Assistant Director of Engineering Amber Slayton, Attorney PLANNING AND ZONING COMMISSION Regular Meeting May 20, 2008 Call to Order and Announce a Quorum is Present With a quorum of the Commissioners present, Chairman Wendland called the meeting to order at 7:03 p.m. in the City Hall Council Chambers at Allen City Hall, 305 Century Parkway Director's Report from 5/13/08 Council Meeting The Council approved the Special Use Permit for a Goodyear Car Care Center, located at the southwest corner of Stacy Road and Goodman Drive Consent Agenda Approve minutes of May 6, 2008, Regular Meeting. Final Plat — Consider a Final Plat for Allen Watters L.P Addition, Lot 4, Block A being 1.1754± acres located south of the southwest corner of McDermott Drive and Watters Road. 3. Final Plat — Consider a Final Plat for Custer-Hedgcoxe Addition No. 3, Lots 3A, 3B, 5, 6 and 7, Block A, being 6.183± acres of land located north of Hedgcoxe Road and east of Custer Road. PLANNING & ZONING COMMISSION PAGE 2 May 20, 2008 Motion: Upon a motion by Commissioner Grimes, and a second by Commissioner Rushing, the Commission voted 7 IN FAVOR, and 0 OPPOSED, to approve the Consent Agenda. The Motion Carried. Reeular Aeenda Agenda Item 4: Continued Public Hearing- Conduct a Public Hearing and consider a request for an amendment to Tract 2, Planned Development No. 53 for CF Community Facilities, to allow office uses. The property is 2.828± acres situated in Lot 1, Block A, The Reading Ranch Addition; located at the northeast corner of Twin Creeks Drive and Exchange Parkway Lee Battle, Assistant Director of Planning, presented the request to the Commission. He stated that this item was tabled at the May 6, 2008 meeting. The applicant has been in communication with the neighboring residents and has returned with a revised plan. The proposal includes fewer buildings; with the buildings being smaller in size and lower in height. The concept plan includes a landscape buffer, sidewalk, possible parkland area, trail, street trees and a 6 foot wrought iron fence. The dumpster will be screened. Trash collection will be controlled by CWT) and service will fall on the residential schedule Staff recommends approval. Chariman Wendland questioned whether the West Allen Church of Christ had a dumpster Lee Battle answered that the church has a polycart instead of a dumpster. He stated this property could possibly have polycarts. Chairman Wendland opened the Public Hearing. Tammy Jones, 1418 Wallace Drive, spoke in opposition to the request. She stated she lives behind the West Allen Church of Christ and her children play in the church parking lot. She lived in Plano previously and had a similar experience with offices moving into her residential area. She stated that crime followed as a result of the offices. She does not want to relive that experience. Her concern is safety She stated she can live with the concept plan that the applicant presented however she has a suggestion. She would like to see a four-way stop sign at Twin Creeks Drive and Exchange Parkway to eliminate possible traffic hazards as a result of the new development. Gregory Parks, 1430 Glendover Drive, spoke in favor of the request. He introduced himself as the Glendover Park HOA representative. He stated he had a meeting with the applicant and saw the revised plan. The majority of the HOA was satisfied. He continued by reading a letter from Scott and Josephine Stone (attached) which listed their suggestions. Mr. Parks believes the plan presented will fit in with the area and is in support. Steven Perry, 1422 Wallace Drive, spoke in favor of the request. He stated he was somewhat opposed at the previous meeting. However, after the meeting with the Glendover Park HOA he is in favor of the revised plan. He stated a concern about maintenance of the property Currently, the maintenance is poor and he wants to know who will be responsible for maintaining the property once it is developed. With no one else wishing to speak, Chairman Wendland closed the Public Hearing. PLANNING & ZONING COMMISSION PAGE 3 May 20, 2008 Chairman Wendland commended the applicant and homeowners for meeting. Michael Barrier, 3904 Drexel Drive, Plano, applicant representative, spoke in favor of the request. He stated the applicant met with the residents with the result being a successful meeting. He confirmed the dumpster will be encased and believes the applicant has made an extraordinary effort to meet the concerns of the residents. Commissioner Jones asked what the fence length was on the eastern side of the property Mr. Barrier answered by stating the applicant will lengthen the fence to follow whatever the City requests. Mr. Barrier addressed the maintenance issue by stating the applicant has not purchased the property yet. However, once the property is in his ownership he expects the applicant to hire someone to maintain the property Chairman Wendland questioned whether the office space will be leased. Mr. Barrier said yes. Commissioner Mangrum stated she would like to see a wrought iron fence on the northern and eastern sides of the property She would also like to see more landscaping instead of an additional sidewalk. She is in support of this request. Commissioner Cocking stated he is concerned with the entrance of the eastern office building in 1 relation with the church parking lot. He believes people going into this office building will use the church parking lot instead of the office parking lot. Lee Battle showed the Commission where the building set back was on the concept plan. He stated that the plan has exceeded the City's parking requirements. Commissioner Cocking stated he would recommend a fence on the eastern side of the property He is in support of this request and believes this plan is a good example of something that fits the neighborhood. Commissioner Jones stated she is concerned with the neighborhood using the property as a park- like setting even though this is an issue for the owner to deal with. Commissioner Rushing stated this plan is a good compromise. He would have liked to have input from the church. Commissioner Grimes commended the applicant and neighborhood for their efforts. He is in support of this request. He suggested continuing the fence and landscaping on the north side of the property 75-100 feet in order to screen Wallace Drive from the parking lot. He does not see the need to screen the church parking lot from the office parking lot. Chairman Wendland commended the applicant and neighborhood for their efforts. He likes the concept plan. His only issue is how far the screening needs to go. He stated that he is inclined to suggest screening the entire east side of the property However, he does not know if it is necessary to screen any other property line besides the one that abuts Wallace Drive. He believes this is compatible with the neighborhood. He is in support of this request. PLANNING & ZONING COMMISSION PAGE 4 May 20, 2008 1 Commissioner Jones stated the proposed landscaping was not included in the packet. Lee Battle responded that the landscaping can be added as an exhibit. Commissioner Cocking questioned the suggestion to extend the fence. He stated his main concern is bleed over traffic from the office resulting in the church parking lot being used by the office patrons. Chairman Wendland stated his point was motivated by the safety of children in the neighborhood. He believes it is possible for the church to have bleed over traffic as well. Commissioner Dreggors suggested moving the entrance for the eastern office building to eliminate the fence issue. Chairman Wendland had concerns of this change affecting the architecture of the building. Gregory Parks, 1430 Glendover Drive, suggested placing the dumpster on the Twin Creeks side of the property in order to preserve the view of the homeowners. Chairman Wendland asked staff for a recommendation. Lee Battle stated that the length of the fence would be whatever the Commission's preference was. He stated the fence location is not fixed in the concept plan. Chairman Wendland addressed the dumpster comment by stating the Commission tries to keep dumpsters from abutting heavily traveled thoroughfares. Motion: Upon a motion by Commissioner Cocking, and a second by Commissioner Rushing, the Commission voted 7 IN FAVOR, 0 OPPOSED, to approve Item 4 with the following stipulations: • Preliminary landscape plan is added as an exhibit. • Continuation of fencing along the east side of property to a point equal to the southernmost parking space of the eastern office building or the southernmost parking space of the West Allen Church of Christ, whichever is furthest south, is required. The Motion Carried. Other Business The annual Board Evaluation will be emailed to each Commissioner prior to the June 3, 2008 Planning & Zoning Commission meeting. Landscaping alone is not secure enough. 2. Dumpster — relocate dumpster to west side of property (along Twin Creeks Dr) for security, sanitation and noise issues. Does commercial trash removal have the same operational constraints as residential (at what time and how often will trash removal occur in front of our home)? The church follows the same trash removal as the residents. 3 Tenants — medical tenants pose a higher rate of continuous daily traffic for the nature of their business thus increasing the traffic and visibility to our homes. If traffic pass through to Wallace Dr could be closed off on the West end tenant traffic would not be an issue.
