CITY OF ALLEN, TEXAS; ORDINANCE NO., 198
AN ORDINANCE AMENDING GENERAL ZONING ORDINANCE NO. 129
OF THE CITY OF ALLEN, TEXAS, BY THE ADDITION OF A CLAUSE
FOR A FENCING PERMIT TO SECTION 3-2 BUILDING PERMITS AND
BY THE ADDITION OF A CLAUSE FORA FENCING FEE TO SECTION
3-3 EXPENSES AND FEES; PROVIDING FOR A PENALTY FOR A
VIOLATION OF THIS ORDINANCE; PROVIDING FOR AN EFFECTIVE
DATE OF THIS ORDINANCE; AND PROVIDING FOR THE CAPTION
HEREOF.
WHEREAS, in order to insure that all new construction
and use of all existing and new structures and the use of
land shall comply with the terms of the General Zoning
Ordinance of the City of Allen, Texas; and
WHEREAS, the laws of the State of Texas authorize
the governing bodies of cities to promote the efficient use
of land by zoning;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL,
CITY OF ALLEN,, TEXAS:
SECTION 1: That from and after the effective date
of this Ordinance, Section 3-2 "Building Permits" of Ordinance
No. 129 is hereby amended by the addition of the following
clause, to -wit:
Section 3-2 "Building Permits" Subsection A. - Every
application for a fencing permit shall be accompanied by
such information as may be necessary to provide for the
enforcement of the Zoning Ordinance. .A oareful record of
the original copy of the application shall be kept in the
office of the zoning official and a duplicate copy shall be
at the building at all times during construction of the fence.
SECTION 2: That from and after the effective date of
this Ordinance, Section 3-3 "Expenses and Fees" of Ordinance
No. 129 is hereby amended by the addition of the following

clause, to -wit:
Section 3-3 "Expenses and Fees" - The Council shall
adopt a schedule of fees commensurate with the cost incurred
in processing an application for a fencing permit with a
minimum fee of $5.00.
SECT ION 3. Any person, firm or corporation who
violates any provision of this Ordinance shall be deemed
guilty of a misdemeanor, and upon conviction therefor, shall
be fined any sum not exceeding $200.00, and each and every
day that such violation continues shall be considered a
separate offense; provided, however, that such penal provision
shall not preclude a suit to enjoin such violation.
SECTION 4: The caption of this Ordinance shall be
published one time in a weekly newspaper published in the
City of Allen, and shall be effective immediately upon its
passage and publication.
