AN ORDINANCE OF THE CITY OF ALLEN, COLLIN COUNTY, TEXAS,
CREATING A PROCESS FOR THE REGISTRATION AND LICENSING OF
PLUMBING CONTRACTORS; ORDAINING OTHER MATTERS ON THE SUBJECT;
PROVIDING RULES AND REGULATIONS PERTAINING TO THE REGISTRATION
AND LICENSING PROCESS; PROVIDING PENALTIES FOR VIOLATION OF THE
ORDINANCE; PROVIDING FOR THE PUBLICATION OF THE CAPTION HEREOF;
AND PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, the Building Official has reviewed the policies and procedures, or lack
thereof, of the City of Allen, Texas, surrounding plumbing work done within the City by
plumbing contractors; and,
WHEREAS, the Building Official is of the opinion that plumbing contractors who desire
to do work in the City of Allen, Texas, should be required to register and obtain a license
therefor; and,
WHEREAS, the Building Official further recommends that the City of Allen, Texas,
create a method and process for the registering and licensing of plumbing contractors; and,
WHEREAS, the City Council has reviewed the recommendations of the Building Official
and concurs with his recommendations and opinions;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
ALLEN, TEXAS:
SECTION L• ADOPTION OF RULES AND REGULATIONS FOR THE REGISTRATION
AND LICENSING OF PLUMBING CONTRACTORS: That from and after the effective date
of this Ordinance, there is hereby adopted by the City of Allen, Texas, for the purpose of
establishing rules and regulations for the registration and licensing of plumbing contractors,
the following:
Section 1: Registration Required: A person who is not registered by the
City as a plumbing contractor may not obtain permits required for plumbing work.
Exception: (a) A building permit issued to a General
Contractor which includes plumbing work shall satisfy the permit requirement,
providing the plumbing contractor shall register with the building inspection
division and satisfy all other divisions of this Ordinance.
Section 2: Method of Registration:
(a) To register with the City of Allen to perform plumbing work
described in the codes, a person shall apply to the building inspection division
in writing on forms furnished for that purpose. The application must contain
applicant's name, local address, and telephone number, and other information
which may reasonably be required to properly identify the contractor.
(b) No person may represent himself as a registered or licensed
plumber with the City unless the person is, in fact, registered and holds a
valid state license.
Section 3: Supervision: The work of installing, maintaining, altering, or
repairing of plumbing for which a permit is required by the codes must be
supervised by a licensed master plumber as provided by the Texas Plumbing
Licensing Law. The owner of a plumbing contracting business who is not a licensed
master plumber shall have a licensed master plumber continuously in his
employment. The owner of a plumbing contracting business shall designate a
licensed master plumber to the Chief Plumbing Inspector as the person responsible
for, and supervising, the plumbing work done by the plumbing contractor. A
designated master plumber may be the supervisory plumber of only one plumbing
contractor within the City at any one time. Should supervision not be continuously
provided, the Building Official may order the work being done by a plumbing
contractor to be discontinued until proper supervision and control has been
provided and the name of the new master plumber has been submitted to the
building inspection division.
Section 4: License Required:
(a) A person who is not licensed as a plumber by the State of Texas
shall not install, alter, repair, relocate, add to, or replace a plumbing system
or supervise plumbing work in the City.
(b) Nothing in this chapter prohibits the employment of a
journeyman plumber to engage in the installation, alteration, repairing, and
renovating of plumbing, or the employment of a plumber's apprentice who, as
his principal occupation, is engaged in the learning of and assisting in the
installation of plumbing, or the employment of unskilled laborers to handle
materials when working under the immediate supervision of a master
plumber.
Section 5: Display of License:
(a) Each holder of a license as a master plumber shall display his
license in a conspicuous place in his principal place of business.
(b) Each holder of a master or journeyman plumber's license shall
carry a card on his person at all times while engaged in plumbing work which
identifies him as the holder of a license and shall produce and exhibit this
card when requested by an inspector or officer of the City.
SECTION II: PENALTIES FOR VIOLATION: From and after the effective date of
this Ordinance, any person, firm or corporation violating any rule or regulation pertaining to
this Ordinance shall be penalized as follows:
(a) Any person, parties in interest, or corporation who shall violate
any of the provisions of this Ordinance or fail to comply therewith or with
any of the requirements thereof shall be subject to a misdemeanor
prosecution and upon conviction shall be punished by a fine of not less than
Five Dollars ($5.00) nor more than Two Hundred Dollars ($200.00), and each
day that such violation shall be permitted to exist or continue shall constitute
a separate offense.
(b) In the event a corporation is the violator of any of the
provisions of this Ordinance, each officer, agent and employee of such
corporation who is responsible for or contributes to such violation in any
manner shall be individually and severally liable for the penalties herein
prescribed. Where any person is acting solely as agent for the party in
ownership, no penalties under this section shall be assessed against such agent
as such.
(c) Conviction under the provisions of this Ordinance shall be
deemed just cause for the revocation of any license which said person, firm,
or corporation or association may have and/or hold under the provisions of
this Ordinance or any ordinance of the City of Allen dealing with the issuance
of licenses which relate to the codes adopted herein.
(d) In addition to the penal remedies herein, the City Attorney
shall, upon the direction of the City Manager, institute any appropriate
action or proceeding, including actions for injunction to prevent, restrain,
correct or abate any act, conduct, work, business, practice, or use which is a
violation of and illegal under this Ordinance.
SECTION III- VALIDITY CLAUSE: If for any reason, any section, paragraph,
subdivision, clause, phrase, or provision of this Code shall be held invalid, it shall not affect
any valid provision of this or any Code of the City of Allen to which these rules and
regulations relate.
SECTION IV: PUBLICATION AND EFFECTIVE DATE: The caption of this
Ordinance shall be published one (1) time in a weekly newspaper published in the City of Allen,
and shall be effective immediately upon its passage and publication.
