AN ORDINANCE OF THE CITY OF ALLEN, TEXAS, ESTABLISHING THE
PARKS AND RECREATION BOARD; SETTING THE MEMBERSHIP AT FIVE (5}
PROVIDING THE QUALIFICATIONS OF THE MEMBERS; PROVIDING THE
OFFICERS OF THE BOARD; ESTABLISHING THE POWERS AND DUTIES OF THE
BOARD; AND DECLARING THE EFFECTIVE DATE OF THIS ORDINANCE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ALLEN, TEXAS:
SECTION 1: SHORT TITLE: This Ordinance shall be commonly known and cited
as the Park and Recreation Ordinance in compliance with the City Charter, Article III, Section
3.05 D.
SECTION 2: DEFINITIONS: For the purpose of this Ordinance, the following
terms, phrases, words, and their derivations shall have the meaning given herein. When not
inconsistent with the context, words used in the present tense include the future. Words in the
plural number include the singular number, and words in the singular number include the plural
number. The word "shall" is always mandatory and not merely directory.
A. "City" is the City of Allen, Texas.
B. "Director" is a person so designated and in charge of the Park and Recreational
Department.
C. "Park" is a park, reservation, playground, recreation center, or any other area in
the City owned or used by the City, and devoted to active or passive recreation,
including all planted expressways, parkways, triangles and traffic circles
maintained by the City, except the parkway strips between curb and sidewalks
along the several streets and highways of the City.
D. "Person" is any person, firm, partnership, corporation, association, company or
organization of any kind.
E. "Vehicle" means every device in, or by which any person or property is or may be
transported or drawn upon a public highway, except devices moved only by human
power or used exclusively upon stationary rails or tracks.
SECTION 3: ESTABLISHMENT OF PARKS AND RECREATION BOARD: A Parks
and Recreation Advisory Board consisting of five (5) active members is hereby established as
follows:
A. Members shall be qualified voters of the City of Allen.
B. Members shall serve without compensation.
C. Members terms will be two (2) years, but members shall not continuously serve for
a period in excess of six (6) years.
D. If a replacement has not qualified upon the expiration of a member's term, then
that member shall continue his membership until replaced.
E. The Parks and Recreation Board shall annually elect a Chairman, Vice -Chairman,
and Secretary.
Chairman: The Chairman shall preside over meetings and shall be entitled
to vote upon each issue. In the event a question over procedure
arises, Robert's Rules of Order shall prevail.
Vice -Chairman: The Vice -Chairman shall assist the Chairman in directing the
affairs of the Advisory Board. In the absence of the Chairman,
the Vice -Chairman shall assume all duties of the Chairman.
Secretary: The Secretary shall keep the minutes of all meetings and in the
Secretary's absence, the Chairman shall designate another
member to act as Secretary. The Secretary shall read once a
year, at the first regular meeting following the appointment of
officers, the Parks and Recreation Ordinance. The Secretary
may accept the assistance of City personnel in taking and
transcribing minutes, when available, but shall sign same
officially before presenting same to the Board for approval.
F. The Director of Parks and Recreation shall be an ex officio member of the Board,
with the responsibility to participate in discussions but without the right to vote.
G. Absence from three consecutive meetings without formal consent of the Board
shall be deemed to constitute the retirement of that member and shall be
'certified by the Chairman to the council.
SECTION 4: POWERS AND DUTIES: The Parks and Recreation Board shall have
the following powers and perform the following duties:
A. It shall act principally in an advisory capacity to the City staff and the City
Council in all matters pertaining to Parks and Recreation, shall acquaint itself
with and make a continuous study and review of the complete Parks and
Recreation services of the City; and shall advise with the staff and City Council
from time to time as to the present and future maintenance, operation, planning,
acquisition, development, enlargement, and use policies of the City Park and
Recreation services.
B. It shall study and encourage the development of Parks and Recreation areas and
study and encourage the development of wholesome recreation for all residents of
the City of Allen.
C. It shall advise with the Parks and Recreation Director on problems of
development of recreation areas, facilities, programs, and improved recreation
services.
D. It shall recommend the adoption of standards on areas, facilities, program and
financial support.
E. The members of the Board shall study and rview the master planning guide for
parks and recreation and become familiar with such plan and its relation to
existing and proposed facilities and shall become aware of any revision or
updating thereof.
F. It shall advise and rcommend to the Parks and Recreation Director on the
development of long-range capital improvement programs and, when in its opinion
the need exists for additional park and recreational facilities, grounds, or
premises, it shall make appropriate recommendations to the City Council. It shall
also recommend the acquisition of additional parks, park and recreational
equipment, and supplies.
G. It shall develop for council review the rules and regulations as may be prescribed
by the City Council for the conduct of its business.
H. It shall develop for council review rules and regulations and policies governing the
use of park and recreational facilities.
I. It shall make any other recommendations to the City Council regarding park and
recreation matters that it considers advisable.
J. It may solicit for the City of Allen gifts, revenues, bequests, or endowments of
money or property as donations or grants from persons, firms or corporations,
subject to the approval and acceptance by the City Council.
K. It may, from time to time, recommend to the City Council amendments or
changes to this Ordinance.
L. The Board, through its Chairman, shall make both an oral and written report
annually to the City Council concerning its activities during the past year and its
proposals for the coming year.
M. The Board's authority shall not extend to the direction, supervision, employment,
or termination of employees of the Parks and Recreation Department. No
supervisory power of the Board is created.
N. It shall develop written policies and procedures for the Parks and Recreation
Director to follow in the conduct of all recreational activities.
O. The Board will review the proposed budget for the Parks and Recreation
Department and make any recommendations to the council it deems necessary.
However, the Board is not authorized to add, delete or change in any way the
budget as prepared by the Parks and Recreation staff.
P. The Board will develop for council approval a set of by-laws governing rules of
procedure for their meetings and operation.
Q. The Board shall not have the power to obligate the City for any funds or
expenditures or incur any debt on behalf of the City.

R. All powers and duties prescribed and delegated herein are deleated to the Board
as a unit and all action hereunder shall be of the Board acting as a whole. No
action of an individual member is authorized except through the Board.
SECTION 5: PROCEDURE: The procedures of the Parks and Recreation Board
are as set out below:
A. Meetings
(1) Regular Meetings: The Parks and Recreation Board shall meet on the
fourth Thursday of each month in a public place with public notice as
prescribed by law.
(2) Special Meetings: Special meetings maybe called by the Chairman or by
written request sent to the Chairman or Vice -Chairman by three (3)
members of the Board.
(3) All meetings shall be open to the public in accordance with the Open
Meeting Statute Article 6257-17, V.A.C.S.
B. Voting
All questions presented for vote of the Parks and Recreation Board shall be
decided by a simple majority, of those voting members present. Only those
voting members present can vote.
SECTION 6: The caption of this Ordinance shall be published at least twice in the
official newspaper of the City,` stating in summary the purpose of this Ordinance and the
penalty for violation hereof, and shall be effective immediately upon its passage and such
publication.
