With a quorum of the Councilmembers present, the Workshop Session of the Allen City Council was called to
order by Mayor Terrell at 6:12 p.m. on Tuesday, October 25, 2011, in the Council Conference Room of the
Allen City Hall, 305 Century Parkway, Allen, Texas.

• Committee Updates from City Council Liaisons
With no further discussion, the Workshop Session of the Allen City Council was adjourned at 7:10 p.m. on
Tuesday, October 25, 2011.

With a quorum of the Councilmembers present, the Regular Meeting of the Allen City Council was called to
order by Mayor Terrell at 7:14 p.m. on Tuesday, October 25, 2011, in the Council Chambers of the Allen City
Hall, 305 Century Parkway, Allen, Testas.

Nancy Madson, 1002 Hawthorne Drive, Allen, Texas, spoke regarding the purchase of property by
the Islamic Association of Allen and her opposition to the future construction of a mosque on the site.
2. Recognition of the Local Texas Amateur Athletic Federation (Local T.A.A.F.) Athletes of the
Year.
Ashley Bassett - Local T.A.A.F Athlete of the Year and voted/selected by Region 7 as Region
Female Athlete of the Year
Andre Phillips - Local T.A.A.F Athlete of the Year
3. Recognition of Anne Gifford, Member of the "Allen Retired Teachers Association" and Past -
President of the Allen Heritage Guild, as the Recipient of a National Award by the American
Association of Retired Persons (AARP) for Developing a Second Grade Curriculum about
Allen's History and Implementing the Program with the Allen ISD Elementary Schools.
4. Presentation of a Proclamation by the Office of the Mayor:
• Presentation of a Proclamation to Donna Kliewer, Waste Services Manager, and Members of the
Keep Allen Beautiful Board Proclaiming November 5, 2011, as "Allen Recycles Day. "
5. Presentation of Information Regarding Declaration of Stage 3 of the Water Conservation and
�^ Drought Contingency/Emergency Plan.

MOTION: Upon a motion made by Councilmember Obermeyer and a second by Councilmember
Herald, the Council voted six (6) for and none (0) opposed to adopt the items on the Consent
Agenda as follows.
6. Approve Minutes of the October 11, 2011, Regular Meeting.
7. Motion to Set Saturday, February 4, 2012, as the Date for the Strategic Planning Session with
City Council and Executive Staff.
8. Adopt an Ordinance Amending the Code of Ordinances, Chapter 9- Motor Vehicles and
Traffic, Section 9-137(6), in Order to Modify the School Zone for Norton Elementary.
ORDINANCE NO. 3040-10-11[R): AN ORDINANCE OF THE CITY COUNCIL OF THE CITY
OF ALLEN, COLLIN COUNTY, TEXAS, AMENDING THE CODE OF ORDINANCES BY
AMENDING SECTION 9-137(b) OF THE CODE OF ORDINANCES TO DESIGNATE SEEPORT
DRIVE FROM 130 FEET SOUTH OF NEWPORT DRIVE TO MEFFORD LANE AND BRYAN
BOULEVARD FROM 150 FEET SOUTH OF NEWPORT DRIVE TO NEWPORT DRIVE AS
SCHOOL ZONES WITH A MAXIMUM PRIMA FACIE SPEED LIMIT OF TWENTY (20) MILES
PER HOUR; PROVIDING A REPEALING CLAUSE; PROVIDING A SAVINGS CLAUSE;
PROVIDING A SEVERABILITY CLAUSE; PROVIDING FOR A PENALTY OF FINE NOT TO
EXCEED THE SUM OF TWO HUNDRED DOLLARS ($200) FOR EACH OFFENSE; AND
PROVIDING FOR AN EFFECTIVE DATE.
9. Adopt a Resolution Ordering the December 13, 2011, Special Election to Fill a Vacancy in Place
No. 6 of the Allen City Council.

RESOLUTION NO. 3041-10-11(R): A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF ALLEN, COLLIN COUNTY, TEXAS, ORDERING A SPECIAL ELECTION TO BE HELD
ON DECEMBER 13, 2011, FOR THE PURPOSE OF ELECTING THE CITY COUNCILMEMBER
FOR PLACE NO. 6; DESIGNATING LOCATION OF POLLING PLACE; ORDERING NOTICES
OF ELECTION TO BE GIVEN AS PRESCRIBED BY LAW IN CONNECTION WITH SUCH
ELECTION; AND PROVIDING FOR AN EFFECTIVE DATE.
10. Adopt a Resolution Amending Fees for the Don Rodenbaugh Natatorium, Joe Farmer
Recreation Center, Allen Senior Recreation Center, Ford Pool and The Edge @ Allen Station
Park Visitor Center (The Edge Visitor Center).
RESOLUTION NO. 3042-10-11(R): A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF ALLEN, COLLIN COUNTY, TEXAS, ESTABLISHING FEES FOR CERTAIN PARKS AND
RECREATION PROGRAMS AND FACILITIES; PROVIDING A REPEALING CLAUSE; AND
PROVIDING AN EFFECTIVE DATE.
11. Adopt a Resolution Authorizing Acceptance of Funds in the Amount of $85,763 from the Collin
County Parks and Open Space Funding Assistance Program toward the Design of Cottonwood
Creek Hike & Bike Trail and Authorizing the City Manager to Execute an Interlocal
Agreement with Collin County for the Purpose of Designing Quality Parks and Recreational
Facilities.
RESOLUTION NO. 3043-10-11(R): A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
ALLEN, COLLIN COUNTY, TEXAS, HEREINAFTER REFERRED TO AS "APPLICANT,"
DESIGNATING CERTAIN OFFICIALS AS BEING RESPONSIBLE FOR, ACTING FOR, AND ON
BEHALF OF THE "APPLICANT" IN DEALING WITH COLLIN COUNTY, APPROVING THE
TERMS AND CONDITIONS OF THE INTERLOCAL FUNDING ASSISTANCE AGREEMENT;
AUTHORIZING ITS EXECUTION BY THE CITY MANAGER; REPEALING ALL RESOLUTIONS
IN CONFLICT, PROVIDING A SEVERABILITY CLAUSE; AND PROVIDING AN EFFECTIVE
DATE.
12. Authorize the City Manager to Execute a License and Facilities Agreement with Ashton Dallas
Residential, L.L.C. and `The Preserve' in Allen Homeowners Association, Inc. Related to `The
Preserve'.
13. Receive the Summary of Property Tax Collections as of September 2011.
14. Receive the Capital Improvement Program (CB') Status Report.
The motion carried.
15. Conduct a Public Hearing and Adopt an Ordinance Creating Planned Development PD 108 to
Allow for Multi -family, Single-family, Senior Living, Mixed-use, Office and Retail Uses on
Property Consisting of Seven Areas Totaling 326± Acres, Generally Located on the North and
South Sides of Exchange Parkway, West of US 75 and East of Watters Creek. ]Twin Creeks

Mayor Terrell opened the public hearing and asked anyone wishing to speak for or against this item to
do so at this time.
Charles Niece, 813 Glen Rose Drive, Allen, Texas, spoke in support of this item.
Peter Longo, 999 Raintree Circle, Allen, Texas, spoke in support of this item.
Barry Metcalf, 505 Pecan Street, Ste. 101, Fort Worth, Texas, spoke in support of this item
Becky Clow, 714 Ridgemont Drive, Allen, Texas, did not wish to speak, but expressed her support of
this item.
With no one else speaking, Mayor Terrell closed the public hearing.
ORDINANCE NO. 3044-10-11: AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
ALLEN, COLLIN COUNTY, TEXAS, AMENDING THE ALLEN LAND DEVELOPMENT CODE
ZONING REGULATIONS AND ZONING MAP, AS PREVIOUSLY AMENDED, BY CHANGING
THE ZONING FROM PLANNED DEVELOPMENT "PD" NO. 54 TO PLANNED DEVELOPMENT
"PD" NO. 108 FOR MULTI -FAMILY, SINGLE-FAMILY, SENIOR LIVING, MIXED-USE, OFFICE
AND RETAIL USES; ADOPTING DEVELOPMENT REGULATIONS FOR SEVEN AREAS OF
LAND COMPRISING 326.Of ACRES OUT OF THE CATHERINE PARSONS SURVEY,
ABSTRACT NO. 711, THE MICHAEL SEE SURVEY, ABSTRACT NO. 544, THE JOHN FYKE
SURVEY, ABSTRACT NO. 325, THE AB PERRIN SURVEY, ABSTRACT NO. 713, AND THE W.J.
JACKSON SURVEY, ABSTRACT NO. 484, COLLIN COUNTY, TEXAS, DESCRIBED IN

MOTION: Upon a motion made by Councilmember Sedlacek and a second by Councilmember
Caplinger, the Council voted six (6) for and none (0) opposed to adopt Ordinance No. 3044-
10-11, as previously captioned, creating Planned Development PD 108 to allow for Multi-
family, Single-family, Senior Living, Mixed-use, Office and Retail Uses. The motion
carried.
