AN ORDINANCE PROVIDING FOR OUTSIDE WATERING AND LANDSCAPE
IRRIGATION; DECLARING AN EMERGENCY; PROVIDING FOR AN EFFECTIVE
DATE; PROVIDING A PENALTY FOR THE VIOLATION HEREOF; PROVIDING
FOR SEVERABILITY AND PUBLICATION OF THE CAPTION HEREOF
WHEREAS, extreme weather conditions have generated unprecendented
demands on area watering storage capabilities; and
WHEREAS, the North Texas Municipal Water District has instituted a
(150) curtailment on water availability; and
WHEREAS, it is the intention of the City Council of the City of Allen
to allow the use of outside sprinkler and irrigation systems
to the extent that those outside uses do not cause a depletion
of reserves to the extent that it jeopardises the City's
ability to provide fire fighting capabilities and to respond
to other emergencies as they may arise. -
NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ALLEN,
TEXAS:
Section 1. That outside watering and landscape irrigation shall be
prohibited between the hours of 12:00 Midnight and 8:00 p.m.
each day with said time of usage prohibition to be enforced
by the City Manager or employees so assigned.
Section 2. Ordinance #312 restricting outside watering and irrigation
during certain hours is hereby fully repealed.
Section 3. That the public interest in maintaining adequate water
storage for fire protection necessitate that an emergency
be declared and that the Ordinance shall become effective
immediately upon passage.
Section 4. That the penalty for violation of this Ordinance shall
be not greater than $200 per occurance.
Section 5. If any section, sub -section, sentence, clause, or other
portion of this Ordinance is found to be invalid by any
competent regulatory agency, the remaining portions of
this Ordinance are declared to be severable and shall
remain in full force and effect.
Section 6. The caption of this Ordinance shall be published two
times in a weekly newspaper published in the City of Allen,
Texas, and shall be effective immediately upon its passage.
