AN ORDINANCE OF THE CITY OF ALLEN, COLLIN COUNTY, TEXAS,
AMENDING THE COMPREHENSIVE ZONING ORDINANCE OF THE CITY OF
ALLEN, AS HERETOFORE AMENDED, SO AS TO ESTABLISH PERMANENT
ZONING ON THE FOLLOWING -DESCRIBED TRACT OF LAND BY CHANGING
SAME FROM "R-2" RESIDENTIAL PLANNED DEVELOPMENT TO "GIPD"
GENERAL INDUSTRIAL PLANNED DEVELOPMENT, SAID TRACT OF LAND
BEING DESCRIBED AS FOLLOWS: APPROXIMATELY 16 ACRES OF LAND, MORE
OR LESS, OUT OF THE THOMAS G. KENNEDY SURVEY, ABSTRACT NO. 500, THE
JAMISON McBAIN SURVEY, ABSTRACT NO. 491, AND THE RUFUS SEWELL
SURVEY, ABSTRACT NO. 875, COLLIN COUNTY, TEXAS; PROVIDING FOR A
PENALTY OF FINE NOT TO EXCEED THE SUM OF TWO HUNDRED DOLLARS
(#200.00) FOR EACH OFFENSE; AND DECLARING AN EMERGENCY.
WHEREAS, the City Zoning Commission of the City of Allen, and the governing body of
the City of Allen, in compliance with the laws of the State of Texas and the ordinances of the
City of Allen, have given the requisite notices by publication and otherwise, and after holding
due hearings and affording a full and fair hearing to all the property owners generally and to all
persons interested and situated in the affected area and in the vicinity thereof, and in the
exercise of its legislative discretion, have concluded that the Comprehensive Zoning Ordinance
should be amended; NOW, THEREFORE,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ALLEN, TEXAS:-
SECTION
EXAS
SECTION 1. That the Comprehensive Zoning Ordinance of the City of Allen, Texas, as
heretofore amended, be and the same is hereby amended by amending the Zoning Map of the City
of Allen to give the following -described tract of land the following zoning classification, to -wit:
That the area be and the same is hereby zoned as "GIPD" General Industrial Planned
Development:
See Exhibit A attached hereto and made a part hereof for all purposes.
SECTION 2. That all ordinances of the City of Allen in conflict with the provisions of
this ordinance be, and the same are hereby, repealed and all other provisions of said ordinance
shall remain in full force and effect.
SECTION 3. That the above-described tract of land shall be used in the manner and for
the purposes provided for by the Comprehensive Zoning Ordinance of the City of Allen, as
heretofore amended, and as amended herein by granting of this zoning classification.
SECTION 4. That any person, firm or corporation violating any of the provisions or
terms of this ordinance shall be subject to the same penalty as provided for in the
Comprehensive Zoning Ordinance of the City of Allen, as heretofore amended, and upon
conviction shall be punished by a fine not to exceed the sum of Two Hundred Dollars ($200.00)
for each offense.
SECTION 5. Whereas, it appears that the above-described property requires that it be
given the above zoning classification in order to permit its proper development and, in order to
protect the public interest, comfort and general welfare of the City of Allen, creates an urgency
and an emergency for the preservation of the public health, safety and welfare, and requires that
this ordinance shall take effect immediately from and after its passage and the publication of
the caption of said ordiance, as the law in such cases provides.

SITUATED in Collin County, Texas, South of the Town of Allen, in the
Thomas G. Kennedy Survey, Abstract No. 500 and in the Jamison McBain
Survey, Abstract No. 491 and in the Rufus Sewell Survey, Abstract No.
875, being a resurvey of part of the 45.25 acre Second Tract, and part
of the 4.42 acre First Tract described in a deed from C. A. Fouts, et
ux, Marcia to H. L. Drumwright dated June 7, 1937 and recorded in Vol.
312, Page 488 of the Collin County Deed Records; and, all of the 6.47
acres described in a deed from Texas Electric Railway Company to H. L.
Drumwright dated July 6, 1949 and recorded in Vol. 404, Page 18 of the
Collin County Deed Records and being described by metes and bounds as
follows:
COMMENCING at a point in the center of U. S. Hwy. No. 75 at the North end
of the main bridge over Rowlett Greek for both the Northbound and South-
bound lanes of said highway, same being at Engineers Station 344 + 66.5;
THENCE North 18° 41' East 1037.2 feet with the centerline of said highway
to the P.C. of a curve to the left; THENCE South 71° 19' East 180.0 feet
to an iron pin set on the South side of a R.O.W. marker in the East R.O.W.
line of said U. S. Hwy. No. 75 for a PLACE OF BEGINNING;
THENCE Northerly with said East R.O.W. line as follows:
North 18° 41' East 600.0 feet; North 1° 37' 30" West 156.85 feet;
North 530 25' 30" East 77.98 feet; North 14° 37' 30" East 32.77
feet to an iron pin set in the center of a gravel road from the
East for a corner;
THENCE Easterly with the center of said gravel road as follows:
South 87° 47' East 130.0 feet; South 85° 32' East 229.48 feet
to an iron pin set in the West R.O.W. line of the Southern
Pacific Transportation Company Houston -Denison Main Line of
Railroad for a corner;
THENCE Southerly with said West R.O.W. line as follows:
South 21° 30' W, 61.0' S 87° 47' E, 26.49';
South 21° 30' W, 1293.82'; S 20 00' W, 74.89';
South 21° 30' West 277.0 feet to the P.C. of a curve to the
right said curve having a radius of 8544 feet, 3 central angle
of 4° 49' 12" and a chord of 718.58 feet which bears South
23° 54' 36" West; With said curve to the right an arc length
of 718.8 feet to the P.T. of said curve;
South 26° 19' 12" West 203.4 feet to a point in the center of
Rowlett Creek .for a corner;
THENCE up the center of. Rowlett Creek with its meanders as follows:
North 13° 48' East 179.8 feet; North 31° 02' West 164.2 feet;
North 26° 30' East 118.6 feet; North 3° 23' East 118.1 feet;
North 74° 13' West 53.5 feet to a point in the center of said
creek at its interesection with said East R.O.W. line of U. S.
Hwy. No. 75 for a corner;
THENCE North 180 41' East 1160.2 feet with said East R.O.W. line to the
PLACE OF BEGINNING and containing 16.3319 acres of land.
