CALL TO ORDER AND ANNOUNCE A QUORUM:
With a quorum of the Commissioners present, the Allen Planning & Zoning Com-
mission was called to order at 7:30 pm by Chairman Garcia at the Allen Municipal
Annex, City Council Chambers, One Butler Circle, Allen, Texas.

Commissioner Kelley indicated that the word "he" on page 5, paragraph 3, should

the Rowlett Farm Partnership, to amend Planned Development Numbers 38,

Buckingham Estates

"Public Hearing - Consider a request by Mr Bob Taylor of Taylor Custom
Builders, Inc to change the zoning from Agriculture -Open Space to Planned
Development/R-2 Single Family with one -acre minimum lots in the Bucking-
ham Polo Estates Variances to the City development standards are being
requested for the following items: 1) alleys not required; 2) street paving
width to be 24 feet, without curb and gutter; 3) street pavement to be 2"
HMAC over 10" crushed stone as per Collin County requirements; 4)
drainage to be open ditch sections; 5) sidewalks not required The proper-
ty is described as a 6.1609 -acre tract of land in the Henry Weisel Survey,
Abstract No 1026, and a 2.5236 -acre tract of land in the James T Roberts
Survey, Abstract No 777, situated in the City of Allen, Collin County,
Texas; further described as being located on Buckingham Lane east of
S. H. 5."
Mr Robert Taylor, 233 Rock Ridge Circle, Allen, Texas, owner of the property,
presented the request to the Commission. He stated the variances being request-
ed reflect the current development in the area. He is proposing to develop 1 -acre
estate lots.
Mr Keener stated that this is an unrecorded platted subdivision. He discussed
the surrounding zoning. He stated that there are several parcels within the
subdivision currently zoned R-5 and R-2/DR This creates a potential to have 3 or
4 different zoning districts within this one subdivision.
Commissioner Allen discussed the existing R-5/DR and R-5 on the north side of
Buckingham Lane, and the fact that there are existing homes in that area.
Mr Jeff Knauss, 100 Buckingham Lane, stated that he is currently building a
home on his property of 17 acres. Mr Taylor stated that there are about 4 or 5
additional homes in the area at 2,000 plus square feet on 112 to 2 -acre lots.
Mr Petty reviewed the history of Buckingham Polo Estates. He stated that he felt
it would be in the best interest of the city for the entire subdivision to have one
zoning district. The problem is that only the Commission, Council, or property
owners can initiate zoning. For the City to rezone the entire subdivision would
result in the downzoning of the R-5 and R-5/DR, which would leave the City
liable for taking property without just compensation. He discussed the circum-
stances surrounding the construction of the road within the subdivision.
Mr Whitehead, City Engineer, discussed the pro rata district established by the
City in this area in order to develop the water and sewer and the construction of
Buckingham Lane. He stated that he has spoken to most of the owners in the
0 area, and it appears to be their intention to build on large estate lots.

SUMMARY OF PARKS AND RECREATION VIEWS
REQUESTED BY THE PLANNING AND ZONING COMNIISSION
A tremendous amount of time and effort has been expended studying the
proposal for zoning Twin Creeks Development area. The proponents have
worked through Planning and Zoning to resolve numerous issues. Planning and
Zoning members have been very thorough in working with the proponents.
Recently, the proponents have demonstrated a willingness to work with Planning
and Zoning to resolve issues regarding community facilities and linear trails.
There still appears to be a standstill however, regarding a few of the park
related issues. Reasons for this are unclear, however, they seem to persist.
Some of the unresolved issues may be due to attempts by all parties to do what
is best without having enough detail to know what is actually going to occur
(i.e., designing of the golf course).
Planning includes several phases (i.e., zoning, plat review and approval, etc).
In this zoning request, several items have been proposed that somewhat cross-
over into what normally would occur during platting or design and engineering
review. What complicates the process more, a site plan has been submitted for
Phase I which includes construction of an 18 hole golf course in the floodplain
currently zoned CF -FP. The proposed design of the golf course is conceptual
and details have yet to be determined. Thus questions regarding safe passage of
hikers and bicyclist along Rowlett Creek has adjacent to the golf course cannot
be answered. Determining how to address these issues, protect the interest of
the community and accommodate the desires of the proponent has been quite an
interesting challenge.
It appears that not all issues can be resolved through zoning. However, by
being prudent in the approval of the request assurances may be included that
will prove most beneficial to all concerned. Provisions of these assurances in
the zoning proposal first may increase the probability that the zoning request
will be approved and second, allow the City an opportunity to thoroughly
evaluate proposed park sites and trail locations during the platting and design
review process.
In order to accomplish this, certain areas of the proponent's proposal need to be
addressed. By addressing these areas, the Parks and Recreation Board, staff
and hopefully all other concerns may be resolved. A summary of the Parks and
Recreation Board views and sections of the zoning proposal that need to be
addressed are attached.
They include sections related to the golf course, specific community facilities
regulations, linear greenbelt areas along Rowlett Creek, and private
neighborhood parks. If these areas are addressed accordingly through zoning,
we feel that: 1) a golf course and linear trail will be constructed along Rowlett
