With a quorum of the Councilmembers present, the Workshop Session of the Allen City Council was called to
order by Mayor Terrell at 6:17 p.m. on Tuesday, October I L 2005, in the Council Conference Room of the
Allen City Hall, 305 Century Parkway, Allen, Texas Items discussed in the workshop included.
• Briefing Regarding the Council Rules of Order and Procedure
• Discussion Regarding the Construction of SH 121 Main Lanes as a Toll Facility
With no further discussion, the Workshop Session of the Allen City Council was adjourned at 7:03 p.m on

With a quorum of the Councilmembers present, the Regular Meeting of the Allen City Council was called to
order by Mayor Terrell at 7:06 p.m on Tuesday, October 1 L 2005, in the Council Chambers of the Allen City

MOTION: Upon a motion made by Councilmember Obermeyer and a second by Councilmember Stout,
the Council voted seven (7) for and none (0) opposed to approve and adopt the consent
agenda as follows
5. Approve Minutes of the September 27, 2005, Regular Meeting.
6. Adopt an Ordinance Adopting and Enacting Supplement No. 1 to the Code of Ordinances for
the City of Allen.
ORDINANCE NO. 2448-10-05: AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
ALLEN, COLLIN COUNTY, TEXAS, ADOPTING SUPPLEMENT NUMBER 1 TO THE CODE
OF ORDINANCES, PROVIDING FOR THE PRINTING THEREOF, AUTHENTICATION BY
THE MAYOR AND ATTESTATION BY THE CITY SECRETARY, PROVIDING A REPEAL OF
CERTAIN ORDINANCES; PROVIDING EXCEPTIONS TO REPEAL, PROVIDING A PENALTY
FOR SUCH VIOLATION THEREOF, AND PROVIDING AN EFFECTIVE DATE

7. Award Bid and Authorize Execution of a One-year Contract for Mowing Services Phase II at
Chase Oaks Golf Course with Martin Properly Maintenance, with an Estimated Annual
Expenditure of $27,132 with Three One-year Options to Renew under the Same Terms and
Conditions.
Council authorized the City Manager to execute the contract.
8. Authorize Execution of a Real Estate Sales Contract with LLG Lands, Inc. for the Purchase of
Approximately 20 Acres of Real Property in the Allen Station Business Park for $2.80 per
Square Foot and Establish a Project Budget of $2,516,700 for Land Acquisition.
Council authorized the City Manager to execute the contract.
9. Authorize Execution of a Contract with Jim Bowman, L.P. for the Construction of a Right -
Turn Lane for Eastbound McDermott Drive at the Southbound Frontage Road of US 75 for
$150,711.15 and Establish a Project Budget of $270,000.
Council authorized the City Manager to execute the contract.
10. Authorize the Execution of a Contract with Preload, Inc. for the Construction of a Six -Million
Gallon Ground Storage Reservoir at the Custer Road Pump Station for $2,711,810 and
Approve a Budget of $6,003,821 for the Overall Project.
Council authorized the City Manager to execute the contract.
it. Authorize the Purchase of Three Solo Certified Law Enforcement Motorcycles from BMW
Motorcycles of North Dallas, for an Amount Not to Exceed $56,994 and Execute an Annual
Contract for Preventative Maintenance.
Council authorized the City Manager to execute the contract.
12. Authorize the Purchase of Seven Vehicles for Various Departments through the Houston -
Galveston Area Council (H -GAC) Cooperative Purchasing Program Authorized Contractor,
Philpott Motors, for an Amount Not to Exceed $137,009.50.
Council authorized the City Manager to execute the contract.
13. Authorize Execution of a Personal Services Contract with Pepperhead Pyrotechnics for a
Fireworks Performance during the 2006 Allen USA Celebration in the Amount of $30,000.
Council authorized the City Manager to execute the contract.
The motion carred.
14. Public Hearing and Adopt an Ordinance Granting a Change in Zoning on 233.06± Acres of
Land to Remove the Subdistricts from the Central Business District and to Rezone the
Property to CBD Central Business District Under the New Regulations.

Mayor Terrell opened the public hearing and asked for anvone speaking either for or against the
request to do so.
Z. Askari, 414 N. Anna, Allen, Texas, asked what impact will the change in zoning have on the
businesses and homes currently located within this district.
With no one else speaking, Mayor Terrell closed the public hearing.
ORDINANCE NO. 2449-10-05: AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
ALLEN, COLLIN COUNTY, TEXAS, AMENDING THE ALLEN LAND DEVELOPMENT CODE
AND ZONING MAP, AS PREVIOUSLY AMENDED, BY GRANTING A CHANGE IN ZONING
FROM "CBD" CENTRAL BUSINESS DISTRICT -MIXED USE RESIDENTIAURETAIL, "CBD"
CENTRAL BUSINESS DISTRICT–OFFICE, "CBD" CENTRAL BUSINESS DISTRICT–
OFFICE/RETAIL, "CBD" CENTRAL BUSINESS DISTRICT–SELF-STORAGE, "CBD"
CENTRAL BUSINESS DISTRICT–INSTITUTIONAL, "CBD" CENTRAL BUSINESS DISTRICT–
INSTITUTIONAL/ OFFICE, "CBD" CENTRAL BUSINESS DISTRICTMEDICALOFFICE
MEDICAL SUPPLY, "CBD" CENTRAL BUSINESS DISTRICT TRANSPORTATION, ON

DESCRIBED IN EXHIBITS "A" THROUGH "M" TO "CBD" CENTRAL BUSINESS DISTRICT;
PROVIDING A REPEALING CLAUSE; PROVIDING A SEVERABILITY CLAUSE; PROVIDING
A SAVINGS CLAUSE; PROVIDING A PENALTY OF FINE NOT TO EXCEED THE SUM OF
TWO THOUSAND DOLLARS 112,0001 FOR EACH OFFENSE; AND PROVIDING AN
EFFECTIVE DATE.
MOTION: Upon a motion made by Mayor Pro Tem Folk and a second by Councilmember Obermeyer,
the Council voted seven (7) for and none opposed to adopt Ordinance No. 2449-10-05 as
previously captioned. The motion carried.
15. CONTINUED ITEM: Public Hearing and Adopt an Ordinance Granting a Change in Zoning from
AO Agriculture -Open Space to PD Planned Development No. 98 for R4 Residential, R5 Residential,
TH Townhome, and CC Corridor Commercial Uses for 164± Acres of Land Located North of West
Exchange Parkway and West of Twin Creeks Drive
MOTION: Upon a motion made by Councilmember Stout and a second by Councilmember Bartlemay,
the Council voted seven (7) for and none opposed to continue the public hearing to the
October 25, 2005, regular meeting of the Allen City Council. The motion carried.

Councilmember Obermeyer announced that the Allen Parks Foundation Golf Tournament had been
cancelled for October 131h
Executive Session
The Executive Session was not held.
MOTION: Upon a motion made by Councilmember Stout and a second by Councilmember Bartlemay,
the Council voted seven (7) for and none (0) opposed to adjourn the Regular Session of the
Allen City Council at 7'35 p.m. on Tuesday, October 1I, 2005. The motion carried.
