REGULAR MEETING

CALL TO ORDER:
The Allen Planning & Zoning Commission was called to order at 7:30 p.m. by
Chairman Karlsruher at the Allen Municipal Annex, City Council Chambers, One
Butler Circle, Allen, Texas.
Approve Minutes
September 13, 1990 (Agenda Item II)
Chairman Karlsruher read the agenda item into the record as follows:
"Approve minutes of September 13, 1990, Regular meeting."
MOTION: Upon a motion by Commissioner Biggs and a second by Commissioner
Nichols, the Commission voted 6 FOR and 0 OPPOSED to approve the
minutes of September 27, 1990, as presented.

Fina Oil & Chemical (U.S. 75/McDermott) (Agenda Item III)
Chairman Karlsruher read the agenda item into the record as follows:
"Public Hearing - Consider a request for a Specific Use Permit for a service
station and auto laundry in conjunction with a convenience store to be
located at the southeast corner of U.S. 75 and McDermott Drive (F. M.
2170) by Fina OH & Chemical Company. The property is located in the
William Perrin Survey, Abstract No. 708, Collin County, Texas, a tract of
land recorded in Volume 906, Page 165 of the Deed Records of Collin
County."
Mr. Keener presented the proposal to the Commission. He stated the request is
for a specific use permit for gasoline sales with a retail store and auto laundry as
incidental uses.
Mr. Sam McGee, representing Fina Oil & Chemical, reviewed the site plan with the
Commission. He stated that the dumpster will be screened and the landscaping
will be irrigated.
1 Commissioner Falk asked about the necessary fire lane, and Mr. McGee confirmed
that because there are two fire hydrants within the required 150 feet, no addi-
tional fire lane is necessary.
Mr. Keener explained that a traffic study has been completed which concluded
that a right -turn lane is necessary on the U.S. 75 northbound frontage road. He
presented a drawing of the proposed configuration of U.S. 75 that had been
provided by the Texas Highway Department. The necessary right-of-way for the
right -turn lane shown by the Highway Department for the northbound access
road is satisfied by this proposal. Mr. Jack Hatchell provided the Commission
with copies of the traffic study and reviewed the process of the study for the
Commission.
Chairman Karlaruher opened the public hearing.
With no one wishing to speak FOR or AGAINST the request, Chairman Karlaruher
closed the public hearing.
Mr. Keener advised that the City Engineer and the Fire Marshal have both
approved this site plan.
Commissioner Gallagher questioned whether today's economy could support this
business on that site. Commissioner Garcia stated that the consideration should
be whether the use is compatible with the surrounding area.
Mr. McGee stated that their company has completed market studies that indicate
that there is a need for a service station in this location.

The consensus of the Commission was that the use is compatible with surrounding
areas.
Mr. Keener stated that the proposed use is consistent with the Comprehensive
Plan as a retail area.
Mr. Bob Roeder, representing Young Oil Company, owner of the property, stated
that the property is under contract to Fina Oil & Chemical.
MOTION: Upon a motion by Commissioner Garcia and a second by Commissioner
Gallagher, the Commission voted 6 FOR and 0 OPPOSED to recommend
approval of the request by Fina Oil & Chemical for a specific use
permit for a service station with a retail store and auto laundry as
incidental uses.
FINDINGS:
1 1. A service station is a compatible use at this location.
2. The traffic study was considered.
3. City Engineer and Fire Marshal have approved the plan.
4. All necessary easements are provided.
Review of Subdivision Ordinance
Mr. Keener discussed the requirement for electrical and telephone lines. The
current subdivision ordinance requires all subdivisions to install pad mounted
transformers. Staff is proposing new text that will place the burden of require-
ment for a pad mounted transformer on TU Electric. Major residential subdivi-
sions would still be required to have underground utilities; however, smaller
users such as day cares, car wash, service stations, etc., may not need this. If
there is an existing overhead pole available, the developer would be allowed to go
underground to that existing pole; however, no new poles to connect to the
existing ones would be allowed.
The Commission was concerned that the language should be made extremely clear
to stated that "no additional poles" should be allowed in order to circumvent the
requirement for pad mounted transformers. The language should clearly indicate
that large users would not be allowed to circumvent the requirement for pad
mounted transformers.
The Commission requested staff to obtain TU Electric's requirements. They
further suggested possible wording that would tie the need for pad mounted
transformers to TU Electric's requirements.
