AN ORDINANCE PROVIDING FOR OUTSIDE WATERING AND LANDSCAPE
IRRIGATION; REPEALING ORDINANCE #307; DECLARING AN EMERGENCY;
PROVIDING AN EFFECTIVE DATE; PROVIDING A PENALTY FOR THE
VIOLATION HEREOF; PROVIDING FOR FOR SEVERABILITY AND PUBLICATION
OF THE CAPTION HEREOF
WHEREAS, extreme weather conditions have generated unprecedented
demands on area watering storage capabilities; and,
WHEREAS, the North Texas Municipal Water District has instituted
a fifteen (150) curtailment on water availability
NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
ALLEN, TEXAS:
Section 1. That any sprinkler, soaker hose, sprinkler system, or
any automated or mechanical sprinkling or irrigating
device is prohibited within the city limits of the City
of Allen, Texas except between the hours of 2:00 a.m.
and 4:00 a.m. Said prohibition of said sprinkler and
irrigation system shall be enforced by the City Manager
or employees so assigned.
Section 2. Nothing in this Ordinance shall prohibit the watering of
shrubs, trees and building foundations by the use of hand
held devices so long as the device is hand operated.
Section 3. Ordinance #307 restricting outside watering and irrigation
during certain hours is hereby fully repealed.
Section 4. That the public interest in maintaining adequate water
storage for fire protection necessitate that an emergency
be declared and that the Ordinance shall become effective
immediately upon passage.
Section 5. That the penalty for violation of this Ordinance shall be
between $5.00 and $200.00 per violation occurance.
Section 6. If any section, sub -section, sentence, clause, or other
portion of this Ordinance is found to be invalid by any
competent regulatory agency, the remaining portions of
this Ordinance are declared to be severable and shall
remain in full force and effect.
Section 7. The caption of this Ordinance shall be published two times
in a weekly newspaper published in the City of Allen,
Texas, and shall be effective immediately upon its passage.
