System
in the City of Allen.
ORDINANCE NO. 2251-1-04: AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
ALLEN, COLLIN COUNTY, TEXAS, EXTENDING UNTIL JULY 31, 2004, THE FRANCHISE
GRANTED TO TXU GAS COMPANY, TO OWN, OPERATE, AND MAINTAIN A GAS
DISTRIBUTION SYSTEM IN THE CITY OF ALLEN; PROVIDING A REPEALING CLAUSE;
PROVIDING A SEVERABILITY CLAUSE; AND PROVIDING AN EFFECTIVE DATE.
S. Adopt an Ordinance Authorizing Extension of the Current Franchise Agreement to Oncor
Electric Delivery Company until July 31, 2004, for Operating and Maintaining their Electric
Distribution System in the City of Allen.
ORDINANCE NO. 2252-1-04: AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
ALLEN, COLLIN COUNTY, TEXAS, EXTENDING UNTIL JULY 31, 2004, THE FRANCHISE

ORDINANCE NO. 2253-1-04: AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
ALLEN, COLLIN COUNTY, TEXAS, EXTENDING UNTIL JULY 31, 2004, THE FRANCHISE
GRANTED TO GRAYSON-COLLIN COUNTY ELECTRIC COOPERATIVE, INC., TO OWN,
OPERATE, AND MAINTAIN AN ELECTRIC DISTRIBUTION SYSTEM IN THE CITY OF
ALLEN; PROVIDING A REPEALING CLAUSE; PROVIDING A SEVERABILITY CLAUSE;
AND PROVIDING AN EFFECTIVE DATE.
10. Adopt an Ordinance Authorizing Extension of the Current Franchise Agreement to Denton
County Electric Cooperative, Inc., d/b/a CoSery Electric Delivery Company until July 31, 2004,
for Operating and Maintaining their Electric Distribution System in the City of Allen.
ORDINANCE NO. 2254-1-04: AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
ALLEN, COLLIN COUNTY, TEXAS, EXTENDING UNTIL JULY 31, 2004, THE FRANCHISE
GRANTED TO DENTON COUNTY ELECTRIC COOPERATIVE, INC., D/B/A COSERV
ELECTRIC TO OWN, OPERATE, AND MAINTAIN AN ELECTRIC DISTRIBUTION SYSTEM
IN THE CITY OF ALLEN; PROVIDING A REPEALING CLAUSE; PROVIDING A
SEVERABILITY CLAUSE; AND PROVIDING AN EFFECTIVE DATE
11. Adopt a Resolution Designating City Representatives for the Bank Depository.
RESOLUTION NO. 2255-1-04(R): A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF ALLEN, COLLIN COUNTY, TEXAS, DESIGNATING CITY REPRESENTATIVES FOR THE
BANK DEPOSITORY; AND PROVIDING AN EFFECTIVE DATE.
12. Adopt a Resolution Designating Investment Officers of the City and Authorizing these
Individuals to Invest, Transfer, Withdraw, Deposit, Give Instructions on Behalf of the
Organization, or Manage Funds for the City of Allen.
RESOLUTION NO. 22561-04(R): A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF ALLEN, COLLIN COUNTY, TEXAS, DESIGNATING INVESTMENT OFFICERS OF THE
CITY AND AUTHORIZING THESE INDIVIDUALS TO INVEST, TRANSFER, WITHDRAW,
DEPOSIT, GIVE INSTRUCTIONS ON BEHALF OF THE ORGANIZATION, OR MANAGE
FUNDS FOR THE CITY OF ALLEN; AND PROVIDING AN EFFECTIVE DATE.
13. Adopt a Resolution Authorizing Application for a State of Texas, Office of the Governor,
Criminal Justice Division Grant for a Child Abuse Investigator Position.
RESOLUTION NO. 2257-1-04(R): A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF ALLEN, COLLIN COUNTY, TEXAS, TO ACCEPT A GRANT FROM THE STATE OF
TEXAS, OFFICE OF THE GOVERNOR, CRIMINAL JUSTICE DIVISION PROVIDING
FUNDING FOR A CHILD ABUSE INVESTIGATOR POSITION TO BE ASSIGNED TO THE
ALLEN CITY COUNCIL

COLLIN COUNTY CHILD ABUSE TASK FORCE, IF AWARDED; AND PROVIDING AN
EFFECTIVE DATE.
14. Award Bid and Authorize Execution of a Construction Contract with Irricon for the Allen
Heights Drive and Greenville Avenue Median Landscape Project for an Amount not to exceed
$591,876.
Council authorized the City Manager to execute a construction contract with Irricon for the Allen
Heights Drive and Greenville Avenue Median Landscape project for an amount not to exceed
$591,876.
15. Award Bid and Authorize Execution of the Purchase of a Leak Detection System with Fluid
Conservation Systems for an Amount not to exceed $66,000.
Council authorized the City Manager to purchase the Leak Detection Equipment from Fluid
Conservation Systems for an amount not to exceed $66,000.
16. Award Bid and Authorize Execution of a Contract with L.A. Sears Construction, Inc., for an
Amount not to exceed $234,470.65 for Construction of the Watters Creek Trail Connector
Project.
Council authorized the City Manager to execute a contract with L.A. Sears Construction, Inc , for an
amount not to exceed $234,470 65 for construction of the Walters Creek Trail Connector project.
17. Award Bid and Authorize Execution of a Contract with A.U.I. Contractors, L.P. for an
Amount not to exceed $248,821 for Construction of The Trail at The Woods Project.
Council authorized the City Manager to execute a contract with AUI Contractors, LT for an amount
not to exceed $248,821 for construction of The Trail at The Woods project.
18. Receive the Summary of Property Tax Collections as of November 2003.

In accordance with the Texas Government Code, Legal, Section 551.071; Property, Section 551.072;
Personnel, Section 551.074; Staff Presentations, Section 551.075: the Allen City Council convened into
Executive Session at 8:05 p.m. on Tuesday. January 13, 2004, in the Council Conference Room, Allen Civic
Plaza, 305 Century Parkway, Allen, Texas, in order to continue discussing matters pertaining to:
Property - Pursuant to Section 551.072 of the Texas Government Code — Purchase of Real Property
The Executive Session adjourned at 8:59 p.m. on Tuesday, January 13, 2004.
28. Reconvene and Consider Action on Items Discussed during Executive Session.
The Allen City Council reconvened into regular session at 9.05 p.m. on Tuesday. January 13, 2004,
in the Council Chambers of the Allen City Hall. No action was taken on items discussed during the
Executive Session.
MOTION: Upon a motion made by Councilmember McGregor and a second by Councilmember
Pacheco, the Council voted seven (7) for and none (0) opposed to adjourn the regular session
of the Allen City Council at 9.05 p.m. on Tuesday, January 13, 2004. The motion carried.
