With a quorum of the Councilmembers present, the Workshop Session of the Allen City Council was called to
order by Mayor Terrell at 6:24 p.m. on Tuesday, May 10, 2011, in the Council Conference Room of the Allen
City Hall, 305 Century Parkway, Allen, Texas.

With a quorum of the Councilmembers present, the Regular Meeting of the Allen City Council was called to
order by Mayor Terrell at 7:05 p.m. on Tuesday, May 10, 2011, in the Council Chambers of the Allen City
Hall, 305 Century Parkway, Allen, Texas.

Services Department Proclaiming May 16-22, 2011, as "Public Works Week."
• Presentation of a Proclamation to the American Cancer Society Relay For Life of Allen Committee
Proclaiming May 8-14, 2011, as "Relay For Life Week. "
3. Presentation of a Check Indicating 'Volunteer Hours to the Community' by Dale
Howard, President of the Allen Retired Educators' Association (AREA)
4. Annual Report by Greg Roemer, President, and Robert Medigovich, Municipal Coordinator for
Community Waste Disposal, Inc. (CWD).
Consent Aeenda
MOTION: Upon a motion made by Councilmember Obermeyer and a second by Councilmember
Herald, the Council voted seven (7) for and none (0) opposed to adopt the items on the
Consent Agenda as follows:
5. Approve Minutes of the April 26, 2011, Regular Meeting.
6. Adopt a Resolution Authorizing the City Manager to Execute an Agreement with the State of
Texas to Accept the Tobacco Compliance Grant, if Awarded.
RESOLUTION NO. 3001 A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF ALLEN, COLLIN COUNTY, TEXAS, AUTHORIZING AN AGREEMENT WITH THE
STATE OF TEXAS, TO ACCEPT THE TOBACCO COMPLIANCE GRANT AWARD, IF
AWARDED; AND PROVIDING FOR AN EFFECTIVE DATE.
7. Authorize the City Manager to Negotiate and Execute an Event License Agreement Between the
City of Allen and Sunjack Football, LLC.
8. Authorize the City Manager to Execute a Right -of -Way Dedication Agreement with David M.
Lebow, Trustee of the Simon Lebow Trust B, for Chelsea Boulevard.
9. Authorize the City Manager to Execute a Professional Service Contract with Birkhoff,
Hendricks & Conway, L.L.P. (BH&C) in the Amount of $135,740 for the Design of the US 75
Water Line Rehabilitation Project, Phase 2 and Establish an Initial Project Budget in the
Amount of $1759000.
10. Award Bid and Execute a Contract with Signature Towing, Inc. for Wrecker and Impound
Services for Consent and Non -Consent Tows for the Allen Police Department.
11. Receive Financial Report for Period Ending March 31, 2011.
12. Receive Investment Report for the Period Ending March 31, 2011.

13. Adopt a Resolution Establishing New Rates and Fees for Wrecker and Impound Services for
Consent and Non -Consent Tows for the Allen Police Department.
RESOLUTION NO. 3008-5-11tR): A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF ALLEN, COLLIN COUNTY, TEXAS, ESTABLISHING TOWING AND STORAGE FEES,
PROVIDING A REPEALING CLAUSE; AND PROVIDING AN EFFECTIVE DATE.
MOTION: Upon a motion made by Councilmember Sedlacek and a second by Councilmember
Caplinger, the Council voted seven (7) for and none (0) opposed to adopt Resolution No.
3008-5-11, as previously captioned, establishing new rates and fees for wrecker and impound
services for consent and non -consent tows for the Allen Police Department. The motion
carried
14. Consider All Matters Incident and Related to the Issuance and Sale of "City of Allen, Texas,
General Obligation Refunding and Improvement Bonds, Series 2011," Including the Adoption
of an Ordinance Authorizing the Issuance of Such Bonds and Providing for the Redemption of
Certain Outstanding Obligations of the City Being Refunded.
ORDINANCE NO. 3009-5-11: AN ORDINANCE AUTHORIZING THE ISSUANCE OF "CITY
OF ALLEN, TEXAS, GENERAL OBLIGATION REFUNDING AND IMPROVEMENT BONDS,
SERIES 2011"; SPECIFYING THE TERMS AND FEATURES OF SAID BONDS; LEVYING A
CONTINUING DIRECT ANNUAL AD VALOREM TAX FOR THE PAYMENT OF SAID
BONDS, AND RESOLVING OTHER MATTERS INCIDENT AND RELATED TO THE
ISSUANCE, SALE, PAYMENT AND DELIVERY OF SAID BONDS, INCLUDING THE
APPROVAL AND EXECUTION OF A PAYING AGENT/REGISTRAR AGREEMENT, A BOND
PURCHASE AGREEMENT, AND A SPECIAL ESCROW AGREEMENT, AND THE APPROVAL
AND DISTRIBUTION OF AN OFFICIAL STATEMENT; PROVIDING FOR THE REDEMPTION
OF THE BONDS BEING REFUNDED; AND PROVIDING AN EFFECTIVE DATE.
MOTION: Upon a motion made by Mayor Pro Tem Stout and a second by Councilmember Obermeyer,
the Council voted seven (7) for and none (0) opposed to adopt Ordinance No. 3009-5-11, as
previously captioned, authorizing the issuance of $8,840,000 "City of Allen, Texas, General
Obligation Refunding and Improvement Bonds, Series 2011", providing for the redemption
of the bonds being refunded and approving and authorizing the execution of a Paying
Agent/Registrar Agreement, a Bond Purchase Agreement and an Escrow Agreement, and the
approval and distribution of an Official Statement in relation to such Bonds. The motion
carried

16. Items of Interest.
Council expressed congratulations to the Allen Americans for reaching the Finals in the CHL
Playoffs.

• Council recognized Boy Scouts from Troops 817 and 1167 in attendance as a requirement for
eaming a merit badge.
• Council wished Teresa Warren a happy birthday
Executive Session
The Executive Session was not held.
17. Reconvene and Consider Action on Items Discusses during Executive Session.
MOTION: Upon a motion made by Mayor Pro Tem Stout and a second by Councilmember Herald, the
Council voted seven (7) for and none (0) opposed to adjourn the Regular Meeting of the
Allen City Council at 7:58 p.m. on Tuesday, May 10, 2011 The motion carried.
