George, City Secretary Pete Smith, City Attorney Workshop Session With a quorum of the Councilmembers present, the Workshop Session of the Allen City Council was called to order by Mayor Terrell at 6:13 p.m. on Tuesday, September 22, 2009, in the Council Conference Room of the Allen City Hall, 305 Century Parkway, Allen, Texas, to discuss the following items: • Update Regarding the Arts of Collin County • Discussion Regarding the Complete Count Committee for 2010 • Update Regarding the Allen Event Center • Committee Updates from City Council Liaisons With no further discussion, the Workshop Session of the Allen City Council was adjourned at 6:59 p.m. on Tuesday, September 22, 2009 Call to Order and Announce a Quorum is Present With a quorum of the Councilmembers present, the Regular Meeting of the Allen City Council was called to order by Mayor Terrell at 7:05 p.m. on Tuesday, September 22, 2009, in the Council Chambers of the Allen City Hall, 305 Century Parkway, Allen, Texas. Present a Plaque -of -Appreciation to Sharon Hall, Former Member of the Public Art Committee. 3. Presentation of Proclamations by the Office of the Mayor: • Presentation of a Proclamation to Representatives of the Allen Arts Alliance, Arts of Collin County, and Public Art Committee Proclaiming October 2009 as Arts and Humanities Month. 4. Presentation by Jane Bennett, Chairperson for ALLen Reads, Regarding the 2010 ALLen Reads Program. Consent Aeenda MOTION: Upon a motion made by Councilmember Obermeyer and a second by Mayor Pro Tem Stout, the Council voted seven (7) for and none (0) opposed to adopt the items on the Consent Agenda as follows: 5. Approve Minutes of the September 8, 2009, Regular Meeting. 6. Adopt a Resolution Authorizing the Adoption of the Proposed Amendments to the Rules of Order and Procedure. RESOLUTION NO. 2858-9-09(R): A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ALLEN, COLLIN COUNTY, TEXAS, REVISING CERTAIN SECTIONS OF THE CITY COUNCIL RULES OF ORDER; AND PROVIDING FOR AN EFFECTIVE DATE. 7. Adopt a Resolution Authorizing the City Manager to Apply for, Accept, Reject, Alter, or Terminate a North Central Texas Council of Governments Regional Solid Waste Program Grant for Implementation of a Pilot Recycling Program in Allen Station Park. RESOLUTION NO. 2859-9-09(R): A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ALLEN, COLLIN COUNTY, TEXAS, HEREINAFTER REFERRED TO AS "APPLICANT,' DESIGNATING CERTAIN OFFICIALS AS BEING RESPONSIBLE FOR, ACTING FOR, AND ON BEHALF OF THE "APPLICANT" IN DEALING WITH THE NORTH CENTRAL TEXAS COUNCIL OF GOVERNMENTS, HERINAFTER REFERRED TO AS "GRANTOR," FOR THE PURPOSE OF PARTICIPATING IN THE REGIONAL SOLID WASTE PROGRAM, HEREINAFTER REFERRED TO AS THE "PROGRAM'; CERTIFYING THAT THE "APPLICANT" IS ELIGIBLE TO RECEIVE PROGRAM ASSISTANCE; CERTIFYING THAT THE "APPLICANT" MATCHING SHARE IS READILY AVAILABLE; AND PROVIDING FOR AN EFFECTIVE DATE. 8. Adopt a Resolution Nominating Gary Rodenbaugh for Election to the Board of Directors for the Central Appraisal District of Collin County and Cast 129 Votes for Said Candidate. RESOLUTION NO. 2860-9-09(R): A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ALLEN, COLLIN COUNTY, TEXAS, PLACING IN NOMINATION THE NAME OF GARY RODENBAUGH FOR MEMBERSHIP ON THE BOARD OF DIRECTORS OF THE CENTRAL APPRAISAL DISTRICT OF COLLIN COUNTY; CASTING BALLOTS FOR THE BOARD OF ALLEN CITY COUNCIL REGULAR MEETING SEPTEMBER 22, 2009 PAGE DIRECTORS FOR THE CENTRAL APPRAISAL DISTRICT OF COLLIN COUNTY IN ACCORDANCE WITH SECTION 6.03(g) OF THE STATE PROPERTY TAX CODE; DIRECTING THE CITY SECRETARY TO NOTIFY INTERESTED PARTIES OF SAID ACTION; AND PROVIDING AN EFFECTIVE DATE. 9. Adopt a Resolution Designating The Allen American as the Official Newspaper of the City of Allen. RESOLUTION NO. 2861-9-09(R): A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ALLEN, COLLIN COUNTY, TEXAS, DESIGNATING THE ALLEN AMERICAN THE OFFICIAL NEWSPAPER OF THE CITY OF ALLEN, COLLIN COUNTY, TEXAS, FOR FISCAL YEAR 2009-2010; AUTHORIZING THE CITY MANAGER TO CONTRACT WITH THE ALLEN AMERICAN; AND PROVIDING AN EFFECTIVE DATE. 10. Approval of the Recommendations from the Tax Increment Financing (TIF) Reinvestment Zone #1 (Garden District) Board of Directors Relating to Payments from the TIF Fund. IL Authorize the City Manager to Award and Execute a Contract with Saber Development in the Amount of $155,177 for the Construction of the Greenville Avenue Water Line Replacement Project and Establish a Project Budget of $300,000. 12. Authorize the City Manager to Award and Execute a Contract with Jim Bowman Construction, LP in the Amount of $439,636.50, for the Construction of the East Main Street Water Line Project and Establish a Project Budget of $600,000. 13. Authorize the City Manager to Execute a Two -Year Contract, with an Option to Renew for Three One -Year Periods, with GT Distributors of Austin, Texas, to Purchase Police Equipment and Tactical Supplies in an Amount Not to Exceed $36,510 for the First Year and $25,000 for the Second Year of the Initial Term and Any Subsequent Renewals. 14. Set Saturday, January 30, 2010, as the Date for the Strategic Planning Session with City Council and Executive Staff. 15. Receive the Capital Improvement Program Status Report. 16. Receive the Summary of Property Tax Collections as of July 2009. The motion carried. Reeular Aeenda 17. Conduct a Public Hearing and Adopt an Ordinance to Amend the Future Land Use Plan of the 2002-2022 Comprehensive Plan. Mayor Terrell opened the Public Hearing and asked for anyone speaking either for or against the request to do so. Barry Knight, 5400 Renaissance Tower, Dallas, Texas, spoke in opposition to the item on behalf of the Petefish family. ALLEN CITY COUNCIL REGULAR MEETING SEPTEMBER 22, 2009 PAGE 4 Ell Virginia Petefish Lea, 1226 Cherokee Drive, Richardson, Texas, did not speak but wished her opposition to the item be recorded. With no one else speaking, Mayor Terrell closed the Public Hearing. ORDINANCE NO. 2862-9-09: AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF ALLEN, COLLIN COUNTY, TEXAS, AMENDING ORDINANCE NO. 2145-3-03; ADOPTING THE 2002-2022 COMPREHESIVE PLAN BY AMENDING THE FUTURE LAND USE PLAN; PROVIDING FOR A SEVERABILITY CLAUSE; PROVIDING FOR A REPEALING CLAUSE; AND PROVIDING FOR AN EFFECTIVE DATE. MOTION: Upon a motion made by Councilmember Caplinger and a second by Councilmember Sedlacek, the Council voted six (6) for and one (I) opposed with Councilmember Herald casting the negative vote, to adopt Ordinance No 2862-9-09, as previously captioned, amending the Future Land Use Plan of the 2002-2022 Comprehensive Plan. The motion carried. Council commended the Planning and Zoning Commission and City staff for their work on this item. Mayor Terrell moved to Agenda Item 19 Other Business 19. Calendar. The Regular Meeting was recessed at 8:08 p.m. Executive Session In accordance with the Texas Government Code, the Allen City Council reconvened into Executive Session at 8:15 p.m. on Tuesday, September 22, 2009, in the Council Conference Room, 305 Century Parkway, Allen, Texas, in order to continue discussing matters pertaining to: • Personnel —Pursuant to Section 551.074 of the Texas Government Code Discuss Appointments to Arts of Collin County Commission, Board of Adjustment, Building and Standards Commission, Community Development Corporation, Economic Development Corporation, and Planning and Zoning Commission The Executive Session adjourned at 9:25 p.m. on Tuesday, September 22, 2009 21.
