CALL TO ORDER AND ANNOUNCE A QUORUM:
With a quorum of the Commissioners present, the Allen Planning & Zoning Com-
mission was called to order at 7:30 p.m. by Chairman Garcia at the Allen Municipal
Annex, City Council Chambers, One Butler Circle, Allen, Texas.
Approve Minutes
October 22, 1992 (Agenda Item II)
Chairman Garcia read the agenda item into the record as follows:

MOTION: Upon a motion by Commissioner Biggs and a second by Commissioner
Falk, the Commission voted 7 FOR and 0 OPPOSED to approve the
minutes of October 22, 1992, as presented.

Chairman Garcia read the agenda item into the record as follows:

MOTION: Upon a motion by Commissioner Biggs and a second by Commissioner
Crume, the Commission voted 7 FOR and 0 OPPOSED to remove this
item from the table.
Mr. Keener suggested a workshop might need to be scheduled in December for
further review of the Subdivision Ordinance.
The Commission discussed the development that appears to be occurring without
proper plats being approved. There was a question as to whether utilities are
being inspected and/or fees paid to Engineering prior to plat approval. Section
104.01 of the proposed Subdivision Ordinance was discussed regarding enforce-
ment, and whether the term "no contracts shall be executed" should be removed.
Mr. Keener advised that the proposed language of this section was provided by
the Texas Municipal League (TML). Chairman Garcia requested staff to review
this language with TML. The concern is whether the current pattern of develop-
ment will change with the adoption of this ordinance, and whether this paragraph
is intended to protect the City.
Staff was advised that all terms that are included as definitions should be capital-
ized at all future locations where the term is used in the document.
Section 105.06 - the word "municipality" should be changed to read "City."
Definition of VARCS should be included.
A definition of Flood Way should be included, and the definition of Flood Plain
should include the term "100 -year."
A definition of Cul-de-sac should be included.
On the definition of Street, Collector, remove the word "residential" since there
can be both a residential and a commercial collector street.
Section 200: Flood Plain -
Mr. Keener suggested a streamlined process for flood plain plats. The Director
of Parks and Recreation has suggested that all flood plain should be dedicated to
the City. Therefore, the language would read that all flood plain will be dedicat-
ed except that which would be negotiated through the zoning process.
Concern was expressed regarding the City's accepting flood plain without
inspection of the property for toxic waste and other environmental problems.
Staff was requested to review the process whereby the City would be accepting
dedication of the flood plain and later discover that it needs cleaning up. It was

suggested that some text should be added to protect the City against environmen-
tal cleanup. Otherwise, the simplified process would be appropriate.
Section 202 -
Language should be added requiring the developer to stake the flood plain. The
Commission suggested that this staking should be accomplished with permanent
monuments, the frequency to be determined by the topography.
Chairman Garcia requested staff to discuss this issue with the City Engineer to
determine the proper method of marking the flood plain.
Park Dedication Ordinance -
The recently adopted Park Dedication Ordinance is proposed for inclusion as
Article 600 0£ the Subdivision Ordinance.
Staff was requested to research the question of whether this ordinance supports
the Comprehensive Plan requirements regarding the number of acres of park land
required at buildout.
Commissioner Biggs suggested using an index to regulate the per -acre price.
The ordinance does not allow for credit to be given for flood way dedication. The
current policy has allowed 100% credit for flood plain. Discussion was held
regarding the possibility of allowing partial or no credit for flood plain. The
consensus was that no credit should be given for flood plain dedication. Section
7.a.1 - should read "flood plain" rather than "flood way."
Staff was requested to research the possibility of using land price indexes to set
the fee for money in lieu of land dedication.
Other Business:
A workshop session was set for November 16, 1992, at 6:30 p.m. to further
consider the Subdivision Ordinance.

MOTION: Upon a motion by Commissioner Biggs and a second by Commissioner
Crume, the Commission voted 6 FOR and 0 OPPOSED to adjourn the
November 12, 1992, meeting of the Allen Planning & Zoning Commis-
sion at 9:30 p.m.
