With a quorum of the Councilmembers present, the Workshop Session of the Allen City Council was called to
order by Mayor Terrell at 6:18 p.m. on Tuesday, October 26, 2004, in the Council Conference Room of the
Allen City Hall, Allen Civic Plaza, 305 Century Parkway, Allen, Texas. Items discussed in the preceding
workshop included'
• Introduction of Ben Ferguson, Chair of the Parks and Recreation Board
• Update Regarding Star Creek (Blue Star Development)
• Other Items
With no further discussion, the Workshop Session of the Allen City Council was adjourned at 7:01 p.m. on
Tuesday, October 26, 2004.
Call to Order and Announce a Quorum is Present
With a quorum of the Councilmembers present, the Regular Meeting of the Allen City Council was called to
order by Mayor Terrell at 7:06 p.m. on Tuesday, October 26, 2004, in the Council Chambers of the Allen City
Hall, Allen Civic Plaza, 305 Century Parkway, Allen, Texas.

Mayor Terrell moved to Agenda Item 4.
4. Recognition of the Purchasing Division of the Finance Department as the Recipient of the
"Achievement of Excellence in Procurement" Award.
2. Present Oaths -of -Office and Certificates -of -Appointment to the Members of the Board of
Adjustment, Building and Standards Commission and the Sign Control Board.

5. Presentation of Proclamations by the Office of the Mayor:
• Presentation of a Proclamation to Principal Sandra Cheek and Student Council Members
Courtney Cox, Kathryn House, Will Jones, and Ty Pearman from Norton Elementary
School Proclaiming October 25-29, 2004, as Red Ribbon Week
• Presentation of a Proclamation to Representatives of the Keep Allen Beautiful Board and
Donna Kliewer, Household Hazardous Waste/Recycling Coordinator, Proclaiming
November 6, 2004, as Allen Recycles Day.
6. Presentation Regarding the Allen Recycles Day Event Scheduled for November 6, 2004, as part
of the Texas Recycles Day Program.
3. Ben Ferguson, Chair of the Parks and Recreation Board, will Review the Parks and Recreation
Board's Annual Report to the City Council.
Mayor Terrell removed the following item from the consent agenda.
9. Authorize Execution of a Facilities Agreement for Greenville Crossing Tract with Centex Real
Estate Corporation with Regard to the Construction of North Allen Heights Drive
Improvements and the Design/Construction of the Neighborhood Park Improvements.

MOTION: Upon a motion made by Councilmember Obermeyer and a second by Councilmember
Bartlemay, the Council voted seven (7) for and none (0) opposed to approve and adopt all
remaining items on the consent agenda as follows:
7. Approve Minutes of the October 5, 2004, TRIAD Meeting of the City Council, Allen
Independent School District Board of Trustees, the Chamber of Commerce Executive
Committee, and the Allen Community Development Corporation Board of Directors.
8. Approve Minutes of the October 12, 2004, Regular Meeting.
10. Authorize Execution of a Real Estate Sales Contract with Faith Episcopal Church for the
Purchase of an Easement for the West Allen Waterline Project for an Amount of $50,000 plus
Closing Costs.
Council authorized the City Manager to execute the contract.
11. Authorize the Purchase of One 18 gpm Trailer Jetter in the Amount of $39,824 and One
Loader Backhoe in the Amount of $50,834.25 for the Community Services Department through
the Houston -Galveston Area Council of Governments Contractors, STM Equipment, Inc. and
Landmark Equipment, Inc., Respectively.
Council authorized the City Manager to purchase one 18 glint trailer,letter in the amount of $39,824
and one loader backhoe to the amount of $50,834.25 for the Community Services Department
through the Houston -Galveston Area Council of Governments contractors, STM Equipment, Inc.,
and Landmark Equipment, Inc.
12. Receive the Summary of Property Tax Collections as of September 2004.
13. Receive the CIP (Capital Improvement Program) Status Report.
The motion carried.
Regular Agenda
14. Conduct a Public Hearing and Adopt an Ordinance Amending the Code of Ordinances,
Chapter 10, "Offenses—Miscellaneous" to Adopt a Curfew for Juveniles.
Mayor Terrell opened the public hearing and asked for anyone speaking either for or against the
request to do so.
With no one speaking, Mayor Terrell closed the public hearing.
ORDINANCE NO. 2344-10-04: AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
ALLEN, COLLIN COUNTY, TEXAS, AMENDING THE CODE OF ORDINANCES, BY
AMENDING CHAPTER 10, "OFFENSES—MISCELLANEOUS," ARTICLE Il, "CURFEW FOR
CHILDREN," TO ADOPT A CURFEW FOR JUVENILES; PROVIDING A REPEALING
CLAUSE; PROVIDING A SEVERABILITY CLAUSE; PROVIDING A SAVINGS CLAUSE;
PROVIDING A PENALTY OF FINE NOT TO EXCEED THE SUM OF FIVE HUNDRED
DOLLARS ($500) FOR EACH OFFENSE; AND PROVIDING AN EFFECTIVE DATE.

MOTION: Upon a motion made by Councilmember Stout and a second by Councilmember Pacheco, the
Council voted seven (7) for and none (0) opposed to adopt Ordinance No. 2344-10-04 as
previously captioned. The motion carred.
15. Consider Approval of a Detailed Site Plan for the Bethany Heights Development Located
North of West Bethany Drive and West of Bel Air Drive and Authorize Execution of the
Facilities Agreement with the Emerson Farm Company.
MOTION: Upon a motion made by Councilmember Bartlemay and a second by Councilmember
Obermeyer, the Council voted seven (7) for and none (0) opposed to approve the detailed site
plan for the Bethany Heights development located north of West Bethany Drive and West of
Bel Air Drive adding amendments to set the minimum lot area at 5250 sq. ft. and the
minimum lot width at 50 ft.; and to authorize execution of the Facilities Agreement with the
Emerson Farm Company. The motion carried.

• October 30 — Harvest Concert and Festival/Joe Farmer Recreation Center/3:00-7:15 p.m.
• November 25 and 26 —City Facilities Closed/Thanksgiving Holiday
17. Items of Interest.
Mayor Terrell announced the donation by the Hall Family to the Arts of Collin County Foundation.
Mayor Terrell announced the birth of his newest niece earlier that day.
The Council wished Happy Birthday to Amy Monet.
Executive Session
The Executive Session was not held.
18. Reconvene and Consider Action on Items Discussed during Executive Session.

MOTION: Upon a motion made by Councilmember Stout and a second by Councilmember Bartlemay,
the Council voted seven (7) for and none (0) opposed to adjourn the regular session of the
Allen City Council at 8:36 p.m. on Tuesday, October 26, 2004. The motion carred.
