CALL TO ORDER:
The Allen Planning & Zoning Commission was called to order at 7:30 p.m. p.m. by
Chairman Armand at the Allen Municipal Annex, City Council Chambers, One
Butler Circle, Allen, Texas.
Approve Minutes
February 22, 1990 (Agenda Item II)
Chairman Armand read the agenda item into the record as follows:
"Approve minutes of February 22, 1990, Regular meeting."
MOTION: Upon a motion by Board Member Biggs and a second by Board Member
Owen, the Board voted 7 FOR and 0 OPPOSED to approve the minutes
of the February 22, 1990, meeting, as presented.

Chairman Armand read the agenda item into the record as follows:
"Public Hearing - Consider a request for a Specific Use Permit for an auto
laundry with Site Plan approval on property fronting on S.H. 5 south of
Bethany Drive and north of Hightrail Drive. The request is being submitted
by Mr. Joe Barton King, representing Mr. Bill Davidson for the construction
of a self-service car wash. The property is located in the southern It acre
of a 4.2 -acre tract in the Rufus Sewell Survey, Abstract No. 875, City of
Allen, Collin County, Texas; further described as being located north of the
Christ the Servant Lutheran Church."
Mr. Joe Barton King presented the request to the Commission. He stated this site
is located in the southernmost portion of the 4 -acre tract which includes the
recently adopted Firestone site plan. This car wash includes 6 bays with a
customer service center. He stated that the Fire Marshal has agreed to the use
of the fire lane for stacking as long as the vehicles are attended.
The southern portion of the property is shown to be extensively landscaped to
screen the church site to the south.
The remainder of the property will become dedicated to the Lutheran Church at the
time of approval of this request, as well as engineering approval on the drainage
and sanitary sewer. A drying shed is located at the back of the property. Mr.
King stated that if the property owner is required to provide water and sewer from
Greenville to the rear of the property, they will allow an easement to do so, as
well as extend the fire lane.
The Commission discussed the need for directional signs to indicate entrance into
the bays from the north.
Commissioner Gallagher discussed a possible problem of traffic flow in the entrance
driveway. Mr. King stated the location of the drive was an effort to move it as
far from the church as possible.
Commissioner Owen questioned the use of vacuums at the entrance to the wash
bays. She felt it might cause traffic congestion as people are waiting to enter the
wash bays.
Commissioner Fulk discussed the amount of landscaping. Mr. King stated there
will be four large trees, some large shrubs, and a hedge row of photinia. All the
landscaping will be irrigated.
There was a discussion regarding a desire on the part of the Commissioners to
J reverse the wash bays to accommodate a better traffic pattern. Mr. King further
I indicated that the design was such as to encourage most of the activity to be on
the north of the property, away from the church.

Mr. Keener discussed the requirements of stacking lanes. The City of Allen does
not have a formal stacking lane policy. The proposed plan allows for a space in
the bay, with one stacking space at the entrance to each bay, as well as another
space which is located in the fire lane.
Mr. Keener discussed the need for platting this property, as well as the remainder
of the property to the east. If the eastern portion of the property is platted with
the church, then access will be through the church; otherwise it will come through
the car wash property, at which time staff will review a revised site plan. The
Zoning Ordinance does not specify the parking spaces for a car wash.
Commissioner Garcia stated he had a problem with the lack of any defined parking
spaces other than in the bays. Mr. King stated there are spaces available in the
drying shed, to the front of the property, and at the eastern edge of the bays.
The Commission agreed a parking space was needed at a location adjacent to the
drying sheds.
Commissioner Garcia discussed the problems with access to the eastern property.
This will be resolved at the time of platting.
The facility is designed for 24-hour service. A public access easement is being
provided to property located to the north.
Chairman Armand opened the public hearing.
Mr. Ron Kindler, Vice President for Christ the Servant Lutheran Church,
spoke in favor of the request. He provided a letter of endorsement from the
church.
Chairman Armand read into the record a letter from Mr. Richard Leach of
DLM, expressing his concern about the future of Allen. He did not express
a specific objection to this request.
Chairman Armand closed the public hearing. He further advised the Commission
that Mr. George Chrisman, a member of the Lutheran Church, had expressed
personal support for this proposal.
Commissioner Gallagher asked Mr. Kindler why the church was in support of this
proposal and Mr. Kindler stated that it was because the proponent has cooperated
with the church and has expressed an interest in the needs of the church.
Mr. Petty advised that staff was not of the understanding that the property to the
east was being "given" to the church as is implied by the earlier statement by Mr.
King referring to "dedication."

Mr. Petty explained that if the eastern property does not plat with the church,
then access must be provided through this property. Additionally, a public access
easement is being provided for all the properties from this one to the north to
the Firestone Store. He stated that this entry is not designed to be just for this
property, but is common to the property to the north. A traffic signage plan will
be considered at the time of construction.
Mr. Fulk asked whether the distance between the curb cut for this development
and the one for the church, which is 1201, was an appropriate distance. Mr.
Keener stated that the City does not have a specific policy at this time, but 90-
120' has been used in the past.
Further discussion was held regarding the fact that the stacking will be required
to be limited to the southern half of the 24' fire lane. It was suggested that
arrows could be used to direct the traffic.
The outside of the building will be lighted, as well as each bay. There are no
large overhead lights.
Mr. Keener advised that the preliminary engineering has been reviewed by the
Engineering Department.
Commissioner Garcia stated that he felt a car wash would be an appropriate use for
this property. Chairman Armand stated he was not comfortable with this use being
next to a church.
Commissioner Karlsruher stated that she agreed with the comments made by Mr.
Leach in his letter.
MOTION: A motion was made by Commissioner Biggs to approve the site plan and
Specific Use Permit with additional parking space, subject to City staff
approval regarding the necessary easements. With the lack of a
second, the motion died.
Upon a motion by Commissioner Biggs and a second by Commissioner
Karlsruher, the Commission voted 4 FOR and 3 OPPOSED to recommend
approval of the site plan and specific use permit with the requirement
of one additional parking space, subject to City staff approval
regarding the necessary easements. Commissioners Gallagher,
Karlsruher, and Garcia voted against the motion.

MAJORITY FINDINGS:
1. Acceptable use.
2. The church neighbors spoke in favor of the request.
3. Compatible with the properties immediately adjacent to the north.
4. Signage would be addressed at the time of construction to indicate proper
flow of traffic.
5. Access to the rear of the property would be addressed at the time of
platting.
6. Property dedication for expansion of S.H. 5 is being made.
7. Fire Marshal has approved the plan.
S. Landscaping is appropriate, and exceeds minimum standards.
9. The landscaping on the west will not interfere with the identification sign.
MINORITY FINDINGS:
1. From an ordinance standpoint, 2+1 stacking for the car wash should be
consistent and fire lanes should not be used.
2. The use is not necessarily consistent with the uses to the north because the
use immediately north has not been determined.
3. A car wash in this location may not be appropriate.
4. Mr. Leach's concerns are valid.
5. The traffic flow is a problem.

Chairman Armand read the agenda item into the record as follows:
"Public Hearing - Consider a request by Mr. Joe Barton King, representing
Mr. Mark Puckett and Mr. Ward Paxton to amend Planned Development -
Shopping Center No. 5 by amending the existing site plan and expand the
Specific Use Permit for a plant nursery. The property is located in Tract
8, Abstract 990, Peter Wetsel Survey; further described as being located at
811 E. Main, east of the Braum's Ice Cream store."
Mr. Keener presented the request to the Commission. He stated that the access
and fire lane easement to the north will be completed when the property to the east
is developed. The statement shown in the center of the site plan stating that
"fire lane location and installation to be completed at the time this lot is developed"
means that this fire lane will not be developed at this time. It will be required
when this property is completed for a more permanent use. However, if the
property to the east develops at any time, the northern easement will have to be
constructed.
Mr. Petty stated that the facility is intended only for tree storage at this time.
Mr. King stated that the additional property being considered at this time will
remain undeveloped and used only for tree storage and display. He stated that
the location of the center fire lane is not tied exactly to the location shown, but
might vary slightly at the time of development. Mr. King stated that the tree
storage in this area should not affect the parking needs for the site.
Commissioner Gallagher questioned the access for vehicles delivering the larger
trees, and Mr. King stated they will be delivered when the ground is dry.
Commissioner Gallagher further expressed a concern regarding trucks leaving that
portion of the property, through East Main Place, and leaving a trail of mud in
their drives.
Commissioner Fulk questioned whether the display area is only south of the fire
lane, or includes both sides of this center fire lane. Mr. King stated the request
includes the entire northern portion of the property.
Chairman Armand asked for clarification of the term "expanding" the Specific Use
Permit. Mr. Petty stated that this means to "expand" the area that is designated
on the Zoning Map as "S." A revised plat would be forthcoming if this action is
approved.
Chairman Armand opened the public hearing.

Commissioner Garcia questioned whether the designation of the two fire lanes
should be made more clear. Mr. Keener suggested wording such as "location and
installation to be completed at the time the lot contains permanent structures." It
was clarified that the area, if approved as presented, can only be used for tree
display and storage.
It was clarified that the property could be fenced if desired by the owner by
obtaining a fence permit.
Commissioner Fulk questioned the necessary parking spaces. He felt that this
additional area of display equates to a need for more parking spaces. The original
site plan required 18, and 23 were provided. The requirement is based on
building square feet, and does not consider outdoor display area.
Mr. Petty stated the parking requirement of the ordinance is based on the building
structure. Additional redevelopment in the northern portion of this property will
necessitate additional parking.
The proponent stated that the no lights are anticipated in this additional area of
the site plan. There are two flood lights on the corners of the storage shed. Mr.
Petty stated that the electrical code protects the neighboring property.
MOTION: Upon a motion by Commissioner Karlsruher and a second by
Commissioner Gallagher, the Commission voted 7 FOR and 0 OPPOSED
to recommend approval of the request.
FINDINGS:
The use is appropriate.
Fire Marshal has approved the plan.
Parking requirements were discussed and they are adequate because
additional use is outside storage.
Items of Interest
Chairman Armand reviewed with the Commission a letter received from Mrs.
Peabody regarding the landscaping on McDermott.
The Commissioners asked when the Subdivision Ordinance will be forthcoming and
Mr. Keener stated he did not know.
Chairman Armand reminded each Commissioner to make the assigned telephone calls
in connection with the Comprehensive Plan Update survey.

At a called special meeting of the congregation council
of Christ the Servant Lutheran Church on January 7, 1990
Mr. George Chrisman presented the proposal of Mr, Ed Whitehill
on behalf of Mr. Bill Davidson concerning the development
and use of the property immediately north of the Church
property for a six -bay "Auto Laundry." After careful
discussion the council unanimously adopted a motion
approving Mr. Davidsons proposal and authorized an officer
of the congregation to represent the Church at the public
hearing and to convey their action to the Planning and
Zoning commission.

SATURDAY I RETURNED TO ALLEN VIA BETHANY FROM CENTRAL AND AS I HAVE IN
MY YEARS OF LIVING IN ALLEN, SAW THE SAME FOUR OR FIVE STICKS - SO CALLED
CREPE MYRTLES - GRACE THE PARKWAY. THIS IS A DISGRACE TO ALLEN AND IT'S
MAYOR AND CITY COUNCIL, WHO THOUGHT TO MAKE ALLEN MORE BEAUTIFUL WAS TO
DECORATE FM 2170 WITH OUR TAX DOLLARS AND FORGET THE REST.
SPREAD THE TREES AROUND NOW BEFORE THEY START TO GROW. TO MAKE THINGS
WORSE, I UNDERSTAND WE HIRED AN OUT OF STATE LANDSCAPE COMPANY TO DO THE
WORK. THIS IS REALLY FOLLOWING OUR POLICY OF KEEPING BUSINESS AND MONEY
IN ALLEN. ALSO, WHAT DOES AN OUT OF STATE LANDSCAPE PERSON KNOW ABOUT
WHAT GROWS WELL 1N ALLEN, TEXAS^ -TREES ARE NOT SUPPOSED TO BE PLANTED
THAT CLOSE TOGETHER AND YOU ARE THE LAUGHING CONVERSATION IN ALLEN
T14ESE DAYS.
IT IS LIKE PUTTING YOUR LIFE IN JEOPARDY TO CROSS BUTLER FROM DOWNTOWN
TO GO EAST ON FM 2170. THE ADDED TREES, SHRUBS AND THE ADDED JOHNSON
GRASS GROWING IN THE MEDIAN STRIP THIS SUMMER WILL EVEN MAKE I1 WORSE.
LET US FACE IT, WE DON'T HAVE THE MAINTENANCE PERSONNEL_ TO KEEP ALL THIS
CLEAN, FLUS IT IS OVER PLANTED.
ON THE ENVIROMENTAL SITUATION, TAKE A LESSON FROM RICHARDSON, WHO HAS HAD
RECEPTACLES AT COI1 AND BELTLINE FOR OVER TEN YEARS FOR GLASS, CANS AND
PAPER. THEY USE THIS MONEY FOR TREES AND OTHER BEAUTIFUL THINGS.
MAYBE SOMEONE ON THE CITY COUNCIL. COULD MAKE A CALL TO FIND OUT HOW
PROFITABLE THIS IS FOR THEM.
WE ALLOW PEOPLE FROM OUTSIDE ALLEN 10 PICKUP OUR PAPERS AT THE DROP BOXES
OVER ALLEN AND MAKE MONEY ON THESE PAPERS. THE CITIZENS OF ALLEN HAVE
BEEN VERY GOOD WITH DEPOSITING THEIR PAPERS THERE. THESE OUTSIDE PEOPLE
EMPTY THE BOXES THREE OR FOUR 'TIMES A WEEK. WHY ARE WE SLEEPING IN
COUNCIL MEETINGS AND NOT MAKING THIS MONEY
