With a quorum of the Councilmembers present, the Regular Meeting of the Allen City Council was called to
order by Mayor Terrell at 7 10 p.m. on Tuesday, June 11, 2002, in the Council Chambers of the Allen City
Hall, Allen Civic Plaza, 305 Century Parkway, Allen, Texas. Items discussed in the preceding workshop
included:
• Briefing Regarding Proposed Sign Requirements for Notification of Zoning Changes
• Briefing Regarding the City Council Rules of Order and Procedure
Pledge of Allegiance
1. Election of Mayor Pro Tem.
The Mayor opened the floor for nominations. Councilmember Petty nominated Councilmember Fulk to serve
as Mayor Pro Tem. There being no other nominations, Councilmember Falk was elected as Mayor Pro Tem
by a vote of seven (7) for and none (0) opposed.

Call to Order and Announce a Ouorum is Present
With a quorum of the Councilmembers present, the Regular Meeting of the Allen City Council was called to

4. Presentation of a Plaque -of -Appreciation to Ms. Lesa Stelcz, former Keep Allen Beautiful
Board Member.
5. Presentation by Dr. J. Tom Ward, Jr., Recognizing the Paramedic of the Year.
Dr. Ward presented Chns Plumlee an award for Paramedic of the Year.
6. Presentation by Dr. J. Tom Ward, Jr., Recognizing the Emergency Medical Technician of the
Year.
Dr. Ward presented Brun Westbrook an award for Emergency Medical Technician of the
Year.
7. Presentation by Mayor Terrell to Dr. J. Tom Ward, Jr., Recognizing his Twelve Years of
Dedicated Service to the Allen Fire Department as the Emergency Medical Services Medical
Director.
8. Presentation by Mayor Terrell to Ms. Kala Halliburton Recognizing her Twelve Years of
Dedicated Service to the Allen Fire Department as the Emergency Medical Services
Coordinator and Educator.
9. Recognition of the Finance Department as the Recipient of the Government Finance Officers
Association Distinguished Budget Presentation Award for Fiscal Year beginning October 1,
2001.
Consent Agenda
MOTION: Upon a motion made by Councdmember Stout and a second by Councilmember Bartlemay,
the Council voted seven (7) for and none (0) opposed to approve and adopt the consent
agenda as follows'
10. Approve Minutes of the May 13, 2002, TRIAD Meeting of the Allen City Council, Allen
Independent School District Board of Trustees, and the Allen Chamber of Commerce
Executive Committee.
11. Approve Minutes of the May 16, 2002, Regular Meeting
12. Adopt an Ordinance Abandoning Portions of a Waterline Easement along EM 2551 within the
North Bethany Lakes Phase Two Subdivision.
ORDINANCE NO. 2052-6-02: AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
ALLEN, COLLIN COUNTY, TEXAS, ABANDONING PORTIONS OF UTILITY EASEMENTS
AS DESCRIBED IN EXHIBITS "A" AND "B" ATTACHED; PROVIDING FOR THE
E FURNISHING OF A CERTIFIED COPY OF THIS ORDINANCE FOR RECORDING IN THE
REAL PROPERTY RECORDS OF COLLIN COUNTY, TEXAS, AS A QUITCLAIM DEED;

EPROVIDING FOR THE INDEMNIFICATION OF THE CITY OF ALLEN AGAINST DAMAGES

TO THE CITY OF ALLEN, TEXAS, AND PROVIDING AN EFFECTIVE DATE.
13. Adopt an Ordinance Amending Ordinance No. 2007-12-01, the Allen Retail Electric Providers
Registration Ordinance, by Repealing the Penalty Provision.
ORDINANCE NO. 2053-6-02: AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
ALLEN, COLLIN COUNTY, TEXAS, AMENDING ORDINANCE NO. 2007-12-01, THE ALLEN
RETAIL ELECTRIC PROVIDERS REGISTRATION ORDINANCE, BY REPEALING THE
PENALTY PROVISION; PROVIDING FOR A SEVERABILITY CLAUSE; PROVIDING FOR A
REPEALING CLAUSE; AND PROVIDING FOR AN EFFECTIVE DATE.
14. Adapt a Resolution Authorizing Intervention in Gas Utilities Docket 9304 at the Railroad
Commission of Texas Authorizing Participation in a Steering Committee with other Cities
Served by TXU Gas Company and Requiring Reimbursement from TXU Lone Star Pipeline of
Cities' Reasonable Rate Case Expenses.
RESOLUTION NO. 2054-6-02(R): A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF ALLEN, COLLIN COUNTY, TEXAS, AUTHORIZING INTERVENTION IN GAS UTILITIES
DOCKET 9304 AT THE RAILROAD COMMISSION; AUTHORIZING PARTICIPATION IN A
STEERING COMMITTEE WITH OTHER CITIES SERVED BY TXU AND REQUIRING
REIMBURSEMENT FROM TXU LONE STAR PIPELINE OF CITIES' REASONABLE RATE
CASE EXPENSES; AND PROVIDING AN EFFECTIVE DATE.
15. Adopt a Resolution Supporting Community Collaboration Entitled the Allen Community
Alliance Proposed by Allen Community Outreach.
RESOLUTION NO. 2055-6-02(R): A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF ALLEN, COLLIN COUNTY, TEXAS, SUPPORTING A COMMUNITY COLLABORATION
ENTITLED THE ALLEN COMMUNITY ALLIANCE; AND PROVIDING AN EFFECTIVE
DATE.
16. Adopt a Resolution Granting an Ad Valorem Property Tax Exemption to Allen Lodge No. 1435
A.F. & A.M.
RESOLUTION NO. 2056-6-02(R): A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF ALLEN, COLLIN COUNTY, TEXAS, ADOPTING THE LOCAL OPTION EXEMPTION
FROM AD VALOREM TAXATION FOR ORGANIZATIONS PRIMARILY ENGAGED IN
PERFORMING CHARITABLE FUNCTIONS UNDER THE PROVISIONS OF SECTION 11.184
OF THE TAX CODE; PROVIDING A SEVERABILITY CLAUSE; AND PROVIDING AN
EFFECTIVE DATE
17. Award Bid and Authorize Execution of a Construction Contract with Rex Environmental, Inc.,
the Lowest and Best Bidder, in the Amount of $134,274.50 for the Installation of the Hedgcoxe
Waterline.

Council authorized the City Manager to execute a construction contract with Rex Environmental,
Inc., the lowest and best bidder, for the installation of Phase 2 of the extension of the Hedgcoxe Road
24 -inch waterline for an amount not to exceed $134,274.50.
18. Award Bid and Authorize a Purchase Order to Philpott Motors, Ltd., the Lowest and Best
Bidder, for the Purchase of a Chipper Truck for the Parks and Recreation Department for an
Amount not to Exceed $36,568.
Council authorized the City Manager to issue a purchase order to Philpott Motors, Ltd., the lowest
and best bidder, for the purchase of the Parks and Recreation chipper truck for an amount not to
exceed $36,568
19. Authorize Execution of a Professional Services Agreement with The Holloway Group/Pyles
Whatley Corporation to Provide Right -of -Way Acquisition/Appraisal Services for an Initial
Term of One Year with Two One -Year Options to be Funded Directly from Designated Project
Budgets.
Council authorized the City Manager to execute a professional services agreement with The
Holloway Group/Pyles Whatley Corporation for right-of-way acquisition/appraisal services.
20. Rejection of Bids for the Mowing Maintenance Services for Medians, Greenbelts, and
Municipal Property.
21. Authorize Execution of a Dedication Agreement for Impact Fee Credit with William E.
Campbell, Jr. — Allen #2, L.P., for an Area of Ridgeview Drive, East of Stacy Road.
Council authorized the City Manager to execute a Dedication Agreement for Impact Fee Credit with
William E. Campbell, Jr. — Allen #2, L.P., for the right-of-way for Ridgeview Drive, east of Stacy
Road.
22. Authorize Execution of an Underground Installation of Electric Facilities Agreement with
Oncor Electric Delivery Company to Install Underground Electric Facilities along Exchange
Parkway from Watters Branch Creek to just west of Comanche Drive for an Amount of
$89,366.
Council authorized the City Manager to execute the Underground Installation of Electric Facilities

Exchange Parkway from Watters Branch Creek to just west of Comanche Drive for $89,366.
23. Authorize Execution of an Underground Utility Reimbursement Agreement with Briar Ridge
Investments, Inc. (Twin Creeks) in the Amount of $89,366 to Facilitate the Installation of
Underground Electric Utilities along Exchange Parkway from Watters Branch Creek to just
west of Comanche Drive.
Council authorized the City Manager to execute the Underground Utility Reimbursement Agreement
with Briar Ridge Investments, Inc. to facilitate the installation of underground electric facilities along
Exchange Parkway from Watters Branch Creek to lust west of Comanche Drive.

Reuular Auenda
24. Presentation and Recommendation Regarding the Senior Center Study Update.
Bob Hembrey spoke on behalf of the seniors requesting use of the old central fire station on an interim basis
only until a new, permanent senior center is built.
MOTION: Upon a motion made by Councilmember Obermeyer and a second by Mayor Pro Tem Falk,
the Council voted seven (7) for and none (0) opposed to accept the recommendation to
further study the building and program needs regarding the new senior center The motion
carred.
Tony Hill, City of Allen Recreational Services Manager, announced July 6, 2002 as the first annual Wild
Water Rodeo from 10:00 a.m. to 12:00 noon at the Don Rodenbaugh Natatorium.
25. Adopt a Resolution Establishing Rates and Fees for Solid Waste Collection and Recycling
Services.
�r RESOLUTION NO, 2057-6-02(R): A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF ALLEN, COLLIN COUNTY, TEXAS, ESTABLISHING FEES AND RATES FOR SOLID
WASTE COLLECTION SERVICES, PROVIDING A REPEALING CLAUSE; PROVIDING A
SEVERABILITY CLAUSE; AND PROVIDING AN EFFECTIVE DATE.
MOTION: Upon a motion made by Mayor Pro Tem Falk and a second by Councilmember McGregor,
the Council voted seven (7) for and none (0) opposed to adopt Resolution No. 2057-6-02(R)
as previously captioned. The motion carred.
