CALL TO ORDER:
The Allen Planning & Zoning Commission was called to order at 7:30 p.m. by
Chairman Armand at the Allen Municipal Annex, City Council Chambers, One
Butler Circle, Allen, Texas.
Approve Minutes
October 27, 1988

Acting Chairman Lee read the agenda item into the record as follows:
"Approve minutes of October 27, 1988, Regular meeting.
MOTION: Upon a motion by Commissioner Garcia and a second by Commissioner
Fulk, the Commission voted 4 FOR and 0 OPPOSED to approve the
minutes of October 27. 1988.

Acting Chairman Lee read the agenda item into the record as follows:
"Public Hearing - Consider a request by Don. A. Tipton, Inc. for Bass
Development Company to amend Exhibit D in Planned Development No. 12
to allow an extension of time for the construction schedule on certain
thoroughfares. This is a tract of land situated in the Simon Burns Survey,
Abstract No. 255, in Collin County, Texas, and being the same property
conveyed to the Trustees of E-Systems, Inc. , Pool Trust by deeds recorded
in Volume 1263, Page 891, and Volume 1263, Page 895, of the Deed Records
of Collin County, Texas; more particularly described as being south of F.M.
2170 and east of Hillside Drive."
Mr. Don Bass, Dallas, Texas, made the presentation to the Commission. The text
of his presentation is attached hereto and made a part hereof. He stated that the
request is to delay the requirement for construction of the roadways for a period
of three years. September 19, 1991, would be the deadline.
Mr Bill Petty discussed the proposal and the original construction requirements.
If the property develops before the time limit expires, Mr. Bass must begin the
roadway construction at that time.
Acting Chairman Lee opened the public hearing.
With no one wishing to speak for or against the request, Acting Chairman Lee
closed the public hearing.
Commissioner Garcia discussed the original zoning on this property and the land
uses involved. He noted that there is no change in the land uses.
Commissioner Fulk stated he understands the need for the extension, but was
concerned with the length of three years. Mr. Bass stated the three years was
requested because of the economic conditions at this time.
Commissioner Biggs stated that this was an appropriate request. Commissioner
Owen stated the request is reasonable.
MOTION: Upon a motion by Commissioner Biggs and a second by Commissioner
Owen, the Commission voted 5 FOR and 0 OPPOSED to approve the
request for amendment to Exhibit "D" of Planned Development No. 12
to extend the time for the construction on certain thoroughfares.

The following findings were read into the record:
1. No changes were requested in the land use.
2. This is unique development where specific timeframes are connected to
offsite construction.
3. Although time frames are placed on the construction of roadways, the area
is not going to develop until the market conditions are appropriate.
At this time the Commission adjourned to workshop session.
Workshop Session
Subdivision Subdivision Relations Review (Agenda Item IV)
Mr. Petty suggested the workshop sessions that are scheduled for November 16
and November 30, 1988, be postponed because of the fact that staff requires more
time to research and prepare the text of the ordinance.
The consensus of the Commission was to eliminate the workshops that are
scheduled for November 16 and 30, 1988.
Mr. Petty presented the Table of Contents and the text of Article 100 for the
Commission's review. The following suggestions were made:
1. It was discussed whether Purpose or Title should appear first in the
ordinance, and the consensus was that Purpose should appear first to
establish the reason for the document before giving it a title.
2. Consideration should be given to further referencing the "Comprehensive
Plan."
3. Section 103.03 - the reference to "City Council approval" should be
removed.
4. Section 103.07 - the reference to "City Council approval" should be
removed.
5. Section 105.01 - the reference to "City Council approval" should be
removed.

6. Section 105.01 - text should be added stating that the final plat should be
filed with City Staff for filing with the County Clerk.
7. Definition for "easement' in Section 105.08 should be used and 105.21 should
be eliminated.
8. Section 105.29 - consideration should be given to the definition of "street
width" to clarify what is actually being defined... the pavement or the right-
of-way. Possibly add a definition for right-of-way.
9. Consider adding a definition for "VARCS," "TIF."
The consensus of the Commission was to accept the proposed text with the
modifications delineated above. The next agenda should include the text of Article
200, Flood Plain, and Article 300, Procedures.

MOTION: Upon a motion by Commissioner Garcia and a second by Commissioner
Biggs, the Commission voted 5 FOR and 0 OPPOSED to adjourn the
November 10, 1988 meeting of the Allen Planning & Zoning Commission
at 8:50 P.M.

PROPOSAL TO ALLEN P & Z - November 10, 1988
PD 786-3-87 - Shadow Lakes
In the early part of 1987 when we proposed and agreed to the obligations and
commitments of the zoning ordinance under consideration, we were comfortable
with the economy, the market conditions in Allen, and also the reception and
interest expressed by the type of users that would be necessary for us to
attract in order to move ahead with a construction program on the site.
Unfortunately, over the past 12 - 18 months, severe economic conditions
have affected almost all types of business and more especially real estate
development. Under the existing circumstances, it became obvious to us that
it would be impossible to meet the requirements for commencing construction
on the various roadway agreements, etc. During this period of time,
Esurvival for most real estate developers was about a full time job. We
advised the Staff in April that we would be unable to meet the schedule.
Conversations with staff members since that time indicated that a revision
of the construction schedules would require action by the zoning bodies.
Although conditions and circumstances have changed rather dramatically, we
believe that these conditions will adjust and improve with the passage of
time and overall economic recovery.
It remains our
opinion that the
zoning uses
and provisions
of the PD are
the
best possible
alternatives for
the City,
the property
and the owners.
Therefore, we
are requesting
an amendment
to the PD ordinance
to allow
for
the additional
time needed to
comply with
the development
requirements
of
the ordinance.
We ask for your
favorable consideration of
this matter.
