Smith, Attorney Call to Order and Announce a Quorum is Present With a quorum of the Councilmembers present, the Regular Meeting of the Allen City Council was called to order by Mayor Terrell at 7:08 p.m, on Tuesday, September 24, 2002, in the Council Chambers of the Allen City Hall, Allen Civic Plaza, 305 Century Parkway, Allen, Texas. Items discussed in the preceding workshop included: • Briefing regarding the settlement with Oncor for gas and electric franchise fee payments and amendments to the existing gas and electric franchise agreements Pledge of Allegiance 1. Citizens' Comments. Consent Agenda MOTION: Upon a motion made by Councilmember Stout and a second by Councdmember Bartlemay, the Council voted six (6) for and none (0) opposed to approve and adopt the consent agenda as follows: 2. Approve Minutes of the September 5, 2002, TRIAD Meeting of the City Council, Allen Independent School District Board of Trustees, and the Chamber of Commerce Executive Committee. Adopt an Ordinance Amending the Code of Ordinances, Chapter 9, "Motor Vehicles and Traffic," Establishing a Speed Limit for Angel Parkway between Stacy Road and Exchange Parkway. ORDINANCE NO. 2093-9-02: AN ORDINANCE OF THE CITY COUNCIL OF THE CTTY OF ALLEN, COLLIN COUNTY, TEXAS, AMENDING THE CODE OF ORDINANCES, BY AMENDING CHAPTER 9, "MOTOR VEHICLES AND TRAFFIC," ARTICLE V, "OPERATION OF VEHICLES," DIVISION 2, "SPEED REGULATIONS," SECTION 9-135(a), TO ESTABLISH THE MAXIMUM PRIMA FACIE SPEED LIMIT FOR ANGEL PARKWAY BETWEEN STACY ROAD AND EXCHANGE PARKWAY WITHIN THE CORPORATE LIMITS OF THE CITY OF ALLEN; PROVIDING FOR A REPEALING CLAUSE; PROVIDING A SEVERABILITY CLAUSE; PROVIDING FOR A PENALTY OF FINE NOT TO EXCEED THE SUM OF TWO HUNDRED DOLLARS ($200) FOR EACH OFFENSE; AND PROVIDING FOR AN EFFECTIVE DATE. 5. Adopt a Resolution Supporting the Establishment of a Federal Court House in Collin County, Texas. RESOLUTION NO, 2094-9-02(R): A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ALLEN, COLLIN COUNTY, TEXAS, SUPPORTING THE ESTABLISHMENT OF A FEDERAL COURT HOUSE AND RELATED FACILITIES IN COLLIN COUNTY; AND PROVIDING AN EFFECTIVE DATE. 6. Adopt a Resolution for Application to North Central Texas Council of Governments for Community Clean -Up Events Program Project Funding. RESOLUTION NO. 2095-9-02(R): A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ALLEN, COLLIN COUNTY, TEXAS, AUTHORIZING THE FILING OF A PROJECT APPLICATION WITH THE NORTH CENTRAL TEXAS COUNCIL OF GOVERNMENTS (NCTCOG) FOR A REGIONAL SOLID WASTE PROGRAM LOCAL PROJECT; AUTHORIZING THE CITY MANAGER TO ACT ON BEHALF OF THE CITY OF ALLEN, COLLIN COUNTY, TEXAS, IN ALL MATTERS RELATED TO THE APPLICATION; PLEDGING THAT R A PROJECT IS RECEIVED THE CITY OF ALLEN, COLLIN COUNTY, TEXAS, WILL COMPLY WITH THE PROJECT REQUIREMENTS OF THE NCTCOG, THE TEXAS COMMISSION ON ENVIRONMENTAL QUALITY (TCEQ) AND THE STATE OF TEXAS; AND PROVIDING AN EFFECTIVE DATE. 7. Award Bid and Authorize Execution of a Purchase Order with Pitney Bowes for the Purchase of an Automated DMS 10K Inserter/Burster/Folder Machine for the Utility Billing Division. 8. Authorize Execution of a Real Estate Sales Agreement for Exchange Parkway Right -of -Way. 9. Receive the CIP (Capital Improvement Program) Status Report. The Allen City Council reconvened into regular session at 8:45 p.m. on Tuesday, September 24, 2002, in the Council Chambers of the Allen City Hall.
