BOARD OF ADJUSTMENT
REGULAR MEETING

CALL TO ORDER AND ANNOUNCE A QUORUM:
With a quorum of the Board present, the Board of Adjustment was called to order at 7.30 p.m. by Chair-
man Roberge at the Allen Library, Two Allen Civic Plaza, Allen, Texas.

Election of Officers (Agenda Item II)
Chairman Roberge read the agenda item into the record as follows:
"Election of Officers - Chairman, Vice-Chavman."
Board Member Clay placed the time of Bill Roberge in nomination for the office of Chairman. The
nomination was seconded by Board Member Cocking. With no further nominations, Bill Roberge was
elected Chairman by acclamation.
Board Member Cocking placed the name of Galen Clay in nomination for the office of Vice -Chairman.
The nomination was seconded by Board Member Engle. With no further nominations, Galen Clay was
elected Vice -Chairman by acclamation.
Approve Minutes
May 6. 1997 (Agenda Item III)
Chairman Roberge read the agenda item into the record as follows:
"Approve minutes of May 6, 1997, Regular Meeting."
MOTION: Upon a motion by Board Member Clay and a second by Board Member Engle, the Board
voted 4 FOR and 0 OPPOSED to approve the minutes of May 6, 1997, as presented.
Public Hearing

Chairman Roberge read the agenda item into the record as lollows:
"Public Hearing - Consider a Request by Mr. Mark Beaty for a Special Exception to Section
3 01(AA) at 205 S. Cedar in the Old Donation, City of Allen, Collin County, Texas, to allow a
exception to the requirement for masonry exterior."
Sally Leeper, Administrative Assistant, administered the following oath to persons listed below who
intended to testify during the hearing. Each of you do solemnly swear or affirm that the testimony you
shall present in this proceeding shall be the truth and nothing but the truth, so help you God.

Mr. Bret McCullough presented the request to the Board He reviewed Section 3.01 of the
Comprehensive Zoning Ordinance with regard to the requirements of the Central Business District for
masonry construction materials. The Ordinance allows a variance to this requirement where the Board
feels there is significant need for preservation based on age and design.
Chairman Roberge opened the public hearing.
Mr. Mark Beaty discussed the request. He noted that he has lived in Allen his entire life. His family
moved to Allen about the time this structure was moved to its present location. He feels this project
would compliment the downtown area. He indicated that he works for the Allen Fire Department and
also has an appraisal business He referred to the information that was provided to the Board Members
which includes research completed by himself. The house is styled as a "bungalow" and built in the
1920's. It was moved from Dallas (Vickery Street) to Plano and then to Allen. This "bungalow" style
was no longer built after the 1930's. He feels there is a need to preserve the house since this style is not
built any longer. He feels this variance would benefit the property and the downtown ara He plans to
remodel the house completely. He plans to install a new roof, new electrical wiring, etc. The house is
built with hardwood Boors which will be refinished. He intends to use this structure as an office
building. Mr. Beaty added that if the variance is not granted, he plans to maintain the building, but cover
it with stucco. He provided photographs of houses in Dallas that were constructed in the same timeframe
in the "bungalow" style.
Ms Sally Leeper read a letter into the record from Mr. Harold Walker, current owner of the property It
is attached hereto and made a part hereof.
With no one else wishing to speak for or against the request, Chairman Roberge closed the public
hearing.
Board Member Clay questioned whether a portion of the structure had been added at a later date. Mr.
Beaty indicated it was possible, but he was not sure. He noted that the front area was originally screened
in as a porch. He noted that his intent is to leave the front porch open.
Chairman Roberge questioned whether historical registration with the State was being considered, and
Mr. Beaty indicated he would researching this possibility
Board Member Clay questioned Bret McCullough as to problems associated with remodeling the
structure, and Mr. McCullough indicated that he has discussed these issues with Mr. Beaty, and would be
requesting an engineer's certification of the foundation. He indicated no other problems with renovation.
Mr. Beaty indicated he intends to use this structure as an office budding, possibly for his personal
business, but he may lease space to others also.
Board Member Cocking questioned whether other "bungalow" style homes are located in Allen, and it
was noted that there are probably not any others. Mr. Beaty indicated that the lot is approximately
11,000 square feet in size He also noted that the assessment placed on this property for McDermott
construction will be paid with the sale of this property

MOTION Upon a motion by Board Member Engle and a second by Board Member Cocking, The
Board 4 FOR and 0 OPPOSED to approve the request by Mr. Mark Beaty and Mr.
Harold Walker for special exception to the masonry requirement for property located at
205 S. Cedar, Allen, Texas, and that this action be accomplished by resolution and such
resolution should be considered adopted, and the chairman of this board is hereby
authorized to sign such resolution.
FINDINGS.
I Age was important because the house was built in the 1920's.
2. There is a unique and significant architecture demonstrated as a "bungalow" type structure.
3 It is important to preserve the historical value of the property
4. This location allows a good reflection in the City
5. This property, in its remodeled state, will add character and viability to the Central Business
District
OTHER BUSINESS:
None.
ADJOURN:
MOTION Upon a motion by Board Member Clay and a second by Board Member Cocking, the
Board voted 4 FOR and 0 OPPOSED to adjourn the January 6, 1998, meeting at 8:00
p.m.

Re: Hearing with Board of Adjustments, concerning the house located at 205 South
Cedar, Allen, TX.
Dear Mr. Petty
Concerning the above referenced property, I am requesting a hearing before the Board
of Adjustments. The purpose of this hearing is for their consideration of waiving the
requirement for masonry on the building if it is converted to a commercial facility. It is
my understanding and belief that this house has historical significance. Mark Beaty will
present evidence of the property's age and unique architecture at the hearing. Once the
sale of the house is completed from myself to Mr. Beaty, he plans to completely remodel
it to its original state and to use it for professional class office space. The house will
remain as residential until this sale is complete. It is my belief that the property will be
an asset to the downtown area in its remodeled state. Thank you for considering this
matter
