Consent Anenda MOTION: Upon a motion made by Councilmember Herald and a second by Councilmember Sedlacek, the Council voted seven (7) for and none (0) opposed to adopt the items on the Consent Agenda as follows. 5. Approve Minutes of the February 26, 2013, Regular Meeting. 6. Approve Minutes of the February 25, 2013, Special Called Joint Meeting with the Allen Economic Development Corporation Board of Directors. 7. Adopt an Ordinance Canceling the May 11, 2013, General Election. ORDINANCE NO. 3143-3-13: AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF ALLEN, COLLIN COUNTY, TEXAS, CANCELING THE ELECTION SCHEDULED TO BE HELD MAY 1l, 2013, FOR THE PURPOSE OF ELECTING THE CITY COUNCILMEMBER FOR PLACE NO. 4 AND 6; DECLARING EACH UNOPPOSED CANDIDATE ELECTED TO OFFICE; ORDERING THE POSTING OF THIS ORDINANCE AT CITY HALL AND AT THE MUNICIPAL COURT AND PARKS ADMINISTRATION BUILDING POLLING PLACE ON ELECTION DAY, PROVIDING A SEVERABILITY CLAUSE, AND DECLARING AN EFFECTIVE DATE 8. Authorize the City Manager to Execute the North Texas Public Works Mutual Aid Agreement with Participating North Central Texas Local Governments and any Public/Political Sub - Division within the State of Texas. 9. Authorize the City Manager to Purchase Carpet from Gomez Floor Covering, Inc., for the Allen Public Library and Municipal Court/Parks & Recreation Community Room Carpet Replacement Project Through the Purchasing Cooperative (Buy Board) in the Amount of $102,546.73. 10. Authorize the City Manager to Execute a Purchase and Sales Agreement with Allen Independent School District in the Amount of $223,482.40 for the Sale of 3.4203 Acres of Land. Il. Award Bid and Authorize the City Manager to Execute a Contract with XIT Paving & Construction, Inc. for an Amount Not to Exceed $654,236.96 for the Construction of Ridgeview Drive, Phase 1, from Watters Road to Stacy Road, and Amend the Project Budget to $1,470,000. Award Bid and Authorize the City Manager to Execute a Contract with All Around Lawn Care, Inc. for an Amount Not to Exceed $312,583.46 for the Construction of Hillside Park and Establish a Project Budget of $433,958.30. Conduct a Public Hearing and Adopt an Ordinance to Amend the Development Regulations to Increase the Number of Special Events Allowed and Adopt a Temporary Use and Special Event Location Map for Planned Development No. 99 for Watters Creek at Montgomery Farm. Mayor Terrell opened the public hearing and asked anyone wishing to speak for or against this item to do so at this time. With no one speaking, Mayor Terrell closed the public hearing. ORDINANCE NO. 3144-3-13: AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF ALLEN, COLLIN COUNTY, TEXAS, AMENDING THE ALLEN LAND DEVELOPMENT CODE, ZONING REGULATIONS AND ZONING MAP, AS PREVIOUSLY AMENDED, BY AMENDING "PD" PLANNED DEVELOPMENT NO. 99 (PD -99), BY AMENDING EXHIBIT "C" "DEVELOPMENT STANDARDS" BY ADDING A NEW SECTION C TITLED "TEMPORARY USES/SPECIAL EVENTS" RELATING TO THE REGULATION AND LOCATION OF CERTAIN TEMPORARY USES AND SPECIAL EVENTS WITHIN PD -99 AND ADDING A NEW EXHIBIT "G" TITLED "TEMPORARY USE AND SPECIAL EVENT LOCATION MAP"; PROVIDING A CONFLICTS RESOLUTION CLAUSE; PROVIDING A SAVINGS CLAUSE; PROVIDING A SEVERABILITY CLAUSE, PROVIDING A PENALTY OF FINE NOT TO EXCEED $2000.OQ AND PROVIDING FOR AN EFFECTIVE DATE. MOTION: Upon a motion made by Councilmember Obermeyer and a second by Councilmember Kizer, the Council voted seven (7) for and none (0) opposed to Adopt Ordinance No. 3144-3-13, as previously captioned, to amend the Development Regulations to increase the number of special events allowed and adopt a Temporary Use and Special Event Location Map for Planned Development No. 99 for Watters Creek at Montgomery Farm. Items of Interest. • Councilmember Sedlacek announced that the Allen Event Center would be hosting the National Collegiate Wrestling Championships March 14-16. • Councilmember Kizer announced the ACO Winemasters event on March 22. Executive Session The Executive Session was not held.
