With a quorum of the Councilmembers present, the Workshop Session of the Allen City Council was called to
order by Mayor Terrell at 6:12 p.m. on Tuesday, August 9, 2005, in the Council Conference Room of the
Allen City Hall, 305 Century Parkway, Allen, Texas. Items discussed in the workshop included:
Update Regarding State Highway 121.
With no further discussion, the Workshop Session of the Allen City Council was adjourned at 6,55 p.m. on

Michael Kolls, Jared Kolls, and Brooke Trisler announced Reed Elementary's campaign to bring
Mrs. Laura Bush to Allen for Teacher Appreciation Week during May 2006.
2. Presentation of Blue Star Flags to the Families of Allen Service Personnel Currently Deployed
by the U.S. Armed Forces.
Mayor Terrell presented Blue Star Flags to the families of Sergeant First Class Teddy Perin and
Lance Corporal Robert Schnoebelen
3. Presentation of a Proclamation by the Office of the Mayor:
• Presentation of a Proclamation to Representatives of the Allen High School Girls' Golf Team for
Winning the 5A State Championship and Proclaiming August 2005 as Lady Eagle Got( Team
Month.
4. Citizen Request for Consideration of a Petition.
• Request by Mr. Sterling Gibson for the Allen City Council to Consider a Petition for the
Removal of the Centerline Pavement Markers Currently Installed on Twin Creeks Drive and
Comanche Drive and Issue a Moratorium of Further Traffic Striping in the Twin Creeks
Neighborhood.
Speaking for removal of the pavement markers:
Lori Heil, 1211 Comanche Drive, Allen, Texas, and
Douglas VanderArh, 909 Twin Creeks, Allen, Texas.
MOTION: Upon a motion made by Councilmember Stout and a second by Councilmember Obermeyer,
the Council voted seven (7) for and none (0) opposed to approve and adopt the consent
agenda as follows:
5. Approve Minutes of the July 26, 2005, Regular Meeting.
6. Motion to Approve Mr. Maher Maso as an At -Large Representative to the Arts of Collin
County Commission, Inc. Board of Directors.
7. Authorize Execution of an Agreement with Weaver and Tidwell, L.L.P. for Professional Audit
Services for the Fiscal Years beginning October 1, 2004, through September 30, 2009.
Council authorized the City Manager to execute the agreement.
8. Award Bid and Authorize Execution of Annual Contracts with Estes, Inc. for an Amount not to
exceed $15,089.90, with CMC Company for an amount not to exceed $14,390, and with Helena
Chemical Company for an Amount not to exceed $715, with Four One -Year Options to Renew
for the Purchase and Delivery of Granular and Liquid Fertilizer at Chase Oaks Golf Course.
Council authorized the City Manager to execute the annual contracts

9. Award Bid and Authorize Execution of a Contract with Jim Bowman Construction Company
for Construction of Pavement Repairs at the Intersection of Allen Drive and McDermott Drive
for an Amount not to exceed $92,508 and Establish a Project Budget of $120,000.
Council authorized the City Manager to execute the contract.
10. Authorize the Execution of a Contract with Sunguard/HTE for the Human Resources and
Applicant Tracking Module for an amount of $27,000.
Council authorized the City Manager to execute the contract.
11. Receive the Summary of Property Tax Collections as of June 2005.
The motion carried.
Recular Aeenda
12. Adopt an Ordinance Establishing the Allen Public Art Program; Establishing the Public Art
Committee and Providing for the Duties of that Committee; and Establishing General
Guidelines for the Administration of the Public Art Program.
ORDINANCE NO. 2429-8-05: AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
ALLEN, COLLIN COUNTY, TEXAS, ESTABLISHING THE ALLEN PUBLIC ART PROGRAM;
PROVIDING FOR THE FUNDING FOR THE ALLEN PUBLIC ART PROGRAM;
ESTABLISHING THE PUBLIC ART COMMITTEE AND PROVIDING FOR THE DUTIES OF
THAT COMMITTEE; ESTABLISHING GENERAL GUIDELINES FOR THE ADMINISTRATION
OF THE PUBLIC ART PROGRAM; AND PROVIDING AN EFFECTIVE DATE.
MOTION: Upon a motion made by Councilmember Stout and a second by Councilmember Bartlemay,
the Council voted seven (7) for and none opposed to adopt Ordinance No. 2429-8-05 as
previously captioned. The motion carried
13. Adopt an Ordinance Authorizing the Issuance of the Waterworks and Sewer System Revenue
Improvement Bonds, Series 2005.
ORDINANCE NO. 2430-8-05; AN ORDINANCE AUTHORIZING THE ISSUANCE OF "CITY
OF ALLEN, TEXAS, WATERWORKS AND SEWER SYSTEM REVENUE BONDS, SERIES
2005; PLEDGING THE NET REVENUES OF THE CITY'S COMBINED WATERWORKS AND
SEWER SYSTEM TO THE PAYMENT OF THE PRINCIPAL OF AND INTEREST ON SAID
BONDS, ENACTING PROVISIONS INCIDENT AND RELATED TO THE ISSUANCE,
PAYMENT, SECURITY AND DELIVERY OF SAID BONDS, INCLUDING THE APPROVAL
AND EXECUTION OF A PAYING AGENT/REGISTRAR AGREEMENT AND THE APPROVAL
AND DISTRIBUTION OF AN OFFICIAL STATEMENT PERTAINING THERETO; AND
PROVIDING AN EFFECTIVE DATE.
MOTION: Upon a motion made by Councilmember Bartlemay and a second by Councilmember
Obenneyer, the Council voted seven (7) for and none opposed to adopt Ordinance No.
2430-8-05, as previously captioned, authorizing the issuance of the Waterworks and Sewer

System Revenue Improvement Bonds, Series 2005, in the aggregate principal amount of
$4,300,000, approval of various agreements in relation to such bonds, and approval and
distribution of an Official Statement. The motion carried.
14. CONTINUATION: Continue Public Hearing and Adopt an Ordinance Amending the Allen
Land Development Code Allowed Uses, Development Regulations, and Sign Regulations for the
Central Business District.
MOTION: Upon a motion made by Mayor Pro Tem Fulk and a second by Councilmember Stout, the
Council voted seven (7) for and none opposed to continue the public hearing to the
August 23, 2005, Regular Meeting The motion carried.
15. Adopt a Resolution Supporting the Funding for State Highway 121 Main Lines as a Toll
Facility.
RESOLUTION NO. 2431-8415(Rl: A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF ALLEN, COLLIN COUNTY, TEXAS, SUPPORTING FUNDING FOR THE CONSTRUCTION
OF THE STATE HIGHWAY 121 MAIN LANES IN COLLIN COUNTY, AND PROVIDING AN
EFFECTIVE DATE.
MOTION: Upon a motion made by Mayor Pro Tem Fulk and a second by Councilmember Pacheco, the
Council voted seven (7) for and none opposed to adopt Resolution No. 2431-8-05(R) as
t previously captioned. The motion carried.
16. Motion to Approve City Council Appointments to the Quasi -Judicial, Corporation and
Advisory Nominating Committees.
MOTION: Upon a motion made by Mayor Pro Tem Fulk and a second by Councilmember McGregor,
the Council voted seven (7) for and none opposed to appoint, as recommended by Mayor
Terrell, Councilmembers Obermeyer, Pacheco and McGregor with Alternate member
Councilmember Stout to the Advisory Boards Nominating Committee, Quasi -Judicial Boards
Nominating Committee, and Corporation Boards Nominating Committee. The motion
carried.

• August 20 — Dedication Ceremony for Fire Truck #492 at Station No. 2 –10:30 a.m.
18. Items of Interest.
Council congratulated Allen resident, Greg Willis, on his nomination to serve as the Judge for
County Court at Law #6. His appointment is expected soon

Council recognized Star Scout Kevin Beardsley from Troop 79 in attendance as part of the
requirements for eaming a citizenship and community merit badge. An additional requirement
involves preparing a report on an issue discussed at the meeting. He announced that he would be
writing his report on the safety of the button installations on Comanche Drive and Twin Creeks
Drive.
Executive Session
The Executive Session was not held.
MOTION: Upon a motion made by Councilmember Stout and a second by Councilmember Bartlemay,
the Council voted seven (7) for and none (0) opposed to adjourn the regular session of the
Allen City Council at 8:50 p.m. on Tuesday, August 9, 2005. The motion carried.
