With a quorum of the Board members present, the Allen Board of Adjustment was called to
order at 7:30 p.m. by Chairman Clay at the City Council Chambers, One Butler Circle, Allen,
Texas.

Chairman Clay read the agenda item into the record as follows:
"Approve minutes of December 5, 1994, Called Special
Meeting."
MOTION: Upon a motion by Board member Roberge and a second by
Board member Cocking, the Board voted 5 FOR and 0
OPPOSED to approve the minutes of December 5, 1994.

Public Hearing
830 Sterling Court (Aeenda Item III)
Chairman Clay read the agenda item into the record as follows:
"Public Hearing - Consider a request from Stephen Ciesielski for a variance to reduce
the side yard building line to 6.25 feet. The property is described as Lot 16 Block A
of the Cottonwood Bend Estates Phase I, 830 Sterling Court, Allen, Texas."
Ms. Cynthia McSperitt, City Staff, administered the following oath to persons listed below
who intended to testify during the hearing. "Each of you do solemnly swear or affirm that the
testimony you shall present in this proceeding shall be the truth and nothing but the truth, so
help you God."

Chairman Clay opened the public hearing.
Mr. Bret McCullough, Building Official, presented the request to the Board. He indicated that
the request is for a 6.25 -foot side yard building line instead of approximately 10 feet which is
required by current zoning. He also pointed out the 6.25 -foot side yard would be consistent
with other side yards throughout the subdivision. The buildable area of the lot was
dramatically reduced due to the establishment of a 45 -foot building line on one side of the
property during zoning process. This line was established for the purpose of tree preservation.

Mr Stephen Ciesielski addressed the Board and once again pointed out the fact that a 6.25 -
foot side yard would be consistent with the other lots in the subdivision. He indicated that he
had spent more than six months designing this house and requested that the Board grant the
variance.
With no one else wishing to speak for or against the request, Chairman Clay closed the
public hearing.
After the Board considered testimony, it was determined that a variance to allow a 6.25 -foot
side yard building line would indeed allow the preservation of large trees. The Board
concurred that the side yard building line variance would not adversely affect the adjacent
properties or general welfare, and
would in fact allow for the preservation of large trees;
MOTION Upon a motion by Board Member Roberge and a second by Board Member
Fourrier, the Board voted 5 FOR and 0 OPPOSED to approve the request for a
variance to reduce the side yard building line at 830 Sterling Court to 6.25 feet.

MOTION Upon a motion by Board Member Roberge and a second by Board Member
Fourrier, the Board voted 5 FOR and 0 OPPOSED to adjourn the June 6, 1995,
meeting at 7:56 p.m.
