Agenda Item 3: Final Plat — Consider a Final Plat for Starcreek Commercial, Lot 2X & 5, Block B being 5.416+ acres located east of Watters Road, south of SH 121. Agenda Item 4: Final Plat — Consider a Final Plat for Starcreek Commercial, Lot 6, Block B, being 2.484± acres located east of Watters Road, south of SH 121. Motion: Upon a motion by Commissioner Grimes, and a second by Commissioner Rushing, the Commission voted 7 IN FAVOR, and 0 OPPOSED, to approve the Consent Agenda. The Motion Carried. Regular Agenda Agenda Item 8: Public Hearing/Replat — Consider a Replat for North Allen Substation, Lots 1R, 2 & 3, Block A and Lot IR, Block B, a Replat of Lot 1. The property is 4.490± acres located north of Stacy Road and west of Chelsea Boulevard. David Hoover, Director of Planning, presented the request to the Commission. He discussed the reason for the replat. The developer wants to screen the property which requires shifting the property line to allow berming and landscaping. Staff recommends approval of the Replat. Chairman Wendland opened the Public Hearing. With no one wishing to speak, Chairman Wendland closed the Public Hearing. Commissioner Grimes questioned if the replat would be part of the HOA. Mr. Hoover stated that would be part of the HOA. Motion: Upon a motion by Commissioner Grimes, and a second by Commissioner Rushing, the Commission voted 7 IN FAVOR, 0 OPPOSED, to approve Item 8. The Motion Carried. Agenda Item 9: Public Hearing Continued - Conduct a Public Hearing and consider a request for a SUP Specific Use Permit No. 104 for a Goodyear Car Care Center. The property is .92± acres situated in the McCoy and Roth Addition, located at the southwest corner of Stacy Road and Goodman Drive, David Hoover, Director of Planning, presented the item to the Commission. He stated there was previous discussion on appearance, screening and activity at the last meeting. The applicant was asked to provide more information. Staff recommends approval of the Specific Use Permit. Mr. Hoover invited the applicant, Issa Boueri, to speak. PLANNING & ZONING COMMISSION PAGE 3 May 6, 2008 Issa Boueri, 7117 Lyons Rd., Garland, applicant, presented a rendering of the proposed Goodyear building. He stated that neighbors were concerned about the landscape around the building. The property will have a 4 ft berm with flowers. He also said there will not be a screening wall because a wall is not aestelically appealing. He continued by saying he is trying to make the building appealing so it does not look like a typical garage. Another concern was noise. He explored several options, but the current configuration is best and the noise will not be a factor. He ended by saying there is no garage in Texas that will look like this and he will sign off on it. Commissioner Rushing stated that this is not the normal look for a Goodyear building. Mr. Boueri responded by saying he wanted to change the building to make the neighbors happy and proud of it. The nicer the building the more customers the building will bring. Chairman Wendland opened the Public Hearing. Chairman Wendland stated that written comments from the first speaker, Pert Virtanen, were received and distributed to the Commissioners. It will become a part of the record (attached). Pert Virtanen, 1807 Baltimore Drive, spoke in opposition to the request. He summarized the basics of his written comments. Derek Weatherbee, 1617 Country Brook Lane, spoke in opposition to the request. He stated that he was concerned about the increased traffic on Country Brook Lane and into his neighborhood. He said the Goodyear entrance should be on Angel Parkway or Stacy Road. Pat Anderson, 1615 Country Brook Lane, spoke in opposition to the request. She stated that she is concerned about the traffic. She questioned who will enforce the provision that the building will look like the rendering. Kenneth Krogerus, 1802 Stacy Road, spoke in opposition of the request. He stated landscape shielding and noise protection were a concern. Impact wrenches generate 103 decibels of sound, which can cause hearing loss. He does not believe enough effort has been placed on the noise issue. Todd Stein, 4631 Elsby Ave, Dallas, Jordan Realty Advisors, applicant's representative, spoke in favor of the request. Mr. Stein stated that this property needs a mix of uses for proper development. He believes this business is warranted and is in the best location. With no one else wishing to speak, Chairman Wendland closed the Public Hearing. Commissioner Mangrum stated the location is the best on the property She said the building was nice and the hours of operation was Monday through Saturday and closed on Sunday She is in support of this SUP Commissioner Cocking stated that he drove to similar establishments to research the noise. He said he sat outside for 30 minutes and did not hear anything. He continued by saying that at 100- 150 ft. away it was hard to distinguish the noise of the tools from the noise of traffic or PLANNING & ZONING COMMISSION PAGE 4 May 6, 2008 surroundings. He stated that the building was nice and the applicant showed commitment. He is in support of this SUP Commissioner Jones questioned the access to the property from a residential street (Goodman Drive). David Hoover responded by saying as the tract develops there will inevitably be entrances on Goodman Drive. Commissioner Jones asked if City staff is looking into ways to encourage slower traffic in the residential area. David Hoover responded by stating that nothing has been discussed yet. However the intensity of the traffic will not be what people are anticipating. John Baumgartner, Director of Engineering, discussed the current and future construction for Stacy Road, State Highway 5 and Country Brook Lane. He summarized Country Brook Lane as a residential collector that will provide traffic relief for Angel Parkway and FM 1378. He concluded by saying that Country Brook Lane has been designed and construction should occur at the end of 2008 or 2009 Commissioner Jones stated she did drive the area and considered that another type of business like a restaurant, which has constant traffic, could go on this site, which could generate significantly more traffic and noise. She agreed that this is a good use for the property Commissioner Rushing stated once this SUP is approved it becomes a legal document and the plans cannot be changed. David Hoover agreed with Commissioner Rushing and added that neither the plan or the use can be changed Commissioner Rushing said the applicant has gone out of his way to make the building look nice. He believes it is a good use and is in support. Commissioner Grimes stated he originally had issues with the noise. He went by some oil change businesses and the noise died down at about 100-150 ft. He does not believe noise is an issue. He added that the more traffic you have, the slower it will go. He cannot see this business as a large traffic generator. He is in support as long as the architectural standards are set and the use is limited. Chairman Wendland stated he had no problem with this request. The renderings will be a part of the SUP He said the Goodyear is compatible with other properties in the area. He is in support of this SUP Motion: Upon a motion by Commissioner Cocking, and a second by Commissioner Rushing, the Commission voted 7 IN FAVOR, 0 OPPOSED, to approve Item 9. The Motion Carried. Agenda Item 10: Public Hearing — Conduct a Public Hearing and consider a request for an SUP Specific Use Permit for a Firestone car care center, on property zoned SC Shopping Center. The property is .946± acres situated in Lot 2, Block A, Allen Center North Addition, located at the southeast quadrant of Greenville Avenue and Stacy Road. PLANNING & ZONING COMMISSION PAGE 5 May 6, 2008 David Hoover, Director of Planning, presented the item to the Commission. He stated that the entire site is zoned SC Shopping Center. The property was marketed to be sold in its entirety, however that has not happened. There may or may not be another pad site on the northern side of the property Mr Hoover continued by saying the location makes sense due to the buffering by the City of Allen pump station and future buildings. This business will sell tires and make minor automotive repairs. Staff recommends approval. Chairman Wendland opened the Public Hearing. Garlyn Norris, 1021 Shelbom Drive, spoke in opposition of the request. He stated that he represents the Silhouette community and this business is not in line with the other types of businesses in the area (current or future). He concluded by saying this business will not be beneficial for the community Kristopher Karrigan, 1007 Shelbom Drive, spoke in opposition of the request. He stated that the reasons why he chose to live in his subdivision were because it looked safe and he was told by the City that the open space was zoned Shopping Center. He is opposed to the dust from tires and the oil. He also stated that the business would be an eyesore. He concluded by asking how the community would benefit from a tire center. Sari Eljarrah, 1025 Shelbom Drive, spoke in opposition of the request. He said his concern was pollution that occurs within the nature of the business. Stagnant oil and dust from used tires were especially concerning. He concluded by saying these applications carry pollutants. Steve Bartell, 1711 White Rock Court, spoke in opposition of the request. He stated that the Goodyear building was admirable and hoped Firestone had given the same thought. He questioned whether a screening wall would be built before or after the building was constructed. He also stated that dust and water contamination concerns him. He concluded by saying what was promised by the City and what is being proposed look like two different things. With no one else wishing to speak, Chairman Wendland closed the Public Hearing Chairman Wendland stated that the speaker cards for those who did not wish to speak would become a part of the record (attached). Steve Meier, 5949 Sherry Lane, Dallas, Mays and Company, applicant, spoke in favor of the request. He stated his company is a developer for Firestone and has built numerous buildings in the Metroplex. This business will be corporate owned, not a franchise. He stated there are rigid regulations to keep the property clean and control pollution. Used tires are stored inside and picked up by a tire recycler. New and old oil are stored in tanks. He continued by saying this Firestone is part of a previously approved General Development Plan and a screening wall is a requirement of the overall development As a policy, Firestone does not store cars outside overnight. Building materials will be complimentary to the materials for Walgreens, which has already been approved. He concluded by saying the building will have a residential look. Chairman Wendland asked which building elevation will face the southern property owners. Mr Meier stated that no garage doors will face the southern neighbors. PLANNING & ZONING COMMISSION PAGE 6 May 6, 2008 Chairman Wendland stated that products or by-products are not allowed to be disposed in the dumpster. Steve Meier answered yes. Commissioner Jones asked if there will be screening at the south end of the Firestone property Steve Meier stated there would not be screening because it would conflict with their cross access. Commissioner Jones asked if there would be opporunities for landscaping. Mr. Meier answered there will be greenspace against the building. Chaimran Wendland staled that constructing a screening wall is a timing issue. Commissioner Jones asked if the facility will be washed down with hoses. Steve Meier answered yes. He continued by saying there will be a trench drain in the floor and will drain the water into an oil separator. The oil separator will filter out any oil; which will allow the water to go into the sanitary sewer. Commissioner Grimes stated he had no problem with this request. It is an industrial use far from a residential area. He stated the City does require a screening wall and suggested entertaining screening across the southern edge of the property Commissioner Rushing stated the building looks like a typical Firestone. Commissioner Cocking stated he was torn on screening the residents 300 feet away He is willing to not require screening at this time. He is in support of this Special Use Permit. Chairman Wendland stated he has no problem with the use and believes it is appropriate. He added that he has a concern for the neighbors to the South. However, he is not certain if he is in favor of a screening wall due to the distance. He continued by saying that he went to an existing Firestone and could hear very little noise. David Hoover stated basic rules will apply regarding landscaping and parking lots. Through the Site Plan staff will work to mitigate screening concerns with a landscape buffer. He concluded there is flexibility to screen the property Commissioner Jones asked in what process could the screening issue get resolved David Hoover answered in the Site Plan process. Motion: Upon a motion by Commissioner Grimes and a second by Commissioner Jones, the Commission voted 7 IN FAVOR, 0 OPPOSED, to approve Item 10 with the following stipulations: • Minor Automotive Repair Use Only • Building sign lights, located on the South side, will be unlit after dark until the rest of the property is developed. • Staff will work with developer to mitigate headlights and noise. The Motion Carried. Item #11: Public Hearing — Conduct a Public Hearing and consider a request for an amendment to Tract 2, Planned Development No. 53 for CF Community PLANNING & ZONING COMMISSION May 6, 2008 PAGE Facilities, to allow office uses. The property is 2.828± acres situated in Lot 1, 1 Block A, The Reading Ranch Addition; located at the northeast comer of Twin Creeks Drive and Exchange Parkway, David Hoover, Director of Planning, presented the item to the Commission. He stated the Reading Ranch School was initially going on the site. However, the developers decided not to follow through with that project. There is a request to build office buildings in its place. Mr. Hoover continued by saying the purpose of this hearing is to get input from the Commission and feedback from the community The office buildings proposed will look like houses. Professional offices, like investment counselors, CPAs, lawyers, etc., will tenant the space. These types of offices will bring less traffic. He concluded by stating the owner would pursue development assuming positive feedback. Commissioner Dreggors questioned the setback requirements. Mr. Hoover responded by stating it depends on which direction the offices will face. Commissioner Dreggors asked what would be done if the offices were treated like homes; where walls or other screening are not permitted in front of the property He is concerned about people parking on the residential street to enter the office buildings. Mr. Hoover stated that measures would be taken to eliminate the option to park on the street. Chairman Wendland opened the Public Hearing. Josephine Stone, 1420 Wallace Drive, spoke in opposition of the request. She stated she bought her house two years ago. If the property had originally been zoned Office she would not have purchased her home. She questioned why an office complex was going in the middle of a residential area. She is concerned about the safety of her children as a result of the traffic the offices will bring. She concluded by questioning trash pickup. Steven Perry 1422 Wallace Drive, spoke in opposition of the request. He is concerned with what Josephine Baker said. He believes putting offices in the vicinity will affect home values. The offices do not fit with the community He concluded by saying the offices will make traffic issues worse. Patrick Jones, 1418 Wallace Drive, spoke in oppostion of the request. He stated his children play in the church parking lot. He is concerned with the people who will come to the offices. He questioned who will ultimately manage the offices and how the property values would be affected. He concluded by presenting petitions from other residents to the Commission. Chairman Wendland stated that the petitions would become part of the record (attached). Gregory Parks, 1430 Glendover Drive, spoke in opposition of the request. He introduced himself as president of the Glendover Park HOA. He stated this property is zoned Community Facilities. The office buildings are not compatible with the other facilities in the area. He is concerned that traffic will increase on Wallace Drive. Randy Black, 1409 Wallace Drive, spoke in opposition of the request. He is concerned with property values, environmental impact and safety of children in the community PLANNING & ZONING COMMISSION PAGE 8 May 6, 2008 1 Martin Holland, 1424 Wallace Drive, spoke in opposition of the request. He stated lots of children are on the street. The development would increase traffic. He continued by saying he bought the house for the schools and surrounding zoning. He is opposed to the zoning change. With no one else wishing to speak, Chairman Wendland closed the Public Hearing. Torsten Holmes, 2142 Channel Islands Drive, applicant, spoke in favor of the request. He stated he lives in Allen and has young children as well. The land has not been purchased yet. He continued by saying he was just looking for feedback. He is proposing to put his own business in one of the buildings. He concluded by saying he wants to make the buildings appealing to the neighborhood. Commissioner Grimes stated he is not in favor of the proposal. He does not believe it fits with the neighborhood. David Hoover reiterated that staff and the applicant are just looking for feedback at this time. Chairman Wendland stated the advantage of the public hearing process was to get feedback. Commissioner Rushing questioned what the property could be used for. Commissioner Jones questioned what the property could be used for. She stated the design was too intrusive for the property She posed the suggestion to reduce the number of buildings to two, with more landscape buffer. Commissioner Cocking stated that a community facility has a building in the middle of the property with a lot more open space. He will consider offices; however it must change from the concept plan. He wants to see the same setback as houses in the front, a landscape buffer and a decorative fence to surround Wallace Drive and the church. He has a concern with walkthrough traffic. He suggested the office buildings need to have different elevations and a limit of 3000 sq. ft. Commissioner Mangrum agreed with Commissioner Cocking. She stated the office buildings would be fine with a fence, landscaping and a reduction to two buildings. She doesn't see any other solution for the property Chairman Wendland stated that he lives in the area and initially did not want to see offices on this tract. However he does not want the property to remain undeveloped due to the strict Community Facilities zoning. He would like to look at another proposal that would be more compatible with the neighborhood. Commissioner Rushing asked if two weeks was enough time for the applicant to meet with residents and change the concept plan design. Chairman Wendland stated that two weeks should be enough time for the applicant. As Planning and Zoning Commissioners, you do important overall visionary planning. Nevertheless, on a semi-monthly basis you deal mostly with current reality. In regard to the item we are discussing at the moment, you have roughly 13 acres of empty property zoned commercial upon which someone wants to construct a building on 7 percent of it. Item.2. So I would like you to consider the variety of other possibilities the property owner may have. The land consists of approximately 560 feet of frontage facing East Stacy Road. There is also approximately the same amount of frontage facing Angel Parkway. Angel Parkway is a 4 - lane divided thoroughfare already in place. East Stacy Road is a 2 -lane Farm -to -Market road. hem -3. TxDOT will shortly begin the work on a schematic design for East Stacy Road being changed to a 4 -lane divided road between Greenville Avenue and Country Club Road. The process of design, approval of it, environmental clearance, and bidding any part of the project, will take 2 to 3 years. Any actual construction could take upwards to an additional year. About this time a year ago, bonds were passed for the funding of the portion west of Angel Parkway. So that is likely to be completed no earlier than the year 2011. Item4. No City of Allen funding is in place for any construction on East Stacy Road east of Angel Parkway. If such funding were approved by another bond package presented to voters in 2012, the process of selling the bonds, bidding the project and completing the construction could be accomplished by 2014. Item . West of the City of Allen, Stacy Road continues through the City of McKinney and into the City of Frisco. On the east side, while the Collin County Mobility Plan 2006 Update shows it extending east of Country Club Road, that is not going to happen. Item.b. So, if Mr. Boueri was thinking along those lines, he needs to think again. Also, I think that he should consider what the effect of future road construction might be on the building that he plans to construct prior to that. In other words, be careful what you wish for, because businesses often go into dormancy when the streets they face have to be widened or rearranged. Item.Z. In the meantime, how should the total development of this 13 acres take place? Based on its size, it needs to have an anchor store. What that may be, I have no idea. However, I do know that it needs to have the highest amount of visibility from the thoroughfare that carries the largest amount of traffic. That happens to be Bast Stacy Road, whether a 2 -lane road or a 4 -lane road. If the owner cannot hold on to 13 acres completely undeveloped, and therefore has to cut out piece by piece segments in advance of an anchor store, I think the focus should be on the western 560 feet of frontage, rather than on the northern 560 feet. Unfortunately the plan we have seen thus far, has shown a 2 -lane driveway from the southeast corner of the Comerica Bank lot all the way east to Goodman Drive. If the result is numerous pad sites, that is indeed a very bad plan. Item -8. For example, if a driver is traveling at the current speed limit of 55 mph on East Stacy Road, how long does it take to pass 560 feet of street frontage. 1, 2, 3, 4, 5, 6, 7 It takes 7 seconds. Surely the land owner would not want to block that 7 second view to the remainder of the property Item -9. In conclusion of what I have to say, there is only one other item I think you should consider. Besides those of us who show up at your meetings, there is a group not invited, yet they are equally effected by your decisions. When I asked James Chancellor about his thoughts, he responded "Thanks for the heads up." That indicated to me that no one within Allen City Hall had notified him. Mr. Chancellor is the Director of Engineering of the Town of Fairview. And, incidentally, he agreed with me that access to a Goodyear store should be from Angel Parkway, rather than East Stacy Road.. kem10. Fairview is your neighbor on the north. So, with items like Firestone and Goodyear, proposed for being built on the Allen side of East Stacy Road, it seems to me that your P&Z and their P&Z should be coordinating with each other --or at least your 2 chairmen should be.
