CITY OF ALLEN ORDINANCE NO. 185
"AN ORDINANCE ALTERING THE PRIMA FACIE SPEED LIMITS
FOR VEHICLES UNDER THE PROVISIONS OF SECTION 169a
OF ARTICLE 6701d OF VERNON'S CIVIL STATUTES UPON
F. M. HIGHWAY NO. 2170 WITHIN THE CORPORATE LIMITS
OF ALLEN; ESTABLISHING A SCHOOL ZONE AT ALLEN
ELEMENTARY SCHOOL AND ALLEN HIGH SCHOOL; DEFINING
TERMS; DESIGNATING BOUNDARIES; REGULATING VEHICULAR
TRAFFIC; PROVIDING FOR INSTALLATION OF SIGNS AND
MARKINGS; PROVIDING FOR PENALTY; REPEALING ORDINANCES
IN CONFLICT HEREWITH; PROVIDING FOR PUBLICATION OF
THE CAPTION HEREOF; AND PROVIDING FOR AN EFFECTIVE
DATE."
WHEREAS, Section 169a of Article 6701d of Vernon's
Texas Civil Statutes provides that whenever the governing
body of the City shall determine upon the basis of an
engineering and traffic investigation that prima facie
speed therein set forth is greater or less than is reasonable
or safe under the conditions found to exist at any intersection
or other place or upon any part of a street or highway within
the City, taking into consideration the width and condition of
the pavement and other circumstances on such portion of said
street or highway, as well as the usual traffic thereon, said
governing body may determine and declare a reasonable and safe
prima facie speed limit thereat or thereon by the passage of
an ordinance, which shall be effective when appropriate signs
giving notice thereof are erected at such intersection or other
place or part of the street or highway.
WHEREAS, the continued growth of school attendance and .
the increase of vehicular and pedestrian traffic on city
streets and rights-of-way surrounding the schools in the City
of Allen; and
WHEREAS, the congestion created by this condition becomes
more hazardous to those people who travel through and within
these area; and

NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL
OF THE CITY OF ALLEN, TEXAS:
SECTION ONE:
Upon the basis of an engineering and traffic investigation
heretofore made as required and authorized by the provisions
of Section 169a of Article 6701d, Vernons Texas Civil Statutes,
the following speed districts are established and the following
prima facie speed limits for vehicles are hereby declared to
be reasonable and safe and such speed ' limits are hereby fixed
at the rate of speed as set forth within this ordinance.
SECTION TWO:
"School Zone" shall mean that Public Street Right -of -:Tay
around Allen Elementary School and Allen High School as described
by Metes and Bounds in Section 3 of this ordinance.
"Speed Limit" shall mean the maximum speed of vehicular
traffic within the boundary of the speed zone.
"School Days" shall mean Monday through Friday during
regular school terms, during the year.
SECTION THREE:
That the boundaries of Allen Elementary School and Allen
High School shall be, to -wit:
BEGINNING at a point in the south right-of-way of F. M.
2170, which point is the intersection of the south right-of-way
line of F. M. 2170 with the east right-of-way line of Greeting
Gate Lane;
THENCE in a Westerly direction along the South right-of-way
line of F. M. 2170 to a point, which point is in the intersection
of the South right-of-way line of F. M. 7120 and the East right-
of-way line of State Highway 5;
THENCE in a Northerly direction along the East right-of-way
line of Highway 5 to its junction with the North right-of-way
line of F. M. 2170;
THENCE in a Easterly direction along the North right-of-way
line of F. M. 2170 to a point which point is in the intersection
of the East right-of-way line of Greeting Gate Lane and the North
right-of-way line of F. M. 2170;
THENCE in a Southerly direction to the South right-of-way
line of F. M. 2170 to the place of beginning.
SECTION FOUR:
The speed limit for vehicles traveling the streets within
this school zone, during the hours of 7:00 to 9:00 a.m. and
2:00 to 4:00 p.m. school days shall be 20 miles per hour
maximum. Signs clearly designating this speed limit shall be
installed and maintained at the beginning of the school zone
on each street entering the school zone. A sign, which
designates the end of the school zone, shall be installed and
maintained on each street leading away from the school zone.
SECTION FIVE:
All provisions of any ordinance in conflict herewith are
hereby repealed so far only as it affects that portion described
herein.
SECTION SIX:
Any person who violates any provisions of this ordinance
shall be deemed guilty of a misdemeanor, and upon conviction
thereof shall be fined any sum not exceeding two hundred
dollars ($200.00).
SECTION SEVEN:
If any section, subsection, paragraph, sentence, phrase,
or clause of this ordinance shall be declared invalid for any
reason whatsoever, such decision shall not affect the remaining
portions of this ordinance which shall remain in full force and
effect; and to this end the provisions of this ordinance are
hereby declared to be severable.
SECTION EIGHT:
The caption of this ordinance shall be published one (1)
time in a newspaper having general circulation in the City of

Allen and shall be effective immediately upon its passage
and publication.
