The regular meeting of the Allen Planning & Zoning
Commission was called to order by Chairman Pendleton at
7:30 p.m. on Thursday, July 22, 1982, at Rountree Elemen-
tary School, 800 E. Main Street.
Approval of Minutes:
July 8, 1982
(Agenda Item II)
MOTION: Upon a motion by Commissioner Koch and second
by Commissioner Larsen, the Commission voted
six (6) for and none (0) opposed to accept
the minutes as presented. The motion carried.
Public Hearing - On Site Plan
Approval by Gulf Oil Corporation
for Development of .99 Acre
Tract at FM 2170 and Hwy 5 (Agenda Item III)
Chairman Pendleton read the request into the record
as follows:
"Public Hearing - On site plan approval by Gulf Oil
Corporation for development of a .99 acre tract, being
part of the Molsen Addition, as described in a deed

from Homer L. Adams to H. Molsen and Company, recorded
in Volume 639, Page 344, Deed Records, Collin County,
Texas, and lying within the Wm. Perrin Survey, Abstract
#708, further described as being Lot 2, Molsen Addition,
and at the southwest corner of F.M. 2170 and U.S.
Highway 75. (Zoning Case No. Z6-18-82-14)"
Frank Musterman, real estate representative for Gulf
Oil Corporation, presented the request and answered some
questions asked by the Commission.
Some of the questions asked and concerns expressed
by the Commission included ingress -egress at the service
station, landscaping, existing utilities, whether there
would be retail sales in the station, and right-of-ways
on the access road.
Chairman Pendleton opened the Public Hearing.
No one appeared to speak either for or against the
request.
Chairman Pendleton closed the Public Hearing.
MOTION: Upon a motion by Commissioner Wolfe and second
by Commissioner Koch, the Commission voted six
(6) for and none (0) opposed to recommend
approval to the City Council this item as
submitted. The motion carried.
Public Hearing - On a Request
from Charles Mitchell for a
Zoning Change on 203A E. Main
from LR to GB (Agenda Item IV)
Chairman Pendleton read the request into the record
as follows:
"Public Hearing - On a request from Charles Mitchell
for a zoning change from LR (Local Retail) to GB
(General Business) on property located at 203A
E. Main Street. Further described as being Lots 3B
and 4B, Block 15, of the Original Donation to the
City of Allen. (Zoning Case No. Z6-16-82-13)"
(' Geri and Jack Clare, of Plano Glass and Mirror
■■L Company, came before the Commission and asked that the
request be granted.
Bill Petty, Building Official, gave the Commission
the zoning background on this particular piece of property.

Public Hearing - On a Request
for Zoning Change on 203A E.
Main from LR to GB (Cont.)
Chairman Pendleton opened the Public Hearing.
On one appeared to speak either for or against the
request.
Chairman Pendleton read two letters opposing the
request into the record. One letter being from Don
Brazeal Insurance and the other from Dick Senter, Pastor,
First Baptist Church (copies attached).
Chairman Pendleton closed the Public Hearing.
Some concerns discussed by the Commission included
why a glass company could not be located in a LR district;
what adjacent property owners thought of the rezoning;
what business could locate on the site if the zoning were
changed to GB and the glass company folded. There was
also some discussion on the zoning in the downtown area
as a whole.
The Commission also discussed the possibility of
alternate ways of allowing the glass company to locate in
the LR district.
Commissioner Wolfe read some Commission findings
into the record as follows:
1. There are seven other areas in the city zoned
General Business.
2. Such a change would result in spot zoning of
General Business in a Local Retail district.
3. Rezoning was requested due to the nature of the
structure, not in accordance with the zoning practice.
MOTION: Upon a motion by Commissioner Wolfe and second
by Commissioner Glass, the Commission voted six
(6) for and none (0) opposed to deny the request
for zoning change as requested by this agenda
item due to the fact that such a change would
be inconsistent with the established criteria
for zoning change in the Comprehensive Zoning
Ordinance. The motion carried.
General Discussion:
The Commission discussed the possibility of initiating
an amendment to the Comprehensive Zoning Ordinance to
include specific use permit in the Local Retail district
for auto glass business.

There was some discussion on whether the Commission
wanted to adopt the update to Planning District 4, as
revised by Frank Osgood Associates, as part of the Compre-
hensive Plan. The Commission asked that this item be
placed on the next agenda for action.
Adjournment:
MOTION: Upon a motion by Commissioner Wolfe and second
by Commissioner Koch, the Commission voted six
(6) for and none (0) opposed to adjourn the
Regular Meeting of the Allen Planning and
Zoning Commission at 9:00 p.m.
