Call to Order and Announce a Quorum is Present
With a quorum of the Councilmembers present, the Regular Meeting of the Allen City Council was called to
order by Mayor Terrell at 7.08 p.m. on Tuesday, October 8, 2002, in the Council Chambers of the Allen City
Hall, Allen Civic Plaza, 305 Century Parkway, Allen, Texas. Items discussed in the preceding workshop
included:
• Briefing Regarding the Water and Sewer Rate Charge.
• Briefing Regarding the Schematic Roadway Plan involving Bethany Drive, SH 5, Exchange
Parkway, and Main Street.

9. Authorize Execution of the Compromise, Settlement and Release Agreement with Oncor for
Gas and Electric Franchise Payments.
Council accepted the terms of the Compromise, Settlement and Release Agreement with Oncor for
gas and electric franchise payments and authorized the City Manager to sign same.

ORDINANCE NO. 2096-10-02: AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
ALLEN, COLLIN COUNTY, TEXAS, AMENDING THE EXISTING GAS FRANCHISE
BETWEEN THE CITY OF ALLEN, COLLIN COUNTY, TEXAS, AND TXU GAS COMPANY
TO PROVIDE FOR A DIFFERENT CONSIDERATION AND TO AUTHORIZE THE LEASE OF
FACILITIES WITHIN THE CITY'S RIGHTS-OF-WAY; PROVIDING FOR ACCEPTANCE BY
TXU GAS COMPANY; PROVIDING FOR A SEVERABILITY CLAUSE; PROVIDING FOR A

12. Adopt a Resolution Authorizing the Sale of General Obligation Refunding and Improvement
Bonds, Series 2003.
RESOLUTION NO. 2098-10-02tR1: A RESOLUTION RELATING TO THE REFINANCING OF
CITY OF ALLEN, TEXAS, GENERAL OBLIGATION REFUNDING AND IMPROVEMENT
BONDS, SERIES 1992 AND RESOLVING OTHER MATTERS INCIDENT AND RELATED
THERETO.
13. Award Bid and Authorize Execution of a Contract with Texas Electric Utility Construction for
the South Fountain Gate Drive Storm Sewer Relief System Project.
Council authorized the City Manager to execute a contract with Texas Electric Utility Construction
for the construction of the South Fountain Gate Drive Storm Sewer Relief Project for an amount not
to exceed $227,758.27
14. Receive the Summary of Property Tax Collections as of August 2002.

CLAUSE; PROVIDING A SAVINGS CLAUSE; PROVIDING A PENALTY OF FINE NOT TO
EXCEED TWO THOUSAND DOLLARS ($2,000); AND PROVIDING FOR AN EFFECTIVE
DATE.
MOTION: Upon a motion made by Councilmember Bartlemay and a second by Councilmember Stout,
the Council voted five (5) for and none (0) opposed to approve and adopt Ordinance No.
2099-10-02 as previously captioned. The motion carred.
16. Conduct a Public Hearing and Adopt an Ordinance Amending Appendix "A" to Add
Definitions to the Allen Land Development Code.

ORDINANCE NO. 2100-10-02: AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
ALLEN, COLLIN COUNTY, TEXAS, AMENDING THE ALLEN LAND DEVELOPMENT CODE
BY AMENDING APPENDIX "A" TO ADD DEFINITIONS FOR ASSISTED LIVING CENTER,
CONVALESCENT HOME, ELECTRONIC MANUFACTURING AND ASSEMBLY, HOSPICE,
SELF -STORAGE, INDUSTRIAL, AND SELF -STORAGE, NEIGHBORHOOD; PROVIDING A
SEVERABH,ITY CLAUSE; PROVIDING A REPEALING CLAUSE; PROVIDING A SAVINGS

17. Conduct a Public Hearing and Adopt an Ordinance Amending Article IV Relating to the
Commercial Corridor (CC) and Industrial Technology (IT) Districts, Principal and Accessory
Uses of the Allen Land Development Code and Planned Development No. 54.
