Exchange Parkway, Allen, Texas, requested the City Council consider providing a facility to house a boxing program for ages 8 and up. Council requested Mr. Vargas meet with Mr. Jimenez to discuss. Presentation of a Proclamation by the Office of the Mayor: • Presentation of a Proclamation to Amanda Minsky Proclaiming September 2010 as Forever Angels Pageant Month. MOTION: Upon a motion made by Councilmember Obermeyer and a second by Councdmember Herald, the Council voted seven (7) for and none (0) opposed to adopt the items on the Consent Agenda as follows. 3. Approve Minutes of the August 13-15, 2010, Budget Workshop. 4. Approve Minutes of the August 10, 2010, Regular Meeting. 5. Adopt an Ordinance Amending the Code of Ordinances, Chapter 6, 'Health and Environment', In Order to Establish the Environmental Health Code. ORDINANCE NO. 2940-8-10: AN ORDINANCE OF THE CITY OF ALLEN, TEXAS, REPEALING CITY OF ALLEN ORDINANCE NUMBER 1569-1-98 "ENVIRONMENTAL HEALTH ORDINANCE", IN ITS ENTIRETY, AMENDING CHAPTER 6 OF THE CODE OF ORDINANCES, CITY OF ALLEN, TEXAS, BY ADDING ARTICLE VIII, "ENVIRONMENTAL HEALTH"; ESTABLISHING A FEE SCHEDULE; PROVIDING A REPEALER CLAUSE, PROVIDING A SEVERABILITY CLAUSE; PROVIDING A SAVINGS CLAUSE; PROVIDING A PENALTY OF FINE NOT TO EXCEED $2000.00; PROVIDING A PUBLICATION CLAUSE; AND PROVIDING AN EFFECTIVE DATE. 6. ORDINANCE NO. 2941-8-10: AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF ALLEN, COLLIN COUNTY, TEXAS, ABANDONING ALL RIGHT, TITLE AND INTEREST IN COUNTY ROAD 149 BETWEEN RIDGEVIEW DRIVE AND ABANDONED COUNTY ROAD 150 (VOLUME 6075, PAGE 4231 IN THE REAL PROPERTY RECORDS OF COLLIN COUNTY) AND BEING MORE PARTICULARLY DESCRIBED IN EXHIBIT "A" ATTACHED HERETO; PROVIDING FOR THE FURNISHING OF A CERTIFIED COPY OF THIS ORDINANCE FOR RECORDING IN THE REAL PROPERTY RECORDS OF COLLIN COUNTY, TEXAS, AS A QUITCLAIM DEED; PROVIDING FOR THE INDEMNIFICATION OF THE CITY OF ALLEN, TEXAS, AGAINST DAMAGES ARISING OUT OF THE ABANDONMENT, AUTHORIZING THE CITY MANAGER TO EXECUTE ANY DOCUMENTS NECESSARY TO COMPLETE ABANDONMENT, AND PROVIDING FOR AN EFFECTIVE DATE. 7. ALLEN CITY COUNCIL REGULAR MEETING AUGUST 24, 2010 PAGE ORDINANCE NO. 2942-8-10: AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF ALLEN, COLLIN COUNTY, TEXAS, ADOPTING SUPPLEMENT NO, 6 TO THE ALLEN LAND DEVELOPMENT CODE; PROVIDING FOR THE PRINTING THEREOF, AUTHENTICATION BY THE MAYOR AND ATTESTATION BY THE CITY SECRETARY; PROVIDING A REPEAL OF CERTAIN ORDINANCES, PROVIDING EXCEPTIONS TO REPEAL, PROVIDING A PENALTY FOR SUCH VIOLATION THEREOF; AND PROVIDING AN EFFECTIVE DATE. Approve the Proposed Location for the Watters Creek at Montgomery Farm LED Pylon Sign. Receive the Summary of Property Tax Collections as of July 2010. 10. Receive the Capital Improvement Program (CIP) Status Reports. The motion carried. IL Public Hearing on the Budget as Required by Article IV, Section 4.04 of the Allen City Charter. Mayor Terrell opened the public hearing and asked anyone wishing to speak for or against this item to do so at this time. �.j With no one speaking, Mayor Terrell closed the public hearing. Mayor Terrell announced that the City Council will vote on the budget at the September 14, 2010, City Council meeting at 7:00 p.m. at Allen City Hall, 305 Century Parkway, Allen, Texas 12. Public Hearing Regarding the Fiscal Year 2010-2011 City Tax Rate. Mayor Terrell opened the public hearing and asked anyone wishing to speak for or against this item to do so at this time. With no one speaking, Mayor Terrell closed the public hearing. MOTION: Upon a motion made by Councilmember Sedlacek and a second by Mayor Pro Tem Stout, the Council voted seven (7) for and none (0) opposed to set the City Council meeting date of September 14, 2010, at 7 00 p.m. at Allen City Hall, 305 Century Parkway, Allen, Texas, to vote on the proposed tax rate of 55.4 cents per $100 of the certified appraised value for the Fiscal Year 2010-2011 budget The motion carried 13. Approve a Resolution to Amend Environmental Health Permit and Inspection Fees for Food Service, Child Care, and Public and Semi -Public Swimming Pools. RESOLUTION NO. 2943-8-10(R): A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ALLEN, COLLIN COUNTY, TEXAS, ESTABLISHING PERMIT, INSPECTION, AND ADMINISTRATIVE FEES RELATED TO THE CITY OF ALLEN ENVIRONMENTAL HEALTH ORDINANCE; AND PROVIDING FOR AN EFFECTIVE DATE. ALLEN CITY COUNCIL REGULAR MEETING AUGUST 24, 2010 PAGE 4 MOTION: Upon a motion made by Mayor Pro Tem Stout and a second by Councilmember Obermeyer, the Council voted seven (7) for and none (0) opposed to approve Resolution No. 2943-8- 10(R), as previously captioned, to amend the Environmental Health Permit and Inspection fees for food service, child care, and public and semi-public swimming pools The motion carried. 14. Calendar. September 14—City Council will adopt the FY 2010-2011 Annual Budget. September 14 — City Council will set the FY 2010-2011 City Tax Rate. 15. Items of Interest. Council wished happy birthday to Mayor Terrell, Councilmember Obermeyer, Mr. Smith, and Councilmember Herald's children, Jackie and Darlyn. Council recognized Boy Scouts in attendance from Troop Nos. 285, 334, and 1334 as a requirement for eaming the citizenship in the community merit badge The Allen Community Outreach will host its Annual Golf Tournament on September 20, 2010. Executive Session The Executive Session was not held. 16. Reconvene and Consider Action on Items Discusses during Executive Session. MOTION: Upon a motion made by Mayor Pro Tem Stout and a second by Councilmember Herald, the Council voted seven (7) for and none (0) opposed to adjourn the Regular Meeting of the Allen City Council at 7:37 p an on Tuesday, August 24, 2010.
