June 21, 2005
Call to Order and Announce a Quorum is Present:
With a quorum of the Commissioners present, Chairman Caplinger called the meeting to
order at 7:00 p.m. in the City Hall Council Chambers at Allen City Hall, 305 Century
Parkway.
Director's Report on June 14, 2005 City Council Action
The proposed amendments to the Allen Land Development Code were tabled.

Consent Agenda
IM Item 1: Approve Minutes of June 7, 2005, Regular Meeting.
Item 2: Approve Minutes of June 10, 2005, Special Called Meeting.
Motion: Upon a motion by Commissioner Wendland and a second by Commissioner
Rushing, the Commission voted 6 IN FAVOR, and 0 OPPOSED to approve
the Consent Agenda. The motion carried.
Regular Agenda
Item 3: Tabled Item - Consider a Waiver of Sidewalks along W Bethany Drive within
the Montgomery Farm property
Motion: Upon a motion by Commissioner Wendland and a second by Commissioner
Grimes, the Commission voted 6 IN FAVOR, and 0 OPPOSED to remove
Agenda Item 3 from the table. The motion carried.
Mr. Hoover presented the request to the Commission. The request is for a waiver of sidewalks
on the south side of Bethany Drive adjacent to the Montgomery Farm property. There will be a
trail on the north side of Bethany The applicant feels that constructing the sidewalks on the
south side could require encroachment into the berm. Mr. Hoover stated that staff does not
support the waiver of the sidewalk on the south side.
Ms. Amy Monier addressed the Commission. The applicant feels that the purpose of the
sidewalks is to help the Bow of pedestrian traffic. They feel with the construction of the trails,
they have met this requirement.
Comments from the Commissioners:
• There are two (2) schools in this area — the children will walk next to Bethany even if no
sidewalk is provided — this is a safety concern.
• Absence of a sidewalk may cause more safety problems.
• The criteria for granting a variance has not been met.
Motion: Upon a motion by Commissioner Wendland and a second by Commissioner
Culbertson, the Commission voted 6 IN FAVOR, and 0 OPPOSED to deny
the request for a sidewalk waiver along the south side of W. Bethany Drive.
The motion carried.
