Call to Order and Announce a Quorum is Present With a quorum of the Councilmembers present, the Regular Meeting of the Allen City Council was called to order by Mayor Pro Tern Caplinger at 7:04 p.m. on Tuesday, February 11, 2020, in the Council Chambers of the Allen City Hall,305 Century Parkway,Allen,Texas. Consent Agenda MOTION: Upon a motion made by Councilmember Doherty and a second by Councilmember Clemencich, the Council voted six (6) for and none (0) opposed to adopt all items on the Consent Agenda as follows: 3. Approve Minutes of the January 28,2020,Regular City Council Meeting. 4. Approve Minutes of the February 1,2020,Special Called City Council Workshop. 5. Adopt a Resolution Ordering the May 2,2020,Joint Election and Authorize the City Manager to Enter into a Joint General Election Services Contract with the Elections Administrator of Collin County. RESOLUTION 3731-2-20(R): A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ALLEN,COLLIN COUNTY,TEXAS,ORDERING A JOINT GENERAL ELECTION TO BE HELD ON MAY 2, 2020, FOR THE PURPOSE OF ELECTING THE MAYOR AND CITY COUNCILMEMBER FOR PLACE NO. 2; DESIGNATING LOCATION OF POLLING PLACES; ORDERING NOTICE OF ELECTION TO BE GIVEN AS PRESCRIBED BY LAW IN CONNECTION WITH SUCH ELECTION; AUTHORIZING EXECUTION OF JOINT ELECTION AGREEMENT; AND PROVIDING FOR AN EFFECTIVE DATE. 6. Authorize the City Manager to Execute a Contract with Intermountain Slurry Seal,Inc.,through an Interlocal Agreement with North Richland Hills for the Microsurfacing of the Hillside Water and Sanitary Sewer Rehabilitation—Phase II in the Amount of$138,673. Authorize the City Manager to Execute a Purchase and Subscription Agreement with Vigilant Solutions, LLC, as the Sole Source Provider for 30 Automated License Plate Reader (ALPR) hardware,Software and Professional Services Over a 7-Year Period in the Amount of$564,860. MOTION: Upon a motion by Councilmember Clemencich and a second by Councilmember Brooks, the Council voted six (6) for and none (0) opposed to authorize the City Manager to execute a purchase and subscription agreement with Vigilant Solutions,LLC,as the sole provider for 30 automated license plate reader hardware, software and professional services over a 7-year period in the amount of$564,860.The motion carried. Conduct a Public Hearing and Adopt an Ordinance to Establish a Planned Development Zoning District with a Base Zoning of Mixed Use "MIX" and Adopt Development Regulations, Zoning Exhibit,Concept Plan,Street Sections,Open Space Plan,Ridgeview Drive Conceptual Landscape Plan, and Character Plan for a Property Generally Located North of Ridgeview Drive, West of Alma Drive, and South of State Highway 121. [The Avenue—Mixed Use] Mayor Pro Tern Caplinger opened the public hearing and asked anyone wishing to speak for or against this item to do so at this time. The following individual spoke neither in favor or in opposition to the item: Fawaz Bham, 1606 Alamosa Drive,Allen,Texas. With no one else speaking,Mayor Pro Tem Caplinger closed the public hearing. ORDINANCE NO. 3732-2-20: AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF ALLEN, COLLIN COUNTY,TEXAS,AMENDING THE ALLEN LAND DEVELOPMENT CODE ZONING REGULATIONS AND ZONING MAP,AS PREVIOUSLY AMENDED, BY CHANGING THE ZONING REGULATIONS RELATING TO THE DEVELOPMENT AND USE OF A 79.285± ACRE TRACT OF LAND SITUATED IN THE JAMES W. PARSONS SURVEY, ABSTRACT NUMBER 705, THOMAS PHILIPS SURVEY,ABSTRACT NUMBER 717,AND JOHN PHILIPS SURVEY, ABSTRACT NUMBER 718, DESCRIBED IN EXHIBIT "A" HERETO FROM CORRIDOR COMMERCIAL "CC," PLANNED DEVELOPMENT NO. 72, AND PLANNED DEVELOPMENT NO.98 TO PLANNED DEVELOPMENT NO. 142("PD-142")FOR MIXED USE; ADOPTING DEVELOPMENT REGULATIONS;PROVIDING FORA CONFLICTS RESOLUTION CLAUSE; PROVIDING A SEVERABILITY CLAUSE; PROVIDING A SAVINGS CLAUSE; PROVIDING A PENALTY OF FINE NOT TO EXCEED THE SUM OF TWO THOUSAND DOLLARS ($2,000)FOR EACH OFFENSE;AND PROVIDING AN EFFECTIVE DATE. MOTION: Upon a motion by Councilmember Schulmeister and a second by Councilmember Brooks,the Council voted six (6) for and none (0) opposed to adopt Ordinance No. 3732-2-20, as previously captioned,to establish Planned Development PD No. 142 with a base zoning Mixed Use "MIX" and adopt Development Regulations, Zoning Exhibit, Concept Plan, Street Sections,Open Space Plan,Ridgeview Drive Conceptual Landscape Plan,and Character Area Plan, and adding primary façade treatments on blocks D, G, I, and P, and a single row of parking on Alma Drive for a property generally located north of Ridgeview Drive, west of Alma Drive,and south of State Highway 121.The motion carried. Personnel Pursuant to Section 551.074 of the Texas Government Code— Performance Review of the City Manager. The Executive Session adjourned at 8:53 p.m.on Tuesday,February 11,2020. 12. Reconvene and Consider Action on Items Resulting from Executive Session. The Allen City Council reconvened into the Regular Meeting at 8:55 p.m.on Tuesday,February 11,2020.The following action was taken on items discussed during the Executive Session. MOTION: Upon a motion made by Councilmember Doherty and a second by Councilmember Kizer,the Council voted six(6) for and none(0) opposed to increase the City Manager's base salary to $230,000 beginning the next pay period.The motion carried.
