AN ORDINANCE OF THE CITY OF ALLEN, TEXAS, CONTINUING
THE FREE PUBLIC LIBRARY; PROVIDING FOR A LIBRARY BOARD;
ESTABLISHING ITS TERMS OF OFFICE; SETTING BOARD
PROCEEDINGS; ESTABLISHING DUTIES AND RESPONSIBILITIES OF
THE BOARD; AND REPEALING ORDINANCE NO. 73 AND NO. 151 OF
THE CITY OF ALLEN, TEXAS.
WHEREAS, the City Council of the City of Allen did pass Ordinance No. 73 on
December 7, 1967, creating a public library for the City of Allen, Texas, and providing
for the creation of a library board, and on April 19, 1973, adopted Ordinance No. 151
amending Ordinance No. 73; and,
WHEREAS, on January 20, 1979, qualified voters in the City did adopt a City
Charter establishing the City of Allen as a Home Rule City; and,
WHEREAS, the present City Council of the City of Allen wishes to continue a
public library and a library board for the City of Allen, and wishes also to bring the
provisory ordinance up to date and in line with the City Charter, adopted on
January 20, 1979;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF ALLEN, TEXAS, THAT:
SECTION 1. AUTHORIZATION: The existing Library Department known
as the Allen Public Library shall continue in compliance with the City Charter, Article
III, Section 3.05 C.
SECTION 2. ESTABLISHMENT OF LIBRARY BOARD: There is hereby
created an advisory board known as the Allen Public Library Board which shall be
composed of five (5) members.
(a) Board members shall serve without compensation.
(b) Board members shall be resident citizens of the service area of the City
of Allen; the service area shall include the corporate limits, the extra-
territorial jurisdiction and/or those areas adjacent to its extra -territorial
jurisdiction.

(c) Other qualifications for membership shall be genuine interest in the
library and the community; ability to work with others; and time to
devote to this service.
(d) Board members shall be appointed by the City Council of the City of
Allen in accordance with established procedures.
(e) Members of the Allen Public Library Board shall serve for two-year terms
with appointments beginning July 1st. Places 1, 3 and 5 shall be appointed
in odd numbered years and Places 2 and 4 shall be appointed in even
numbered years so that Board memberships will be staggered. No member
shall be appointed to the Board for more than three (3) successive terms.
This provision shall apply to all future appointments. However, those
presently serving at the time of adoption of this ordinance shall have been
considered to have served one term of office. All vacancies shall be filled
for the unexpired term in the same manner as provided for in regular
appointments.
SECTION 3. OFFICERS: The Allen Public Library Board shall annually
elect a Chairperson, a Vice -Chairperson, and a Secretary from its membership.
Chairperson: The Chairperson shall preside over meetings and shall be
entitled to vote upon each issue. In the event a question
over procedure arises, Robert's Rules of Order shall
prevail.
Vice -Chairperson: The Vice -Chairperson shall assist the Chairperson in
directing the affairs of the Library Board.. In the absence
of the Chairperson, the Vice -Chairperson shall assume all
duties of the Chairperson.
Secretary: The Secretary shall keep the minutes of all meetings and in
the Secretary's absence, the Chairperson shall designate
another member to act as Secretary. The Secretary shall
read once a year, at the first regular meeting following the
appointment of officers, the Library Ordinance. The
Secretary may accept the assistance of City personnel in
taking and transcribing minutes.
SECTION 4. BY-LAWS: The Library Board shall have the power to
develop and revise by-laws for its own governance which will be subject to approval by
the City Council. The by-laws shall include provisions for
(a) Establishment of meeting dates.
(b) Establishment of and appointment to certain committees made up of

Board members and other lay -persons to assist the Board in the
conduct of its responsibilities.
(c) Board member's attendance requirements.
SECTION 5. POWERS AND DUTIES: The Allen Public Library Board shall
have as its chief purpose to act in an advisory capacity on policy matters to the City
Council and to the Library Director. In addition, it will have the following duties and
responsibilities:
(a) To use its influence to promote services of the library in the
community.
(b) To become familiar with state and local library laws.
(c) To recommend policies and objectives governing library programs to
the City Council.
(d) To establish and support a planned program of public relations.
(e) To attend Library Board meetings and other committee meetings
deemed necessary for promoting the library.
(f) To establish a policy for materials' selection to be used by the
Library Director.
(g) To recommend to the City Council various fines and the amounts to
be charged as fees for the use of library facilities.
(h) To solicit gifts and donations to the library subject to the approval
of the City Council.
(i) To review the proposed budget for the Library Department and
make any recommendations to the Council it deems necessary.
However, the Board is not authorized to add, delete or change in any
way the budget as prepared by the library staff.
(j) To plan for the future development of library facilities and
programs after study and review of the master planning guide for
the library.
SECTION 6. REPEAL OF PREVIOUS ORDINANCES: From and
after the effective date of this Ordinance, Ordinance No. 73 and No. 151 are
hereby repealed.
SECTION 7. PUBLICATION AND EFFECTIVE DATE: This
ordinance shall become effective immediately upon its passage and publication as
required by law.
