Call to Order and Announce a Ouorum is Present
With a quorum of the Councilmembers present, the Regular Meeting of the Allen City Council was called to
order by City Secretary Shelley George at 7:01 p.m. on Tuesday. May 25, 2004, in the Council Chambers of
the Allen City Hall, Allen Civic Plar 305 Century Parkway, Allen, Texas. Items discussed in the preceding
workshop included:
• Briefing Regarding the Franchise Agreements for Oncor Electric, CoSery Electric Cooperative,
and Grayson -Collin County Electric Cooperative (GCEC).
• Briefing Regarding Racial Profiling Compliance.

I. Motion to Select `Mayor Pro Tem' for the Duration of this Meeting Only.
MOTION: Upon a motion made by Councilmember Stout and a second by Councilmember Obenneyer,
the Council voted five (5) for and none (0) opposed to appoint Susan Bartlemay as Mayor
Pro Tem for the duration of the May 25, 2004, meeting only. The motion carried.

General and Special Election of Councilmember Place Nos. 4 and 6, and the Proposition for
determining whether the City shall be authorized to sell/trade certain park land. The totals verified

RESOLUTION NO. 2289-5-04(R): A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF ALLEN, COLLIN COUNTY, TEXAS, DECLARING THE RESULTS OF THE GENERAL
AND SPECIAL ELECTION OF THE CITY OF ALLEN HELD MAY 15, 2004, FOR THE CITY
COUNCILMEMBERS AND THE PROPOSITION FOR DETERMINING WHETHER THE CITY
SHALL BE AUTHORIZED TO SELL/TRADE CERTAIN PARK LAND; AND PROVIDING AN
EFFECTIVE DATE.
MOTION: Upon a motion made by Councilmember Stout and a second by Councilmember McGregor,
the Council voted five (5) for and none (0) opposed to adopt Resolution No. 2289-5-04(R) as
previously captioned, declaring the results of the May 15, 2004, General and Special
Election. The motion carried.

Pat Buckley, Vice -Chair of Keep Allen Beautiful Board, announced the awards received by City of

MOTION: Upon a motion made by Councilmember McGregor and a second by Councilmember
Pacheco, the Council voted five (5) for and none (0) opposed to approve and adopt the
consent agenda as follows:
7. Approve Minutes of the May 11, 2004, Regular Meeting.
8. Adopt a Resolution Authorizing an Interlocal Agreement with the City of Lucas to Provide
Inspection Services for new Lovejoy Independent School District Facilities Located in Lucas.
RESOLUTION 2290-5-04(R): A RESOLUTION OF THE CITY COUNCIL FOR THE CITY OF
ALLEN, COLLIN COUNTY, TEXAS, APPROVING THE TERMS AND CONDITIONS OF THE
ATTACHED INTERLOCAL COOPERATION AGREEMENT BY AND BETWEEN THE CITY OF

9. Authorize Execution of Real Estate Sales Contracts for Right -of -Way for the East Main Street
Widening Project with Brian and Gale Doffing for an Amount of $1,493; with Bart and Kelly
Presti for an Amount of 53,236; with Glen and Tracy Pederson for an Amount of $3,053; and
with Dorothy Farris for an Amount of $2,142 plus Closing Costs for these Parcels.
Council authorized the City Manager to execute the real estate sales contracts for the rightof-way, for
the East Main Street Widening Project with Brian and Gale Doffing for an amount of $1,493; with
Bart and Kelly Presti for an amount of $3,236; with Glen and Tracy Pederson for an amount of
$3,053; and with Dorothy Farris for an amount of $2,142; plus closing costs.
10. Authorize Execution of a Facilities Agreement for Twin Creeks Phase 7A-1 and 7A-2
Subdivision with Hillwood RLD regarding Infrastructure Improvements.
Council authorized the City Manager to execute a facilities agreement for Twin Creeks Phase 7A-1
and 7A-2 Subdivision with Hillwood RLD with regard to the "Infrastructure Improvements."
11. Receive the Quarterly Financial Report for the Period Ending March 31, 2004.
12. Receive the Quarterly Investment Report for the Period Ending March 31, 2004.
13. Receive the Summary of Property Tax Collections as of April 2004.
14. Receive the CIP (Capital Improvement Program) Status Report.
The motion carried.
15. Authorize Execution of a Five -Year Contract with Community Waste Disposal, Inc. (CWD) for
a Services Contract for Solid Waste, Collection, Disposal, and Recycling.
MOTION: Upon a motion made by Councilmember Stout and a second by Councilmember Obermeyer,
the Council voted five (5) for and none (0) opposed to authorize the City Manager to execute
the five-year contract between the City and Community Waste Disposal for solid waste,
collection, disposal, and recycling services with an effective date of June I, 2004 The
motion carried.
16. Adopt a Resolution Establishing and Adjusting Rates and Fees for Solid Waste Collection and
Recycling Services.

MOTION: Upon a motion made by Councilmember Obermeyer and a second by Councilmember
Pacheco, the Council voted five (5) for and none (0) opposed to adopt Resolution No. 2291-
5-04(R) as previously captioned. The motion carried.
17. Conduct a Public Hearing and Adopt an Ordinance Granting a Change in Zoning by
Authorizing an Amendment to Tracts 5, 6, and 7 of Planned Development No. 65, being 41f
Acres, from SC Shopping Center and R5 Residential to move the SC Shopping Center to the
Northern Portion of the Tract and to add TH Townhome Zoning to the Southern Portion on
Property Located South of Shelley Drive and West of FM 2551.

June 8" Regular Meeting. The motion carried.
