Consent Aeenda ® MOTION: Upon a motion made by Councilmember Obermeyer and a second by Councilmember Herald, the Council voted six (6) for and none (0) opposed to adopt the items on the Consent Agenda as follows: 6. Approve Minutes of the September 27, 2011, Regular Meeting. 7. Adopt a Resolution Nominating PFSweb Inc. to the Office of the Governor, Economic Development and Tourism as an Enterprise Zone Project. RESOLUTION NO. 3038-10-11lA): A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ALLEN, COLLIN COUNTY, TEXAS, APPROVING PFSWEB, INC., A TEXAS CORPORATION, TO THE OFFICE OF THE GOVERNOR, ECONOMIC DEVELOPMENT & TOURISM ("EDT") DIVISION THROUGH THE ECONOMIC DEVELOPMENT BANK ("BANK") AS AN ENTERPRISE PROJECT; AND PROVIDING FOR AN EFFECTIVE DATE 8. Authorize the City Manager to Approve the Purchase and Installation of Three Solar Powered Mixing Units from SolarBee, Inc. for $134,181 for the Rowlett, Prestige, and Bethany Water Towers and Establish a Project Budget in the Amount of $150,000. 9. Authorize the City Manager to Execute a Contract with Daktronics for $480,640 for the Construction, Installation and Enhancement of Video Boards at the Allen Event Center. The motion carried. Conduct a Public Hearing and Adopt an Ordinance Providing for the Taxation of Goods -in - Transit as Defined by Tax Code, Section 11.253. Mayor Terrell opened the public hearing and asked anyone wishing to speak for or against this item to do so at this time. With no one speaking, Mayor Terrell closed the public hearing. ORDINANCE NO. 3039-10-11: AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF ALLEN, COLLIN COUNTY, TEXAS, PROVIDING FOR THE TAXATION OF GOODS -IN - TRANSIT, PROVIDING A REPEALING CLAUSE; PROVIDING A SEVERABILITY CLAUSE; AND PROVIDING FOR AN EFFECTIVE DATE. MOTION: Upon a motion made by Councilmember Sedlacek and a second by Councilmember Caplinger, the Council voted six (6) for and none (0) opposed to adopt Ordinance No. 3039- 10-11, as previously captioned, providing for the taxation of goods -in -transit as defined by Tax Code, Section 11.253. Items of Interest • Council wished happy birthday to Councilmember Herald and City Manager Vargas. • Councilmember Obermeyer visited with Congressman Sam Johnson during his recent trip to Washington, D C The Regular Meeting was recessed at 7:52 p.m Executive Session In accordance with the Texas Government Code, the Allen City Council convened into Executive Session at 8.08 p.m. on Tuesday, October 11, 2011, to the Council Conference Room, 305 Century Parkway, Allen, Texas, in order to discuss matters pertaining to: 13. Personnel Pursuant to Section 551.074 of the Texas Government Code - Discussion of Duties of the Board of Directors of the Allen Economic Development Corporation. The Executive Session adjourned at 8:55 p.m. on Tuesday, October 11, 2011. 14. Reconvene and Consider Action on Items Discussed during Executive Session. The Allen City Council reconvened into the Regular Meeting at 8:56 p.m. on Tuesday, October 11, 2011.
