CITY OF ALLEN, TEXAS, ORDINANCE NO. 23Q
AN ORDINANCE MAKING IT UNLAWFUL TO LEAVE, PARK OR
STAND ANY TRUCK -TRACTOR, ROAD -TRACTOR, SEMI -TRAILER,
BUS, TRUCK OR TRAILER WITH READY CAPACITY IN EXCESS
OF ONE TON UPON PROPERTY, STREET, HIGHWAY OR ALLEY
WITHIN AREAS ZONED RESIDENTIAL DISTRICT ACCORDING
TO THE ZONING ORDINANCE OF THE CITY; PROVIDING
EXCEPTION; DECLARING A PUBLIC NUISANCE; PROVIDING
FOR INJUNCTIVE RELIEF; PROVIDING FOR A PENALTY;
PROVIDING FOR PUBLICATION AND AN EFFECTIVE_ DATE
HEREOF.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ALLEN,
TEXAS:
SECTION I: It shall be unhawful for any person or any
owner to leave, park or stand any truck -tractor, road -tractor,
semi -trailer, bus, truck or trailer with a ready capacity
in excess of one ton according to the manufacturer's
classifications upon property, streets, highways or alleys
zoned as Residential District according to the zoning ordinance
of the City of Allen.
SECTION II: This Ordinance shall not apply and shall
not prevent the parking or standing of the above described
vehicles in residential zoned areas for the purpose of
expeditiously loading and unloading passengers, freight or
merchandise, but not otherwise.
SECTION III: The presence of any of the above described
vehicles in violation of this Ordinance is hereby declared
to be a public nuisance. Not withstanding any penal provision
afforded in this Ordinance, the City Attorney is authorized
to file suit on behalf of the City of Allen for such
injunctive relief as may be necessary to prevent the violation
of any provisions of this Ordinance.
SECTION IV: Any person who violates any provision of
this Ordinance shall be deemed guilty of a misdemeanor, and
upon conviction therefor, shall be fined any sum not
exceeding $200.00. Each and every day that a violation
continues shall be considered a separate offense.
SECTION V: The caption of this Ordinance shall be
published one time in a newspaper having general circulation
in the City of Allen, Texas, and such Ordinance shall be
effective immediately upon its adoption and publication
and it is so ordered.
