AN ORDINANCE OF THE CITY OF ALLEN, TEXAS, AMENDING
ORDINANCE NO. 193 OF THE CITY OF ALLEN, TEXAS;
PROVIDING FOR AN AMENDED FEE SCHEDULE FOR SEWER
SERVICES; AND PROVIDING A SEVERABILITY CLAUSE AND
AN EFFECTIVE DATE.
WHEREAS, a sewer rate study has been presented to the
Allen City Council which indicates that net revenues to the
water and sewer fund, under the present rate structure, will
not be sufficient to produce the revenues needed to finance
proposed and necessary improvements to the sewer system and
to finance the increasing costs of operating the sewer system;
and,
WHEREAS, the Allen City Council desires to comply with
the applicable provisions of the laws, rules and regulations
of State and Federal Agencies pertaining to the establishment
of rate schedules; and,
WHEREAS, after due consideration, the City Council of
the City of Allen, Texas, has determined that the public
welfare would be best served by amending the present sewer
rate structure to insure that the sewer system will be
adequately financed;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF
THE CITY OF ALLEN, TEXAS, THAT:
SECTION I:
Section 1

is hereby amended
to
read as
follows:
From and after the effective date of this Ordinance,
sewer charges to apply to each separately metered dwelling
unit for all single family and duplex residential
connections, all mobile home parks or apartment complexes,

and all commercial and industrial customers shall be
as follows:

Industrial
Should any customer use water that is not discharged into
the sanitary sewer systems, such customer may, at its owner
expense, install a separate water meter for such use, and the
volume of water so used shall not be considered in calculating
monthly sewer rates.
Should any industrial customer discharge sewage at a
maximum rate greater than two times its average annual rate,
the industrial cost recovery rate shall be adjusted using
the peak rate as the demand rate for reserved capacities in
the sanitary sewer collection and treatment system.
SECTION II: That if any paragraph, section, clause, phrase
or provision of this Ordinance shall be adjudged invalid or
held unconstitutional, the same shall not effect the validity
of this Ordinance as a whole or any part or provision thereof
other than the part so decided to be invalid or unconstitutional.
SECTION III•
This Ordinance, and all rates established
herein, shall become effective on December 1 ,
1977.
